I foolishly fell prey to some scab. I brought a Refund Recovery System, so I thought. I paid around 40.00 dollars for it. I charge it on my credit card. If there is any you can help me get my money back I would appreciate it Thank you.

Thought I would input on this...most lenders refund ALL fees incurred if the loan cancels or is otherwise withdrawn, especially if it is rescinded after close within the rescission period. A reputable lender would cheerfully refund all fees. Most states require this, and lenders cannot supercede the state and federal laws, though they certainly try to do this with muddy language that has questionable legal status...and keep part of your money anyway. Push the issue with your attorney...you may be due the full amount back...and should get it back anyway. As for an appraisal fee, if you paid one, you are entitled to the copy, though you may not be entitled to have it reassigned, thanks to appraiasal lobbyists. I have yet to see a reputable lender come from NJ, especially Mount Laurel. Seems to be a home to a bunch of scam artists. Good luck.

PHH Response to Mary from Aloha, OR After researching your claim we were able to determine that a check in the amount of $295 was prepared and mailed out via UPS overnight mail January 29, 2003. This check cleared our account February 12, 2003. We apologize for the delay in your receiving the check refund, this was due to a processing error. We had every intention of sending the check that you were promised by Matthew McMullin on January 7, 2003. It was due to unforseen circumstances that we were delayed in the processing of this check. Our response to your claims that we misrepresented the funds we collected at the time of your application is as follows. It is our standard policy to review our refund policy with our customers verbally prior to collecting any money. The policy for collecting money on your loan was reiterated in the written documentation that we provided to you as a follow up to our verbal conversation. This policy stated, "Any money paid up front is non refundable if you decide to cancel your loan with us. However, if your loan is declined, $425 will be used to cover costs incurred (as permitted by state law) and the remaining balance will be refunded." As per our policy we provided you with a check in the amount of $295.00 which was cashed on February 12, 2003. The amount represents the difference between the $720.00 we collected and the $425.00 we retained to cover the expenses incurred on your loan as per our standard policy. Thank you for allow us to refute the claims that were previously made regarding our company and it's refund policies.
