On Oct 1st, 2016 my husbnd and I purchased a used car from Five Star Mitsubishi Altoona. We told them, before we even looked at any vehicles that we had three issues that needed to be taken into consideration: we explained we were disabled and therefore were on a very, very strict budget; discussed a four car accident we were involved in, which caused me myriad injuries, and almost death; and that all we wanted was a safe vehicle.

We were assured we would be treated fairly. Therefore, we purchased a used car from them. Within an hour of driving it off the lot, I almost had a serious accident as the whole front bumper flew off the car while I was driving. I pulled over and had an extreme panic attack as well as incurring my PTSD to increase substancially.

I was able to get home, get my husband, and went right back to Five Star Mitsubishi Altoona and told them what happened and that we did not want this unsafe vehicle. They would not let us return it, although I have found out that they must give the buyer a grace period to return the vehicle for whatever reason.

They said they 'fixed it' but it happened again. My husband brought it down and tried to explain to them the damage to the car existed before it was sold. They bullied, coerced and tried to make my husband admit we did the damage. He is bipolar and began to panic.He said 'maybe' just to get out of the dealership and their unethical bullying.

After that, more issues began to come to light: the problems with the bumper caused the car to begin to mildew as rain and such could easily get into the vehicle because of the bumper issue. We also had transmission problems, whereby the car bucked and pulled; and issues with the brakes locking. I then tried to mediate with the owner, but he did nothing but put us in a small room where he and five other of his employees surrounded us and kept calling us the liars who caused these problems with the vehicle.

I then contacted Carfax and discovered that this car did not have only one owner who had just traded it in. The car was used as a rental car and had also been in a severe accident which was not disclosed to us. We have been manipulated, lied to, berated, and treated like criminals who were trying to renege on our deal, which is just not the case.

I have much information to back up my claims. So not only wasn't the car safe, was on the lot for many months, not just traded in as stated, and owed by a company who used it as a rental car. Their unethical business practices and lies have caused immense mental and emotional issues.

We want them to take this deathtrap back. It is unsafe and we were 'tricked' into purchasing it based on lies and poor consumer practices. In addition the loan which we were told would cost us $200 a month, but is actually costing us $460 a month, which they knew from the outset we could not pay. I also want the three months payments that we made, as we are now behind on our bills due to their deception. And I want them to deal with the loan company and get us out of both contracts asap.

Your disability has nothing to do with this

First off using your disability to gain sympathy often has the opposite effect. As you stated that you wanted a "safe" vehicle. Really, so I guess people that have never been in an accident want a "Death Trap". You said you are disabled and on a strict budget. Really, so people that aren't disabled aren't on any sort of budget and the sky's the limit as far as the car they buy?

See the point? You are asking for things that EVERYONE wants and your disability does NOT matter and doesn't entitle you to any "special treatment" when it comes to purchasing cars.

Contrary to you thinking the "law" is on your side, it probably isn't. There isn't a single law that puts any sort of uniform "grace period" to return a car. Now, if you have something to the contrary please post the SPECIFIC section of law that gives you this grace period.

Dealers can at their option give you a grace period by writing it into the contract. Now, if it was in writing and you attempted to bring it back in that time then yes you have a very valid complaint. But I don't think I would be going too far out on the limb and say that there is no such clause in your contract.

You are basically asking why you should be responsible for a car if it breaks down 20 minutes after you leave the lot. Well I have some bad news for you. If you did purchase the car "As-Is" you are not only responsible for anything that happens 20 minutes later, but anything that happens as soon as you sign the contract. Yes, if you leave the office go outside and put the key in the ignition and the engine blows up...you are responsible. Of course it sucks if that happens, but that is what "As-Is" means, it doesn't mean "As-Is" as long as everything is okay, it means that you are responsible for ANYTHING and EVERYTHING. Sorry but that is what the law states.

The ONLY other chance you have would be is if you can show fraud on the part of the dealer. For that you would have to prove that they knew it wasn't safe or they told you something that they knew was factually incorrect...this is a very hard standard to reach because it would basically have to be something in writing.

You are going on the assumption that your CarFax report is the "smoking gun". Well it is proof the car was in an accident, it wasn't proof that the dealer knew about it, and that is a BIG difference.

By the way the time to look up the CarFax report was BEFORE you bought the car. The time to have it checked out by an independent mechanic was BEFORE you bought the car.

First of all you have no right to judge me or berate me for the mistakes of Five Star Mitsubishi. What do you work there or something? It sounds like the same kind of bullying and bull they tried to spin on us. You can believe what you want, but you know nothing of me or our disabilities and how they affect us so who are you to rant and rave that we are in the wrong? You have no right to attack me or my experiences so keep your opinions to yourself because you know nothing but what you've read. You do not have the documentation or the Carfax reports which prove unethical behavior on the part of the seller.

Second,you're actually saying to me that once the car is off the lot, even less than twenty minutes, and it starts falling apart on the highway that it's my fault? Too bad you have nothing better to do than harrass someone who is trying to take care of herself and her husband, as well as warn other consumers of their unethical practices.

You have shown me nothing that explains or justifies Five Star Mitsubishi Altoona's tactics or what we have been going through. Let's just see how you would feel if you were treated in such a demeaning way and taken advantage of. I'm sure you're unfeeling and rude attitude would change in a second.

So find someone else to attack and get off on by being a horrible, uninformed 'person' who has nothing better to do than make things worse for others. Just disgusting. PS The law is on my side and I will prevail.

 While its unfortunate that these issues are happening to you, the REALITY is that YOU signed paperwork to the effect that YOU understood the purchase was AS IS. This means YOU can want in one hand and poo in the other, YOU signed away ANY return the moment YOU drove the vehicle off the lot. Unless YOU purchased an extended warrenty, which MOST consumers DO NOT, then ALL of the repairs are on YOU. Sadly your disability doesnt exempt YOU from the local laws of your state in dealing with a used vehicle purchase. There is ZERO help on this one. Your only options are continue paying the loan, or let them repo it and take the hit on your credit. YOU could just pay it off completly but thats a choice thats on you. I get that you have some disabilities but do ANY of those disabilities keep YOU from using common sense? I only ask because its common knowledge to have ANY used vehicle YOU wish to purchase checked out by a trusted mechanic. If YOU did not do this then YOU really ONLY have yourself to blame. YOUR accounting of the situation is skewed by YOUR own bias. YOU would say ANYTHING to paint THEM in a bad light and make yourself a more favorable victim. Hence WHY you bring up your various disabilities so many times.
