DAC/USIS is as big of a bunch of pricks as the company you worked for. Send a letter of dispute to DAC and explain that you believe the accidents were not preventable, and why. Tell them you want an investigation which should include police reports and witness statements. Tell them you want the items corrected or removed as per your rights under the FCRA. Send the same letter to the company. Send all letters by certified mail, return reciept requested, and put the certified # on the letter, save a copy for your records. In a separate letter, you can add a consumer statement to be placed on your report of up to 100 words that will explain your side to potential employers. Now, write letters of complaint for illegal activities by this company to everyone you can think of such as DOT state and federal/FMCSA, Labor board, IRS, FBI, etc.. Light more fires under them than they can put out. I had to do this against a large company who hauls glass in Medford OR. Now, just over 1.5 years later I got a letter from FMCSA. They are now screwed. It is a lot of work and you have to be dedicated to your cause. You WILL prevail if you do what I say. Good luck

Waller Truck Company is run by a family and clam of crooks and scammers! I drove for them and so did my brother, both quit because the bossman, Tim Crowly was a homosexual and one day he fondled my brother and told him if he wanted to keep his job, he better let him suck his d**k, and a fight broke out! My brother called him a fagget and he said he didnt like being sexually harrassed by a dude! My brother went straight to his truck, cleaned it out and said, I quit! He soon called me and I did the same a week later! To make it short, both me and my brother have terminated and equipment abandament on our DAC reports...Its made it alittle harder to get a job, but we was able to get it far enough behind us! You wanna job with a really good company, JB Hunt or US Xpress....Trust me, you'll make twice as much money, and both have dedicated automotive and other dedicated lanes in K.C.MO area and Sedalia MO to dest points...Good Luck Brother Trucker!.....Bigbadwolf

If you want to drive, try to buy your own truck and don't look back. I did this in 1993 and never regretted it. I was so sick of driving shoddy equipment, taking all the risks, yet taking crap from the office pinheads that have never driven a truck. I don't know what type of rig you drive, but you can make a nice living with a dump, flatbed, something within your financial status. Just start talking to people and see if theye'll give you some jobs. Once you get known in your area as a reliable person to deal with, you'll be fine. Don't listen to naysayers that will tell you it's too risky or you cannot do it. I will NEVER drive for anyone again, and my only regret is that I didn't do it thirty years earlier.

The reason truck companies find everything to be "preventable" is simple. They can deny you pay increases, and keep you locked into the company. No other company is going to hire you with "preventable" accidents on your record, unless they can do so at a very low rate of pay. The last thing a company wants is a highly paid "company" driver. I know. I was the #3 driver for the company I drove for. I was also at the top of the pay scale, and pushing about 3K-4K miles per week. I had a fast truck and drove the limit. No speeding tickets ever. They decided a wreck was preventable, even though the cops on the scene said it wasn't, and included it in their report. The load was sealed and the first driver on the load never properly blocked it in to prevent shifting. The police report showed the load had no locks or blocks. Cause of the minor wreck was shifting load). I tried working for other companies, but none would accept the "risk"...The risk of someone actually driving safely and not crashing into everything. They actually told me I should have anticipated someone in the hammer lane slamming on their brakes to get off the interstate on the off ramp. The off ramp was to the right of the right lane, 3 lanes over. Sure, what was I thinking? The funny part is this...first they fired me. Then they realized I did nothing wrong, so they rehired me while I was cleaning out my truck. Then 6 weeks later, they fired me again because the Safety Director was whining about not being taken seriously by anyone. Hard to take a guy seriously when he starts to cry. Then, I was rehired because the President of the company said I did nothing wrong. Then, I was fired again because the Safety Director had to have his way and went to the owner of the company. That was it. I am outta there! The best was yet to come. They said I could stay if I leased a truck and signed on as a contractor. Too funny. Be glad you're gone from whoever you drove for. None of them are worth a flying fart.

Typical. I'll bet this is why they called hitting the deer a preventable accident.

The company my boyfriend drove for previous to his current one gave him this booklet listing their definition of preventable and non preventable accidents, and deer were considered preventable because hitting one was "driving too fast for visibility conditions." Pretty crappy, huh? For example, if somebody hit you, no matter what the conditions, that was "failure to yield right of way." Somebody ran into your parked truck, you were "parked improperly." Your fence incident probably fell under something stupid like "driving too fast for weather conditions." I assume this is the result of companies trying to protect themselves from lawsuits. I would try being honest with potential employers, letting them know what they'll find on your record and exactly what happened so they won't be surprised. Hopefully you'll find someone who understands. Good luck!
