I am writing this report so that others do not get caught the way my husband did by Arrow Financial and their attorney Charles Litow. Our story begins back in 1999.

My husband signed a written contract with a company to have a softwater system installed in our home. over time we did fall behind in our payments. That is when we were first contacted by Household bank. We made our payments to Household by check.

In 2006 Arrow Financial filed a judgement against my husbands wages claiming it was a credit card debt.  Nev r hearing about this company before we contacted them and told them we did not have a credit card through household bank.

My husband was then contacted by Charles Litow who lead my husband into believing that he could prove he had a credit card debt. My husband signed a confession of debt through a credit counseling service in the amount of $5,932.01, with an interest rate of 23.24 per annum.

The bottom of this confession reads that without further notice to my husband and without order of the court, all pursuant to Iowa Code Chapter 676.  What this means in laymans terms is that this lawyer can sue my husband until they bury him because he will never pay this bill. What it also shows if my understanding is correct is that Mr. Litow diguised the legal process.

On Oct 4th, 2011, Mr Litow sent us a letter stating that we had paid close to $10,000.00 on this account and he was wanting $6,000.00 more. Oct 30, 2011 I sent Mr. Litow a Letter requesting that he stop his collections on this account since I felt we had more than paid off the original contract.  A couple weeks pass without hearing from him. So I send him another letter requesting that he show proof of the credit card application.

On 1/25/2012 the first dollar amount is taken from my husbands wages. This time I tried to contact Arrow Financial by phone only to be told by an employee (Mr. O'Mally) that there was a cease and desist on my husbands account. He told me that he couldn't talk to us and we couldn't talk to him about this account; However they could still continue collections.

On 1/26/2012 I sent a certified letter to Mr. Litow and Arrow Financial requesting Valdiation of this debt. The request included validation for the following:
payment history
original creditor
credit card agreement
Proof that the statue of limitations has not run out

On 2/2/2012 we received from Mr. Litows office a copy of the signed confession and nothing else.

I have sent another certified letter stating that his claim is in dispute and request validation of the above again; as of to day, I have heard nothing from his office. However, he is still collecting.

Trying to figure out this mess I went to the court house and pulled all the documents regarding this case and found the following:

1. Mr. Litow has been sending the notices of garnshments but he has been sending them as C/O letters to companys we have never heard of until we pulled the court documents.
2. Mr. Litow has been using County Sheriffs (not ours) to send these notices

My final thought is this don't sign any documents for Collection agencys or their Lawyers until you have them validate the debt and check your state Statues to make sure the statue of limitations has not run out on their ability to collect.

Sue Him he has violated your rights. Check out the Laws FDPCA. Send him a Validation of Debt Letter by Certified mail then wait 30 days, then file a Law suit against him.

Go get em :)
