Midway Nissan 2201 West Bell Road Phoenix, AZ 85023 Attention:    James Corkell Finance & Sales Director Reference: Gap Addendum #NG105499 Mechanical Protection Plan: #2567515 Subject: 2007 Ford Ranger Advertised Purchase Price: $12,221.00  This written notice is hand-delivered to Midway Nissan at the above address on December 3, 2018. I am requesting a full refund of $2172, for the cost of the above Gap Addendum and Mechanical Protection Plan. The addendum states that I have 30 days to cancel but due to your company sending my loan paperwork to the bank referring to my home address, instead of my mailing address, which is a Post Office Box, I only received the paperwork yesterday evening.

I am very unhappy that after reviewing the bank payment stub finally received yesterday, your company financed your commission into the loan making my loan $3779 more. There is no way this buyer or the Kelly Blue Book feels that truck is worth $16,000 as CRB Auto loan now indicates to me. You were fully aware of my intent of paying off the loan in thirty days (as of this writing, this vehicle has been totally paid off), so no buyer would insure himself against this loss of $1607 in insurance premium for a mere 30 days with a vehicle reporting 27,367 miles by the car dealer.

This difference in lack of refund from the high-pressured gap insurance and mechanical repair plans and what you unnecessarily financed through the loan company. I never wanted these plans and you literally and repetitively shoved them down my throat. Then added insult to injury by dumping an extra $1607 in commission for your staff. As a result, I am awaiting $3779 to be immediately refunded to me by Nissan Midway. I regret this business association, and I have complete empathy for the dozen Ripoff Reports and over four dozen BBB reports that have been filed against Midway Nissan through the years by your other customers.

Your response was not only valid but deceitful Robert.  I tried to leave twice and you poured on the lies about you and your son and your purchases for him.  You even went so far to tell me you were a church going man who could be trusted.  Then when my wife came down there to get our money back you not only refused to see her,  you had the adacity to leave the lot until she left the showroom.  You guys are crooks....who take advantage of non-English speaking/writing customers hourly in your establishment.

First off if they were such "high pressure" and kept trying to push extras on you, what did you do? Did you refuse to sign until they removed them, or did you give into their pressure?

You can say dealers shouldn't use "high pressure" sales, but if you don't like it there was nothing keeping you there. You could have registered your objection to their tactics by walking out. However, since you stayed and agreed to the deal, you then be subject to the terms of the deal. After the fact it just becomes a case of buyer's remorse. Where if you knew you only had 30 days,  there was no reason you should have waited until you got the loan documents.

As for the commission, I am not exactly sure where you are going with that. How did they add their commission to the loan? Was it in "points" against the loan? Was it a seperate line on the agreement? Did they increase the sell price? And more importantly did YOU sign the agreement with this additional charge in place?

By the way your "intent" to pay off the loan in 30 days has nothing to do with this.  The fact that you apparently did is great but doesn't change that.  There are many people who "intend" to do a lot of things but if something comes up they don't end up doing it.

 Before the sale was consummated, YOU were presented with the contract. Said contract contained all the figures for the sale. YOU were to sign this contract indicating YOU agreed with the terms including the figures. The ONLY reason the sale went thru with the contracted figures is because YOU failed to review those figures BEFORE you agreed to them! You can cry, whine, wail and stomp your feet in temper tantrum all you wish, but the bottom line is none of this would have happened if YOU would have used COMMON SENSE and actually READ what you were agreeing to before you agreed to it! How dumb is this????
