My husband received a letter last night from CAMCO, from a Mike Thomas. He called Mike Thomas who explained that he owed $2295 to Chase on a debt that was dated 1988 (sixteen years ago!). Mike Thomas told my husband he finally located him regarding this 16 year old debt by contacting his American Express and Bank One accounts (meanwhile my husband has lived at this address for eleven years). Mike also mentioned that my husband had an "impeccable credit report", so obviously he ran a credit report.

Our first reaction was to pay this amount asap (although my husband denied the debt was his while on the phone, and refused to provide any personal information whatsoever; but after he hung up, we realized it was his debt which he thought had been written off many years ago). I went online and did a search for CAMCO and found your website. From there I learned that he should write to CAMCO telling them that he was aware of the Statute of Limitations in New York and that he considered the matter closed and not to contact him again. We are sending it to them via certified mail on Monday.

Is that enough for now? Is there anything else we should do or should we wait until we hear from them again, either telling us they are dropping the matter or that they will sue us? Should we request validation of the debt at this point or wait?

Camco is done. You may have noticed they just sold off all their debt and there is a very good chance all the officers and owners will be banned from the collection industry for life. I would really like to know what 'proof' you are talking about. We both know camco has nothing in the way of media so your so called proof is only some bogus affadavit of asignment that would not hold a thimble of water in court. I would say go get another job but we both know alot of CAs out there will not hire camco employees.

ah ha..camco will be opening its doors..the law state that they would only pay back the money to those who actually never owed the debts..our attys are great..the whole point is, if you owed the money your gonna owe it cause you incurred the debt..to get your money back at this point your gonna have to prove that you didnt owe it..stats does not apply..the argument is that you all (say) you never had the loan, credit, etc..the original docs on the acct are being pulled by the courts, and if the individual did owe the debt the will not receive any refund ..because they volenteered to pay the debt. now..for the ones who really didnt owed the money, or was "threatened" harrassed etc. and didnt owe the money u may get ur money back. i hope u guys kept payment info on these so called bogus accts. and as for any other company u focker are just gonna have to deal with it..pay ya bills ...cause the law states ...we may attempt to persue time barred debts as long as we comply with the rules of the fdcpa.....so what about the good collectors huh? the ones who made sure that all the basis were covered?im talkin bout "mini maranda" and dont play dumb when that maranda right is stated alot of u debtors just hang up...but once we get it out(the mini maranda) we can call and call until u are fully aware of our collection program. as long as im polite but direct and fully inform the debtor also confirming (ssn #),dates of birth last payment dates, a full blown credit report..im talkin bout all the goodies? if i have the info on the debtor and i have followed all rules and regulations according to collecting the debt and they pay...i have done my job..see; debtors paid me because i was nice and i just stated the facts...folks asked for proof, i fax it, mailed it, or whatever i had to do to let that person know i was legit. i can not make them pay but i have never theatened or harrassed a person to make a payment, after i stated the facts if they paid, they paid, simple as that.i have had debtors call the office and say ok i know i owe the bill but its out of stats or u guys cant sue me...but people we have a job to do.and we have kids to feed and bills to pay...so i wannna say to all the collector who do not harrass, who do not theaten and who did not violate the fdcpa..good job..because we are all debtors, so there is no need to point the finger. and the key to success in this business is respect both ways...camco will be back in business real soon other companies will learn from their mistakes..and to any body collect a time barred debt..continue! u can ..just follow the rules of the game. i got alot more to say..but it dosen't matter the law is written to the effect that this is ok..it's just they way u do it...and so it begins again..by the way camco i dont want my job back...i just wanted to open up peoples eyes..i love my stress free life now..im just glad that collection efforts will continue..especially the people who called me at the office harrasing me... got get ya checkbook.because now if they can prove it...u'll pay it one way or the other..peace...ps dont get into debt because the original companies will ganish wages or pesue in a court of law because now they are being summoned to the courts for timebarred debts and cant get there money.oh u better believe it..they sue before stats is up now...they will not take any chances..good luck..fockers

Thanks, Kevin. I will cc: those individuals in my letter to CAMCO. This is what I was planning on including in the body of my letter ... any suggestions would be appreciated. "Dear Jeff Garrington: I am in response of your letter dated November 16, 2004 (copy enclosed) which I received yesterday, November 22, 2004 about a certain debt that you are attempting to collect. I have checked with my State Attorney General and verified that the legal Statute of Limitations for collecting this type of debt in New York has expired. Now that you know I am aware of my rights in this matter, consider this letter as my official notification that I consider this matter closed and demand that you, or anyone affiliated with your company, stop contacting me regarding this matter except to advise me, via official mail only, that your debt collection efforts are being terminated or that you or the creditor are taking specific actions allowed by law. Be advised that should you decide to pursue this matter in court, I will invoke my rights and use the expired statute of limitations as my defense. Additionally, I must advise you that I am keeping careful records of all correspondence concerning this matter including a recording of any phone calls." Kevin, is this sufficient? Thanks again for your input.
