NatureHills.com Nature Hills Nursery Sent me a dead Hydrangea plant and will not replace it Omaha Nebraska

On 6/18/16 I was delivered a Nikko Blue Hydrangea Bush that I ordered from Naturehills.com on 6/13/16. It looked pretty puny when it was delivered but since it still had one thin green stalk on it I decided to plant it to see if it would thrive and survive. On 6/22/16 I contacted Naturehills.com via email to let them know that I didn't think the plant was going to survive and could they please send me a replacement. I received a reply from Naturehills.com on 6/26/16 telling me to wait at least 6-8 weeks to see if the plant could adjust to it's new environment. I immediately responded to their email and told them the plant died and to please send me a replacement since it arrived to me looking pretty bad. They responded that since I didn't notify them within 48 hours that I would have to pay half of the selling price and shipping for a replacement plant. Upon receiving this response on 6/27/16, I called Nature Hills Nursery and spoke to an employee who restated the same response, that I would have to pay half of selling price and shipment for a replacement plant. I ask to speak to a manager and she transferred me to his voicemail. I left my name, number and why I was calling on his voicemail. I still have not heard from him.
