My precious daughter Elaine Stewart died in a tragic accident 2 years and 7 months ago today. Thirty-eight years old, Elaine had never married, had no children and died intestate.  Successful professionally, she had a lovely home in a wonderful neighborhood near Albuquerque; thanks to CitiMortgage, it still stands neglected and empty.  This neglect further breaks my heart--

Elaine was current on her mortgage payments. And 2 years and 7 months ago, her earthly home was worth much more than the mortgage balance.

Unfortunately, CitiMortgage (CM) had obtained Elaine's mortgage from her local bank. As her court-appointed legal representative, I quickly notified CM and offered to do whatever was best for CM to expedite the sale and avoid the expense of foreclosure.

What has happened and not happened since, I do not understand. I have a stack of papers over 2 inches thick: over and over, to Elaine in "default"; over and over, to the Estate of Elaine Stewart; over and over from Susan C. Little & Assoc., an Albuquerque law firm; and for the last seven months from The Castle Law Group, another Allbuquerque firm.

Seven months ago on the two-year "anniversary" of my dear daughter's death, I posted a ripoff report about CM; they are evil and incompetent. Someone from CM called and said he would look into it and get back in touch with me. He did not call me back and was never available when I called his number. Evidently all he did was fire Susan C. Little & Assoc., hire Castle Law Group and let things start all over again. Mid-Dec. another letter was sent to "Elaine Stewart Estate" thanking her for the "opportunity to service" her mortgage needs....Merry Christmas....

My son and I have been defendants in a law suit with CM as the plaintiff for over 2 1/2 years.  We cannot afford on-going legal assistance. Fortunately, we have avoided being tricked into agreeing that we are "liable for default judgment." And the Court knows and has legally acknowledged that my son and I had and have NO INTEREST in Elaine's property; we did not co-sign her mortgage and we made no mortgage payments. How can we be defendants when we have nothing to defend??

My son and I are being harassed and now, almost 74 years old, I am suffering from elder abuse. We should be the plaintiffs with CitiMortgage, Susan C. Little & Assoc., and The Castle Law Group as the defendants.
