Here is our story as forwarded to Midway Nissan's e-mail:

My fiance and I had the WORST expierence ATTEMPTING to buy a used car at your facility. We were there for hours and after we walked out were contacted mercilessly on the phone for hours after that until we FINALLY were offered the deal and car we asked for. We drove it off

the lot and kept it for ALMOST TWO WEEKS before we were called by our salesman who stated and I quote, "We need to take a picture of the VIN. Can you drive it down tomorrow after work?" So we did and that's when we were FINALLY told that they were unable to finance the

vehicle and that we had to return it. We attempted to increase our down payment with BORROWED money and attempted to get co-signer's all to no avail. HOWEVER, vefore we had a definitive answer on either

the co-signer or the extra money for the down payment the salesman AGAIN let us drive it off the lot and stated that he would start the paperwork for the additional down payment. We drove home.

The very next day that salesman, Manny, called me AT WORK to ask when I could come in and sign the new paperwork and I advised him that we still had no answer on the extra down payment or co-signer. He stated that

he thought I said this was happening even though we left without a yes or no the night before. I told him I didn't want to deal with them anymore and that I would be bringing the vehicle back to them NOW and that they were to have MY TRADE-IN waiting in the parking lot

and ready to go. I arrived and had to wait AN HOUR OR MORE before the transaction was complete. NOW to top it all off we received a letter reading as follows:

Did you get your trade-in back?

Did you get your trade-in back? I sort of assume that is what you are saying. As far as the letters, I'm sure they are just generated automatically because somewhere in their computer system it shows you bought a car. Just throw the letters away or return them but you won't get anything by suing them, except lawyer's fees. Really a sad excuse for a dealership.

Rescending Law

#3Consumer Suggestion

Thu, September 07, 2006

I'm not sure about Arizona but in california they only have 10 days to rescend on a contract for a new car. Once the 10 days is up (and its 10 consecutive days. I had issues with weekends and holidays not counting for the dealers policy but the law reads clearly and I resolved it) They HAVE to accept the contract weather the can finance you or not. The actual dealer ended up financing me because I stuck it to them so hard. Know your legal rights in and out before ever financing anything.
