I hired Olympia Law Group to negotiate a lower mortgage payment.  I told them I had previously filed but the payment was still too high.  I was told they would negotiate a much lower payment, lower my interest by 2% points and get the arrears partly written off.  I provided all of the paperwork within 24 hours of it being requested. 

I was told I needed to be residing in the home by 8/01/2019 since I was currently living in an apartment.  Olympia Law Group filed my application for mortgage assistance the end of June, 2019.  It was rejected immediately because I was not residing in the home.  I checked the status of my case on the Olympia website.  I saw it stated denied as of 7/03/2019. 

I contacted various people at Olympia both by phone and email with no response until 7/11/2019.  I was told my options were bankruptcy, sell the property, etc.  and had until 7/15/2019 to provide an answer.  It was all sent by email.  I contacted the mortgage company myself.  I was told I was denied immediately because I was not residing in the home. 

I was further told the attorney's know this and do not tell their clients all the time and then they are rejected.  The mortgage assistance is a federal program and it requires you reside in the home when applying.  I then asked Olympia Law for a refund of payments 2 and 3 stating I would not pay the 4th payment.  I told them to keep the 1st payment since they did submit an application. 

However, there is nothing they did I had not already done and it did not cost me $2250.  Olympia Law Group was negligent by not telling me to be residing in the home sooner or waiting to file the application until I was residing in the home.  They further would not return my calls or emails giving me only 4 days to make a decision about next steps.  I had to sell my home.

Hi Amy,

You have been speaking with Travis regarding your mortgage with Carrington.  Please let us know if we are not moving forward with the legal submission process to getting your mortgage restructured.  If you are not moving forward with the process we need to cancel your retainer and close your file.  The compliance attorney does not want to leave your inquiry open any longer without any work being done on your file due to the foreclosure status and projected future sale date. 

Remember to be careful with your servicer when you try to get a modification as they generally bring people on a run around and request document after document from you telling you to keep sending in more documents and having you speak to a number of different people leading you to believe like they will work with you only to have you fall farther behind and then tell you they can’t help you and foreclose on the property or force your into a bankruptcy. 

I will assume you have resolved your situation and are not moving forward with the legal submission process to getting your mortgage restructured if we do not hear back from you by the end of the business day Monday (4/15).  Hopefully the legal submission was fully explained to you and you fully understand how the legal submission process works in terms of how the case law is applied through the submission. 

If you have further questions feel free to call or email.  Keep in mind if you do not take “specific” action against the bank servicer through their legal department your mortgage will not be able to be restructured.  Unfortunately you will not receive a fair loan modification through the loss mitigation department of the bank and you will not be able to get your mortgage restructured unless you obtain representation. 

Best of luck resolving everything in your favor if we are not assisting you and be very careful relying on what the bank servicer tells you because I have seen a number of home owners lose their property doing this or get forced into filing a full Chaper 13 Bankruptcy and then lose the property anyway in the bankruptcy!  MAKE SURE YOU HAVE A IN LISCNENSED ATTORNEY.    Thanks Amy!

We can still cancel your file but we wanted you to know the facts before you did so.  Whomever helps you make sure they either file a law suit against the servicer or do a legal submission.  Apart from these options you will not be able to get this out of foreclosure unless you have the full amount to reinstate the loan.  Please sign the cancellation in the event that you are cancelling as we have a signed retainer from you Good luck!!

I am cancelling any agreement made between Olympia Law Group and Amy E. Travis as of 4/11/2019.  I will not be authorizing any payments to be made to Olympia Law Group.  I also will not be seeking representation of any kind from Olympia Law Group or any of it's affiliates, employees, contractors, etc.  The cancellation is in full effect by my email signature.  I will expect to hear nothing further from your law firm nor hear of any payment being sought of any kind.  Please let me know if you have any questions.
