i received my 20 G ipod ($399. +tax) at christmas time. When i used it in january, i realized i could not get it to shut off. I put it aside. I called the company and they recommended i buy insurance and i did ($64.00). The technician told me to "boot" it up and shut it off. In doing this, it lost it's formatting and i sent it to them. It came back in worse shape and couldn't be turned off and within 24 hours didn't work at all. I spoke to them they promised me a "new " ipod. the following week an empty box arrived. They are investigating and although various people i have spoken with promise me a new ipod nothing has happened. Today I was angry and complained and later received an email that i will be receiving a used or refurbished or new (ha) ipod in the mail. What can I do. I wonder if the initial ipod was refurbished. what is my recourse. I want to take them to court.

You can buy a good mp3 player for way less. There's no hard drive in an mp3 player. They're reliable. If you buy a big one, you get plenty of song storage capacity. Or, for only a little more than you pay for an ipod, you can get a laptop computer. You get a real screen. A bigger hard drive. Plus, it runs a lot more than just music files. An ipod is just a bad value, compared to other electronic items. Plus, it looks like the one you got is junk. Why am I not surprised? The best thing you could do is contact your bank and try to reverse the charges. Send them the trash back, and tell them to just keep it. Idiots buy ipods. Smart consumers look at all the options and demand good value. You won't find good value in an ipod.

The empty box is a return box... you send this one back and then they send you a replacement.

The reason they sent you an empty box, is so that you can return the defective ipod at Apple's expense. Peel off the address label; there should be a postpaid shipping label underneath it that's addressed back to the company. You pack the defective iPod in the box, and call the same shipping company that brought you the box, and they pick it up and ship it back to Apple. The replacement gets sent when they receive the defective unit. If it has been more than 30 days since you received the box, you've got to call back in and make sure the dispatch is still open (have the box in hand so you can give them the dispatch number, it makes life a lot easier.) Did you mean that you sent in your iPod already and rec'd an empty box in exchange? That'd be soooo weird, but they'll DEFINITELY take care of it if something like that happened. Those sorts of things get attention. The 'investigation' means they're verifying that it really happened, that's all. They tend not to like to get scammed out of free iPods, so they do investigate. I should mention also that yes, it does sound like an agent or two probably dropped the ball in your case, and certainly there were times when I thought the repair people needed to be taken out and flogged. But that doesn't mean the company doesn't do its best to stand by its promises - in the year I worked there I never saw anyone deliberately screw a customer but I saw plenty of things get screwed up just because the support people sometimes had more work than they could handle, and they rushed through things and just kind of screwed up. In any case, it seems to me you're ready to swap that iPod for a fresh one, and the company has agreed to swap it... so the issue will be resolved, albeit after a hell of a lot of time on the phone. It can be that way sometimes... :( It seems to me that this isn't a ripoff so much as a really bad logistical screwup. Finally, I should mention that you can always swing by an Apple retail store, there are several in NY, and take it to the Genius Bar. Bring your case number if you have it, or ask the Genius to look up the case, and the Genius can normally settle the issue right there, face to face. Sometimes that's the best way to get things taken care of.
