Our loan was re-financed through FIELDSTONE MORTGAGE, and is serviced through Litton Loan Servicing, LP. First, FieldStone had Household service our loan, we had it set up on Auto-pay where they took 400.00 every Monday out of out checking account. Our payment was $1468.12 per month, we were puting any where from 200 to 400 a month towards principal. Well in Dec 2002, Household sold the loan to Litton to service, Well on 12/31/02, Household took out there 400.00 towards the January 2003 payment. On January 1, 2003 we were supposed to start paying Litton instead of Household according to the letter received on Jan 12th, thats right, Jan 12th. I called Litton to make payment arrangements, and they said, they didn't even have the account set up, so I asked what did they do with the 400.00 thay was taken from my account on 12/31/02. They said that they would get it from Household, and for me to call in February and everything would be set up and current. They told me I couldn't even make a payment at that time.

So, I called on 2/9/3 to make a payment, they said they haven't received the 400.00 from Household, and the would inquire, but to go ahead and make the February's Payment. So I did. Then on March 4th, I called to make a payment, and they said that they were still trying to get the 400.00, but to make a payment of 1068.12 for January and 1468.12 for March. So I did. This 400.00 has put me a month behind ever since. They would take my payment, apply 400.00 to a suspence account and make the prior months payment, then put the remainer 1068.12 in the suspence for the next month. In May of 2003, We actually were late, and they reported it as 60 days past due, we caught it up in July, but they still were reporting it as 60 days past due. So, they offered us a LOAN MODIFICATION Agreement. This shoud have caught us up, they should have reported us current going forward. But it didn't, $2000.00 later and all current payments, the were still reporting us 60 days late. Then in Nov 2004, we got behind again, then they were showing us 90days late, and started Foreclosure, we signed a Forebearence Agreement and gave then 4000.00 and have made our payment on the 20th of the month until Aug 2005, we were 10 days late and the filed foreclosure again, this time 120 days late. These "SAVE YOUR HOUSE" plans they make you do, does not help. They will probably end up with our home. We are in the process of selling at this time. I have all my receipts and bank statements and all back-up, I even called to argue the fact that they were wrong, but I was hung up on several times. We tried to re-finance, and the refinance company, was hung up on and was unable to find out the simplest information, like "Who actually holds our mortgage" and What the pay-off amount was" We finally found out that FIELDSTONE MORTGAGE still held our note, when we got the Foreclosure papers. PLEASE BEWARE! As a 20 year corporate accountant, I have found multipal descreptencies in the principals of accounting, processing this loan using there own on-line statement.
