This company is being allowed to take advantage of innocent consumers who do not qualify for traditional car financing. This company is selling lemons and getting away with this practice under a car dealer umbrella. Someone needs to investigate this company because millions of peoples' credit history is being abused and allegedly illegally placing detrimental false credit judgments on otherwise honest tax payers and consumers who were just trying to get a reliable vehicle to go back and forth to work.

This cannot go on any longer, it makes me sick that this company is making profits off good honest hard working citizens and ruining these peoples credit by falsely promising good quality vehicles, with no follow up to any repairs or any responsibility with what is wrong with the vehicle. Usually at a very high cost to the consumer. Then the company is allowed to place judgments on consumer credit reports, and in my case, I bought a vehicle when the company was known as "Ugly Duckling Car Sales" in Richmond, Virginia,and was closed down by the Better Business Bureau under this name. Later was allowed to reform under "Drive Time" and has since placed a 2nd judgment on my credit, under debt sold -blanket, and now I have 2 judgments for the same vehicle. Please read my story below:

I purchased a pick up truck from Ugly Duckling Car Sales in 2002. The second day I owned the vehicle the transmission fell out. I called the sales department and was assured any necessary repairs would be covered under warranty, and the 72 hour lemon law would be acknowledged. I was advised a tow truck would be by to pick up the vehicle. The tow truck never showed and when I called back to inquire about it a I was given the run around by several sales team members all of whom reassured me that the issue would be resolved.

About a week of this, and getting rides with friends to work, I was fed up so I called and demanded to speak with the General Manager who advised me that the warranty would no longer cover any needed repairs and the lemon law was void. I was told I was the owner of the vehicle and that this was my problem. I advised that I could not and would not pay for a vehicle that didn't work. I also advised them of the sticker on the windshield which listed all of the features and one important one, a running engine. I was told if I did not want the vehicle to bring it back.

My dad loaded the vehicle on his trailer and dropped we dropped it off. I again advised them the vehicle had not been in working order (which they claimed prior to the sale) since it was in my possession and I was relinquishing the property back to them. This was the last thing I heard about this issue until it appeared on my credit 3 months later. I am a honest hard working individual and cannot pay for something that doesn't work, or was promised in a sales agreement that would work.

I contacted an attorney who specialized in lemon laws. I was told that due to the time frames involved I did not have a case for lemon law. This situation really hurt me financially and I feel that I was a victim. I have researched this company and have found that the BBB has listed them as an out of business franchise due to fraudulent business practices. I guess I was one of their first victims. This bruise on my credit has been sold several times to collectors trying to do their job. Each time I advise what the situation was and each time I am told they are just doing their job. It is my understanding that the judgment against me has been split from the original amount owed. It is now two separate entities for which I am getting dinged twice for.

I cannot qualify for a mortgage with my wife, and I cannot qualify for traditional car financing, even though my earnings have increased since I applied for this bogus car loan in 2002. In my eyes I am still being abused as a victim by this bogus company and thus is a form of abuse and harassment. How many other victims have there been? Why can't our state laws protect honest tax payers from businesses like this? Why can't our local senators do something? I wish a hard working, honest attorney would come forth and help the victims of this worthless company.
