American Home Shield refuses to acknowledge or repair damage they caused!

The facts: The plumber AHS sent out to repair water leaks under our kitchen sink missed the real leak and now we have damage to the wood flooring and cabinetry. AHS says this is "Secondary damage" and their contract clearly states that they do not cover repairs for secondary damage.

I contend that this secondary damage would not be there if they had correctly repaired the leak in the first place. There were two leaks under the sink. The plumber they sent out fixed the minor leak in Sept 2001. My wife pointed out the second wet area under the sink and the plumber said not to worry about it. That it would air dry and be fine.

Two months later, the second wet area is still wet and now there is sub floor damage to the hardwood flooring. Turns out the dishwasher had a bolt work itself loose and was shooting water out with every use.

The cabinetry between the sink and dishwater is very damaged with wet rot and the flooring to support the dishwasher is essentially gone!

AHS has been stonewalling us in regards to this issue. They stand by the wording in their contract. However, they (their agent - the plumber they sent out) cuased this damage through their negligence!

The house due to mold and mildew is causing significant health problems to our family. I have informed them of this fact and they still claim no responsibility for the damage or willingness to repair it. They say I should take this up with the plumbing company (who does have insurance) Yeah right! They are also blowing us off.

Next call is to the Calif Attorney General!!!!

I suggest all other people with compliants do likewise. If enough of us get together we are talking class action lawsuit!!!

Then most people find out they're as bad or worse than insurance companies as far as trying to get a claim paid. For starters, they pretty much have free reign because they call themselves "risk retention groups" and many state's Dept's of Insurance don't regulate RRG's. Even if the word "insurance company" is in their name they still deny they are insurance companies. Many are backed by such bogus insurance co's/RRG's which some states still refuse to recognize and regulate as the insurance companies they mimic. Another thing home warranty companies are good at is having arbitration clauses that take away your right to sue, and your right to appeal the decision. The arbitrator is usually chosen by the warranty company itself, too. And, when they decide against you, you may not be allowed to even talk about your case. That, coupled with the fact that arbitration is not public record like court cases are, makes it super easy for warranty companies to hide true numbers of denied claims or unhappy customers. Another thing about arbitration is that it does not just cost the few hundred dollars for the filing fee like they tell you; it can cost many thousands as the hourly rate for experts and arbitrators adds up. And you probably will still have to hire an attorney. They will have an attorney. Many fees are not recoverable in arbitration as they are in court, either, (should a mirical occur and you win). Stonewalling, buck-passing, denying, etc...this is all you'll get most of the time from home warranty companies.
