Today is exactly 8 years after I involuntarily got involved with Leasecomm. I signed up for a credit card processing system with E-commerce exchange - 26707 West Agoura Road Suite 100 Calabasas, CA 91302 Tel. 800-748-6318 Fax 818-701-2400 [email protected], then on September 8, 1999 a representative of Leasecomm came into my small business I had just opened and said that the lease agreement was sold to them by Vendor: E-commerce Exchange (Vendors Bill of Sale). I tried to use the system online and it never worked for me, I called both E-commerce Exchange and Leasecomm several times about it, then I decided not to keep the system anymore, I explained that I would like to cancel the contract, and I was told that since I had a 48 months contract I could not cancel it, since its a non cancelable lease agreement.

Every month Leasecomm charged my checking account for $49.95 plus others fees, not to say that some other credit card companies were charging my checking account also, charges for fees for non usage of the system, proving once again I never used their system until July 2001 when I decided not to pay it anymore and on July 28, 2001 I got a letter from Leasecomm (Anthony Davenport Leasecomm Corporation) asking for the money. Then on August 25, 2001 two letters, same content to my both addresses from (Heather Shannon Lessee Relations), saying that I had a $114.90 pass due balance. Then on September 18, 2001 I got this treaty letter from Leasecomm with no ones name, neither signature:

You have chosen to ignore all communication from Leasecomm Corp. with regard to paying you lease-obligation.

Per request of the Leasecomm-collectors, we are preparing the paperwork necessary for filling a legal LEGAL ACTION.

This action will be filed within a few weeks from the date of this notification. At this point in time you will also start receiving phone-calls from the collectors. All expenses associated with the collection efforts will be invoiced and added to you balance.

The only way for you to avoid these unpleasant events is for you to make sure that Leasecomm receives your past due balance of $202.84 at their offices at 950 Winter Street, Waltham, MA 02451 within 5 business days from the receipt of this letter. If your payment has crossed this letter in the mail, please accept our apologies.

P.S. We are using the legal system in all states to enforce Leascomm's lease-agreements. Any court Judgement in Leasecomm's favor are being enforced by local authorities nationwide.

As required by law you are hereby notified that a negative credit report reflecting on you credit record may be submitted to the credit reporting agency if you fail to fulfill the terms of your credit obligations.

The another letter:

Your account has been referred to our legal department to commerce legal proceedings. Prior to filing a law suit I would like to try to resolve this matter amicably, before additional legal fees will be incurred which you will be responsible for.

Enclosed for you review please find a copy of the lease agreement. You executed our standard non-cancelable commercial lease agreement. Prior to funding this lease, our credit department verified with you the installation of the product, that it was in good working order, and the terms and conditions of this leases, at which time you agreed to the terms.

Any problems you may have with the product, or with any service associated with it, are not our responsibility but between you and your dealer that you acquired the product from. Also, our lease agreement states clearly that no verbal or written side-agreements you may have entered into with the dealer may override the terms and conditions of this lease.

Unless we hear from you within 10 days of this letter, Leasecomm may file a law suit against you. Please read your lease and see that you consented to the jurisdiction of the courts of Massachusetts which is where the case will be tried.

I have been disputing this account with Leasecomm since then, and in writing since December 6, 2004 and since then nothing has been done, but one thing is for sure: they never took me to Court because they notice who knows their rights and put them in writing and go before the Judge to reinforce them.

They called me when they received the letter on 02/25/05 at 3:50 EST from 617-890-8600

I spoke with Hank Cokash (lessee relations) at 800-843-5327 x 8620 about this account and he explained to me that I have signed a contract with Leasecom and I paid until 2001 and there's an outstanding balance $1,913.40.

I am glad I live 30 minutes away from Leasecomm, actually the same Middlesex County where I am a Notary Public and I know my consumer rights under the Laws of the state of Massachusetts: www.mass.gov/consumer www.mass.gov/dob -

Since Leasecomm has kept collecting their money without providing me with any services or product (Massachusetts General Law CHAPTER 93A. REGULATION OF BUSINESS PRACTICES FOR CONSUMERS PROTECTION), made a mess to my credit worthiness for so long, collected all crazy fees they could, threatened me, and they never took me to Court as they have threatened me saying they were going to, now I am going to take Leasecomm to Court and ask them to explain not only my case but hundreds if not millions of case all over the US. There are 146 reports here on www.ripoffreport.com against Leasecomm and I will be the 147th. I have consulted an attorney about my rights and I wish I could see all of you there at the Massachusetts Middlesex County Courtroom to claim our losses. If you are victim of Leasecomm, lets go there together. We have nothing to loose but to reinforce our consumer rights and let the others, who are afraid to face them. They can pay their best attorney in the world but our rights as consumers will not be changed and they will end up loosing any way because the money of this world will not leave this world, and if there's no attorney to defend us in this fight, do it yourself and let Leasecomm be their own judge and they will live with that remorse until they face their own trap before our Major Judge, God!.
