I discussed buying some email marketing services with Ryan Kluck of Exact Data (there is an alias floating around as well).  Mr. Kluck mentioned a figure of X number of emails and Y level of service for about $1,000.  I said that sounded OK (as in "so far").  He asked me for my credit card number and I balked saying, in effect, that "I need to see something in writing".  He reassured me that I would "get a signed contract that spelled everything out" and his tone dismissed the credit card as an agreement to transact.  I gave him my credit card number thinking it was a credit check.  He referred me to an account manager, Jayme Berkowsky, who "would take care of me, get me the contract, and take it from here".  Oh yea, and he said "Thank you for your business." 

I got off of the phone and had this gut feeling and for good reason.  I checked around on the internet and read some of the narratives about this outfit.  Within an hour I had emailed both Kluck and and Berkowski saying "No thanks".

That evening around 2 am I awoke again to that same (I've been conned) gut feeling and called AMEX to cancel any approval that they might have made.  Exact Data had already called to get approval and it could not be retracted said AMEX.  I put a "contested" status on any actual billing that might ensue.  Evidently, with Exact having approval, there was no stopping Ryan Kluck from just billing away for payment not agreed to and for services not delivered.

We will see how this goes down with AMEX but I really feel (not only stupic, but) scammed.  These people could pull this off with enough frequency to sustain a business without ever delivering any service.  I was having a bad day and vulnerable, I suppose.  But.........ladies and gentlemen is this the new normal?  Is Exact Data just another virus?  Exact Trickster, Exact Scam.

These sharks have their routine down.  Hopefully AMEX will take care of their customer in a fashion that is somewhat different than I was "taken care of" by Exact Data.

There is no “Marinata” in our CRM, and the other names mentioned (except “Ryan Kluck”) are neither current nor former employees. This person may or may not be an actual client – it’s hard to know without a real name. The complaint goes on to say we sell gold – we don’t. Perhaps he has us confused with another company.

There is a comment posted by “James Constantino” on July 9, 2014. You received a quote from John Zmuda that included a “save fee, fulfillment fee and multi-use fee”. The “save fee” ($5) is for us to store your order, so that if you order again, you can “exclude or suppress the previous order”. The fulfillment fee (ranges from $50-$100) is industry standard. List managers, including Exact Data, charge a fulfillment fee to cover the cost of 3rd party data warehouse upload fees. And the multi-use fee. If you have been purchasing data for one time use, and using (or selling) it multiple times, you are breaking the most basic rule in our industry. There is a “single use” and “multi-use” prices. All lists start with a “base rate”, then have select and multi-use prices added.

I was in the market for some speciality data we do not collect, and looked around for a reputable company to purchase from.  Well we sent a request to Exact Data and got a call from a John Zmuta.  We do wholesale purchasing and selling of data and been in the business for 27 years.  We were going to pull this speciality data but had no abstracters in the areas we needed it.  So like I said we contacted a few companies, and we asked for quotes from five of them.  Well all fell in line, but exact data had a weird quota method, the included a save fee, fullfillment fee, and multi use fee.  I was curious on this because we have never assessed any fees like this to our clients, and again we have been in the industry for many many years... So I had my skip tracers do a due dilligence on thisd comany and found multiple law suites, and formal complaints against them to actual government entities.  I am amazed they are still in business.

Below are just two cases against this comapany for misrepresenting the work product:

These are only two of many out there.  I would suggest anyone doing business with a data person verify they originate their data or do not do business with them
