Complaint Review: Ace Industrial Supply - Burbank, California

This is the email I sent with the tracking inforation when I returned the item on Juy 7 2014, as you can see it was signed for on July 9 2014 by L Liana. Now it is 5 months later and they call 5-10 times a day I called themand told them I had returned the item and was told by john Johnson aka real name probably something else there wa s no record of me returning the item and my account was going to be filed by the legal department, when I gave him the tracking numbr he sad it was no good so I sent the shipping proof and the following letter to him at [email protected]. I intend to be reimbursed and wil file a collection action against Ace Industrial Supply and any susidiaries I can locate. Ths company runs on unethical and right at the edge of fraudulet business practices. They are unscrupulous and decietful, and try to get you to pay for thngs that are not your responsability. I say we all sue hem fo  rthe reasons utlined in my letter to Ace.

per our conversation of 11/11/2014 at about noon here is the forwarded multi order shipping receipt from my pay pal shipping account with an attachment showing the details from the USPS showing the history of transit and signature of recipient by L Liana on 07/09/2014 at 1:57 in Burbank Ca.

When I spoke to the Ace Representative on July 07 2014 I was told I had to return the item by Friday July 11 2014 in order to close the account. The Viper drill bit set was sent to me by Ace Industrial Supply unsolicited and their representative said verbatim that if I didn't feel it was the best drill bit set I had ever used I could keep it at no charge to me.

They also stated that if I did feel it was the best drill bit set I had ever used that I could remit $175.00 for the set. I never got the chance to use and evaluate the Viper Drill Bit Set due to 2 major back surgeries in January and in March of this year.

Instead of the conditions expressed by the cold call solicitation of the representative of Ace Industrial Supply, I started receiving telecommunication harassment by representative of Ace Industrial Supply for payment of the Viper Drill Bit Set and was offered numerous special pricing options if I was to make payment by phone for a drill bit set I did not order and received by false pretense by the telemarketing special promotion employees of Ace Industrial Supply

This  is a practice I consider to be questionable and unethical due to the sales representatives' falsely stating  that if I did not find the Viper set to be the best set of drill bits I had ever used there would be no charge for the item. But as it turns out the representative made false statements about the terms of the item.  Ace Industrial Supply sends items to people who do not make initial contact with Ace Industrial Supply to order an item but instead Ace Industrial Supply telemarkets by cold call, makes false claims and then bills and threatens legal action if the person receives an item they did not order for themselves.

By sending me an item I did not order by my own inquiry and action, I have recourse by the telemarketing provisions and business practice regulations governed by the State of Kansas.  By the actions of Ace Industrial Supply and the questionable business practices, and shipping unsolicited items to a resident of the state, and then demanding payment of a resident of the State of Kansas, County of Sedgwick, City of Wichita, I have resident,consumer protections. By sending the Viper Drill Bit Set to me, the laws of the state and regulatory statutes of the county and city, Ace Industrial Supply is conducting business in Kansas and is bound by these consumer protections.

This practice of sending unsolicited, misrepresented items seems fraudulent to me, and have  caused me financial damage  to return an item that I did not by my own action  order and purchase for myself. I had to pay return shipping on an item that was sent by false representation by Ace Industrial Supply. I have requested that Ace Industrial Supply reimburse me for the return shipping charges on more than one occasion that has gone ignored by my requests sent by first class mail.

Ace Industrial Supply now owes to me,"name removed", $12.90 + 21% interest compounded monthly ($2.07 per month)  on the $12.90 from July 7th to November 11th 2014. Plus $5.00 for handling, and $10.00 for time and expense, postage and clerical work to collect the debt owed to me, for a total as of today November 11, 2014 of  $38.25. This amount will continue to accrue interest compounded monthly on the current total of $38.25 at 21% monthly until  the full amount is remitted and I am made whole financially.

Please return confirmation of receipt of this email and attachment and close the collection action against me,  I have sent a notice of cease and desist collections actions on Thursday November 03 2014 by USPS first class mail.

I also expect Ace Industrial Supply to reimburse my out of pocket expenses as listed above immediately as Ace Industrial Supply now has an outstanding debt to me for the costs I incurred by their questionable and unethical  business practices.

If the amount shown above in this email that shows the return of the Viper Drill Bit Set by documentation and signature of receipt along with documents showing the return of the item, " section remoed"

You may remit the current balance of $38.25 to avoid further collection actions by me against Ace Industrial Supply, their employees and representatives, along with any subsidiary's, parent companies, and or stock holders and board of directors if any. Any further correspondence will be sent by certified, signature return receipt to the following address that was with the misrepresented Viper Drill Bit Set.
