I am a few months behind on payments and they called the previous tenant of the house I am currently living in and old them I was telling people I owned the home. They made harrassing threats to the previous renter and in turn she contacted my landlord. My landlord now is aware that I am having a financial hardship when it was not his business; especially since I've never been late on a rent payment. They call all the time at least 10 calls a day with an automated system and people. They say they will work with you, but charge you for every payment you make to them. They 'help' you by attaching the few months your behind to your existing monthly payments so you will be paying even longer. They will not allow you to pay every other week without charging you a late fee. They obviously know where I live. Why not just pick up the vehicle and be done with it.

Oh poor baby.  The big bad bill collector keeps calling you because once again you don't do what you contracted to do...pay your bills on time.  Of course, that's nothing new for you otherwise you wouldn't have been placed with a subprime deadbeat lender to begin with. All you're hear wailing about is their collections efforts which YOU turned on.  Oh yes...poor, poor baby.

So why don't they just pick up the vehicle?  Don't worry being a few months behind it is only a matter of time.  But you will NOT be done with it...it will just be starting.

You see when your vehicle is reposessed it does not just make the loan go away.  By law they will sell the vehicle at auction.  Which because it is an auction it will sell for about 25%-30% of "blue book" value.  That amout is deducted from the balance of your loan.  They then add in the expense of the auction and reposession.  If there is still a balance due..YOU are legally responsible for that.

If you fail to pay that balance they can continue collection efforts and even file a suit against you.  You will most likely loose and get a judgement against you.  Now, I do not believe that Texas allows Wage Garnishment.  However, there is nothing that would stop them from attaching your bank account.

Oh and as for them saying they are willing to help.   They are willing to help..you just don't like the help they are providing.  You like many have some very strange thoughts of entitlement where you feel that you are not only allowed, but they are required to allow, you to just change the terms of the legally binding contract you signed when they gave you the loan.   This is not how it works.
