Before considering any kind of settlement, forebearance or other remedies, make sure you have your loan properly evaluated to ensure there is another legal remedy that can be pursued. For example, in may cases the originating lender may have violated the Truth In Lending Act and your loan, if your primary dwelling and a refinance, may be rescindable. As a further example, in many cases the loan may have been originated with fees that were so excessive that they may have violated RESPA as an unearned fee. The list goes on and on. Unfortunately, finding the right person to evaluate your loan for these violations is the hard part. Select Portfolio is known for violating your rights under the Fair Debt Collection Practices Act and the Federal Trade Commission has entered into multiple settlements with them. You can search that out on the FTC website. I am in the mortgage litigation consulting business but am purposely not putting my information here as I do not want people to dillute the value of what I am saying as promoting myself. Instead, look for multiple options, foreclosure, bankruptcy and forebearances should be your last resort AFTER you have researched your other options.

Have you tried to refinance your home with someone else? There are plenty of people out there that would love to have you as a customer. File over the internet at lendingtree.com. My husband went to school and we had to pay a company to finance the schooling. It took my husband a long time to find a decent job and we could not make the payments. They put us into forbearance for 6 months and it made our total due jump up twice as high as it was to begin with just because we did not pay anything for 6 months. It also changed our percentage rate to so high that no one could pay it off. I went and applied for a loan somewhere else and paid it off. Saved myself alot of money and heartache trying to make ends meet. Don't let them bully you! There is always help somewhere!

You need to go to Loansafe.org and tell your story. They will give you help and advice with what to do. These guys are good and they are free. It is a blog community of homeowners helping each other with contact numbers and addresses of all the mortgage companies. They know the ins and outs of real eastate and mortgages and have forms and "go bys" to help you.

We just HAD to pay $1944.00 (my sister's entire savings plus mine of 400) and our house note goes up $300 more per month with signed forbearance agreement;we had to; we had no choice! Then we will have a BALLOON NOTE OF $13,500 DUE IN 4MONTHS! We lost our health insurance after a job loss from hurricane Katrina; then got ripped off from a contractor (left town with the insurance money), so my husband was doing some work on our home himself,using the saw lst month, he cut his hand and lost the use of his his thumb/hand. NO HEALTH INSURANCE! FORECLOSURE LOOMING! I still can't believe we may lose our home. I have heard many sad stories about this same company namely S.P.S. from this site. I AM SO FRIGHTENED! I TOOK MOST OF YOUR ADVICE AND I DID FILE A COMPLAINT WITH F.T.C.; LOOKED INTO REFINANCING, (so far no bites because of our credit since SPS damaged our credit report; I also called my senators, legislatures, attorney General (some called back some didn't)to file complaints. I made a complaint to ins. commissoner. IT DID NO GOOD! SPS sent letter to commisioner saying (it's borrower's responsibility yada yada etc).I JUST WISH SOMEONE HAD THE ANSWER TO SAVE OUR HOME! I cannot believe this is really happening to us! Its like a very bad dream! HOW CAN I REFINANCE WITH SOMEONE ELSE? DOES ANYBODY OUT HERE THAT READS THIS KNOW OF ANY COMPANY THAT WOULD REFINANCE FOR US TO KEEP S.P.S. FROM STEALING OUR HOME? I'd be willing to pay the 10.7 % interest we pay at this point. I REALLY FEEL SO STUPID!

Contact The Fair Housing Authority if there isn't one your area contact a group for the rights of the disabled. These groups usually know someone to contact someone for your area. Good Luck!

I am sorry for what you are going through. I have a really hard time with them, in 2004 I received a letter from them demanding 14800.00 demanding back taxes and insurance all of which I did not owe them, they would not listen to me on the phone or respond to my letters so I was forced into chapter 13. Then again in march of 2007 they were demanding 22000.00 for the same thing and talked me into a forbearance agreement which I did but it is a bait and switch so they could steal my house. I found out the ceo has been in alot of trouble with the goverment and thats why they keep changing names of the company. I end the end bought a new house and gave them mine as I could not keep giving the money for stuff they dream up. I called the Federal Trade Commission and the District Attorney's office and they are helping me sue the crooks. Try Calling The District Attorney in you area for help and if they cant they will tell you where to look. God Bless.

In our Chapter 13 plan, we had an attorney for us , but do NOT know the attorney for SPS. HOW can we find that out? AND MOST IMPORTANTLY, WHY? Would that make a difference to my situation NOW? Thanks. please reply. Thanks again! Please reply Why?

This all should have been filed in your plan NOT given to you after, why are you paying for something now that should have been added into your chapter 13 plan, they should have had an attorney amend the plan to include those things are you able to re-open your prior bk? I'm not sure with the laws that were passed. In Louisiana was the attorney for SPS Dean Morris or was it Boyles Law Firm?
