I purchased a John Cena (item #5198584282) picture autograph from Mr. SCHNEIDER through www.ebay.com on Friday, May 20, 2005 about 13:00 hours. Six days later, May 26, 2005, I sent Mr. SCHNEIDER an email simply asking when should I expect my package. In his response, he was very rude. I have pasted emails and headers below. Anyone wanting me to forward them a copy of an email please post leaving your email address.

Mr. SCHNEIDER is very rude and I suggest not doing any business with him. I do not know how he got so many positive comments. I do know that recently, he has been getting alot of negative comments. I can only tell you of my experience with this man. Notice, my question never gets answered. I had to delete the "email addresses" due to posting rules. I still did not receive my picture.

PAYPAL:

May 20, 2005 Payment To Dave Simmons Completed Details -$20.93 USD

May 20, 2005 Payment To ALEX SCHNEIDER Completed Details -$23.41 USD

Dear northeastboy,

I need to know if you mailed out my picture yet and when I can expect it. If you are not going to mail it to me, then I expect a FULL REFUND. Please let me know what you choose. If I do not hear from you, I will do whatever needed, including filing a complainait with FCC. sellers have up to 30 days to send out an item and try to bid on ebayers with higher than 98% feedback.

#2Consumer Suggestion

Hi Lisa, I am sorry you had such a negative experience. Please note in the future that sellers have up to 30 days to send out an item and try to bid on ebayers with higher than 98% feedback. He could have written you to let you know that he received funds and when he would ship out. Some sellers have specific days that they ship items on. Also, some PO( post office ) are closed on the weekends. You were right to find out where the item was but I didn't find him rude just stupid. I will make sure to block him the next time I buy. Also, may I ask why your i.d is private?? Please note I am not trying to be ugly just helpful. If you have any questions please feel free to email me as I am a seller on EBAY and love working with my customers.

MR. SCHNEIDER sent an instant message to my AOL account this afternoon. However, he spoke to my cousin, who was watching my children while I tended to my younger son in the hospital. My cousin said Mr. Schneider would consider not taking legal action (Sue me for slander) if I would apoolgize to him. Mr. Schneieder, I am sorry for making your communication information public. I have tried to rectify this matter by submitting an email to this website requesting them to remove your ebay screen name and address. I cannot edit this information out because I do not have access to the functioning of the website. If there is anything else I can do (within my limits)to rectify this matter, please email me letting me know.

Product received today - Of course my negative feed back was taken away by ebay!

#4Author of original report

Sat, June 04, 2005

Finally, I got the John Cena Pic today. I have to say, even though this guy was very rude, he packaged it nice. I had to block this guy from emailing me because he sent me about 15 emails in one day. I read one, and it was so childish, I decided to just block him and to dump his unread emails into the spam folder. Of course my negative feed back was taken away by ebay, but that's ok, because someone else complained about him and left negative feed back. So, it's not only me. Just because he has over 3,000 positives doesn't mean he has the right to be rude.

Also had some trouble ..what do you expect from an -AOL user- with a name like "HACKED666

#5Consumer Suggestion

Fri, June 03, 2005

I just completed two auctions with northeastboy. I got an awesome deal on some boxes of cards and received the merchandise a couple days ago in good order. However, I experienced similar frustration with his poor communication. I, also, inquired about the status of my order a few days after I had payed with paypal. I received a short response that did not answer my question. I decided to give him some more time and not overreact. Eventually, he emailed me, I think the whole email was "item shippedups." written without the space and everything. I felt a little insulted. But hey, I got a great deal, received my item, and left positive feedback. I don't think he would rip anyone off. He has shitty communication - but what do you expect from an -AOL user- with a name like "HACKED666"???

I just wanted to let you all know, my first email to Northeastboy was not intended to be rude. I just wanted to know when to expect the package. I didn't think I had to explain myself, since I am an adult. I just wanted to be sure the package arrived in time for my son's kindergarten graduation, since it was a gift for him. And since it wasn't here on time, I had purchased another present for him. AS of, June 2,2005, I still did not get it. If you look at my first posting, you see I made a purchase the same day. I received that package within 4 days. The seller contacted me and let me know when he shipped the package and when to expect it. As far as Ebay goes... I will not purchase from any new sellers.

The whole FCC thing

#8Consumer Comment

Thu, June 02, 2005

No doubt that the seller is an a*s, but outside of that... I'd be totally on the buyer's side here if it weren't for the FCC threats. If you're going to make threats against someone, at least make threats that are valid. I think what the whole problem here is that the initial contact on the 26th, while obviously INTENDED to be just a simple query by the buyer could be taken as pushy and demanding. Perhaps a better way to handle the situation would have been an e-mail that said "Wanted to ask if you could please tell me when the item was shipped so that I can know when to expect it." and that should have been done at auction close as well, but that's neither here nor there. The reply back looks as if he took it that you were saying "Where the hell's my item?", which I can see. I often write much like you did in the first message and it is sometimes misunderstood much the same as yours appears to be. It could have stopped there. Your reply back to his message (His first reply could be taken as completely sarcastic or merely a statement of fact... Hmm... Just like YOUR first message) contained threats. Threats which were comical. The FCCs involvement on the internet is minimal and technical in nature. For future reference, if you feel the need to threaten a seller, the first stop would be with Ebay, then with PayPal, then moving on to the local district attorney in the sellers area. The FTC WOULD be interested, as well as the USPS (Assuming they became involved at any time) but not on a $20 item. Now, if there were 5,000 $20 items involved... My final verdict on this whole thing. Both of you had the chance to act like adults and passed. A good rule of thumb is that you give a seller 7 to 10 days to get the item to you (mail days, not including holidays) therefore, if the item has not arrived by today, June 2nd, THEN you start Ebay and PayPal proceedings. My time start for 7 to 10 days begins on the 21st because the auction ended at 4pm on the 20th, so scratch that day. As for the "other shipping options", a charge of $3.00 for shipping indicates USPS. You're the least wrong out of the two parties involved, but being the least wrong doesn't make you right.

Matthew I sincerely apologise for any misunderstanding. I most certainly was not referring to you or anyone else other than Alex and Denny as 'lowlifes'. They are so arrogant and I wonder how anyone can get so bitter and twisted about the very people that they are earning their living from. I thank you for standing up for Lisa - these two other big tough heroes obviously relish picking on ladies. At least they are an example to all the children of the world because if today's kids strive to be the opposite of Alex and Denny they will be model citizens.

Wally, you never fail to entertain me however you said that lisa has drawn out two of the biggest low lifes on this site.. I certainly hope you are not refering to me. I have been in full support of lisa this entire time. I am not one of those arogant ebay sellers.. Im one of the few good ones. But to further back this up so it has a legitamat reason to be posted, I will add that you do good by not joining ebay. It really does take quite a hassel off your hands.. but in my case I have things I dont want anymore and would rather sell them than just get rid of them. A leather jacket, some movies from time to time, old video games.. I also like to do those odd auctions just to see what kind of wierdos I can attract.. Keep watching.. Ill soon be selling my Ex fiance's engagment ring.

Please Sir Denny accept my apologies for doubting you. I and the rest of the billions of dumbasses don't know what it is like to be a man of your standing. Fancy we dumbasses who pay you money for your goods expecting service as well - how stupid are we?????? We should expect you to hide behind the fine print and take every one of those 30 days before you get off your backside to ship our goods. Our expectations that you would ship as soon as you receive payment is laughable isn't it - we are mere buyers - the scum of the earth - dumbasses each and every one of us. Lisa, Matthew and all you other dumbasses please don't inconvenience King Denny any further - please just pay your money and p*ss off and stop bothering him - he is so superior to all of us - HE IS AN E-BAY SELLER - (applause and adulation please)He is a legend in his own mind and wow don't I wish I could rise to the pinnacle of the business world like Denny has and become an ebay seller. I hope all of you dumbasses see the error of your ways and now understand how superior to us Denny and all of the Ebay sellers are. I bow my head in humility. PS I don't have an ebay ID because I have seen so many people get ripped off by ebay sellers that with the small pea brain that I have I decided to keep my money in my pocket rather than gamble - sorry Denny you can't block me - but hey why not block all of Australia - it's only a mere 20 million people but that would show them how superior you are wouldn't it. PPS Thanks for the entertainment Lisa - I'm sorry you were inconvienced but you have drawn out 2 of the biggest low lifes on this site - well done and continue to demand fair treatment as a consumer.

The poster boy for bad sellers

#15Consumer Comment

Thu, June 02, 2005

Denny I thought the seller Lisa reported was bad. but if you do act the way you say then I would love your id first.. Here's mine, Jessifer08. Go ahead and block me, or for that matter, dont even bother, just fill me in with your id so Ill never buy from you. She was perfectly within her rights to ask about the shipping. It could have been handled differently on both ends yes but as a seller the one in question should have acted more profesionally and not stoop to such rudeness. If there is one thing that will stop me from doing business with an oline company its unprofessionalism. Its that attitude that buyers are all out to rip the seller off so lets rip them off first.. and its sellers like that that make it hard for honest online sellers to make a living cause fewer people want to deal with people online. If she paid that day sure the man might not have checked his ebay account that day.. sure the weekend would have stalled the shipping, but the point is that when she asked for an update she got a rude respons instead of "I apologize for the delay, yada yada yada, your item will be mailed out (insert date here or the word soon) and I will provide you with an update once it is sent. Thank you and have a nice day." Had that been the seller's response this would all be ok, lisa wouldnt be here now and we all wouldnt know how much you, Denny support the crummy grumpy sellers. And yes, I read the emails.. and if a seller responded to such a simple question like that I would have lashed out with far more rudness than what lisa did.. go ahead and talk bad about me.. ill never meet you so I dont really care what you think about me.

Did you pay for other services? NO!

#16Consumer Comment

Thu, June 02, 2005

Lisa not only are you a buyer that is impatient, but a buyer I would make sure to avoid. IT is You and those like you that make Sellers on ebay wonder they even bother. If you were so INSISTENT on getting an item by a certain time, THEN why didn't you contact the seller before BIDDING to see if he would be able to send the item out so that you could get it by a certain date? You paid on friday, so expect that the itme can be mailed up to 30 days after auction end! Sorry, that's the reality. Ebay says the seller has up to 30 days to mail item after auction end. Paypal holds seller to 15 days after you paid through their system! So, the seller IS IN HIS EVERY RIGHT to send the item after 15 days (excluding Sundays). did the auction state that item would be sent as soon as payment arrived? You mention FedEx, UPs and other mail delivery services! NOt only are you dumb, but DID YOU PAY for him to use these services? I doubt it. UPS /FED EX can cost a buyer extra if they want to use it. DID he offer those services? No? Then why do you expect him to use these services? Did you pay for priority mail? NO? Yes? Well, if you didn't, then dont expect an item mailed out on monday to get to you the same week. First class postage can take 3-7 Business days. Media mail can take up to 4 weeks. If you were so insistent on getting the itme quicky, why dont you DRIVE your @$$ down to his city and pick it up personally? The first email was fine to him, and YOU should have let it drop after he replied. No, you had to threaten him with reporting to the FCC (which they will probably ignore you unless you loss something close to over $10,000). Sorry, YOU were the one who was rude. If i received an email from someone demanding a refund because SHE/he didn't get an item without letting me know HOW fast they needed it, I would reply just as rudely. And anyone who didn't bother to read her emails to the seller are blind. She threatened him, and she expects to be treated fairly. Unbelievable. Please provide all your ebay id's so that i can block all of you. And it wont matter if i give you mines or not since you wont be able to bid on my auctions anyway. dumbasses the lot of you.

Ebay Sellers - what absolute arrogance!!!!!

#17Consumer Comment

Wed, June 01, 2005

Hi Lisa, I've been following your thread and shaking my head in disbelief at the total arrogance of your seller and the most negative person (and total ebay supporter) on this site - Denny from Hawaii. Every time he comments on a thread it is most negative and woe betide anyone who has a bad word about ebay sellers - then the garbage really flows. Your request was perfectly normal and civil - your sellers' response was out of order. Why do people who sell on Ebay think it is their right to please themselves when they send items that have been paid for? I am in mainstream business and I ring a supplier interstate and order paying with a card and I receive the goods next day - 2 days at the latest. I fail to understand how anyone would gamble their hard earned money, put up with the sort of garbage these sellers throw at you, in the hope that the goods they sell may or may not arrive and be in the condition as described. Read the horror stories on this site. Don't support these bufoons with absolutely zero civility. I learnt a long time ago that I, as an ethical trader, cannot win on every deal and that a customer does not complain or ask a question if they don't have a problem. It is so easy to answer their questions civilly or give them a refund or whatever it takes to make sure that their shopping experience is a very comfortable one. Naturally there are some good ebay sellers but the vast majority seem to need a personality transplant and think of themselves as 'holier than thou'. It matters not how many thousand successful transactions they have - if they have one that they didn't handle professionally then give them a wide berth. Denny old mate - do some soul searching and stop looking down your nose at ebay purchasers - they are the innocents and have a right to expect service - the fact that you blocked Lisa because an absolutely arrogant co ebay seller treated her poorly is indicative of the mentality that is rife amongst sellers. People are coming back to mainstream walk in, pick it up, examine it, pay for it and take it home stores in droves thanks to the number of e-ripoffs. Hold your head high Lisa and thank your lucky stars that you eventually received your goods (or did you?). Think long and hard next time you are tempted to buy on-line. You are totally innocent of any wrong doing in this matter. You simply paid your money and asked a perfectly reasonable question. By the way Denny you might like to publish your ebay identity so people can also block you as a seller - it does work both ways - sellers hold no greater status than buyers - it may be timely to reflect on that and start treating buyers with the civility they deserve, it costs nothing to do so!!!

By the way Denny, I didn't DEMAND a refund. In a, I believe it was the 3rd email from me to him, I said if you aren't going to mail it, then I expect a refund. I did not say I wanted a refund no matter what. Get real, just because you had so many successes, doesn't mean you are successful. Success isn't measured by quantity, but by quality. Which you have not had lately. You want me to leave you alone or go away, simply do not reply to my emails.

ATTN DENNY - Even if he mailed the product out on Monday, I still should have received the package no later than Thursaday.

Let me know your ebay screen name so I know not to buy from you. If you feel that I was rude asking 6 days after the sale, when the money was DEBITED out of my account friday after noon, and received friday afternoon buy the seller, before the post office closes, than I wish not to business with you. The Post office is open on Sat. from 9am until 12 noon, and you know- there is fed ex, ups, and dhl. So, excuse me for wondering 6 days after I paid for an item when I can expect to receive it. Even if he mailed the product out on Monday, I still should have received the package no later than Thursaday. I live only 3 hours away from him, not six days.

Dear Lisa, I do think it was right to ask for an update on the shipping in fact I always ask for a shipment comfirmation if one is not recieved in about 4 days. I looked at this seller's feedback.. sure he has a high percent rating.. but he also has 111 negative feedbacks. All of which seem to be the same problem of not getting the item and all of which are responded with the seller insulting the buyer or comparing his high feedback score with the buyer's low one (as if that really means he is a good person to do business with) This seller's arogance and repeated cause for negative feedback leaves me to believe that you are going to be another one and will more than likely not see that John Cena pic. So with that said, good luck on getting your money back.

You paid on May 20th hmm friday no? He probably didn't get an email stating he got paid until May 21st, so what can he do? Post offices are closed by 12 pm on Saturdays. Can't mail it out on Sunday. So the soonest he could mail it out was Monday, that is if DECIDES to. May 26th WAS all too soon to be bugging a seller to find out if the item was mailed out. What if he was waiting for the paypal payment to clear? to make a deposit into his bank account, before sending? that takes 3-4 business days. Does it say in his auction/ description that he mails out itesm the same day they paid, regardless if its the weekend and there is no postal pickup? Be realistic lisa, you were the one who was rude. YOU demended refund for something that could have been mailed out on the 26th. Thanks for providing information on you, you are no on my Block Bidders list at ebay.

FCC/FTC the INTERNET is a form of communicatio

I think you can contact the FCC as well as the FTC on e-commerce trading. Because the INTERNET is a form of communication and to fraud someone through mail order/trade over the internet should fall in those FCC and FTC guidelines.
