On the afternoon of 10/11/2007 I recieved a phone call from a young lady who identified that she worked for Landmark Chevrolet and that I was approved for a auto loan on a new vehicle. At this point I set up an appointment to come into the dealership that afternoon and talk with her. That afternoon I arrived at the dealership and asked for the young lady that I talk to ealier that day. I sat down in that office with her, and she asked me about 15 question dealing with my job, my income and ect.

At this point she left the office and an older lady come in. (the old bate and switch game) she asked me to come to her office were we need to fill out a paper work for a credit report auth. At this point I explained that I didn't have the greatest credit and what I wanted my payments to me. I was told that wouldn't be problem. She left the office and about 10 mins later comes back in and tells me that she couldn't really do anything but there was a young man in Used Sales that she know by the name of Hazim Sekban that could help me. She introduce me to Hazim Sekban.

I explained what I was looking for and the monthly payments that I wanted. We left the new car office and drove over to the used car lot to his office (mind you it was in MY VEHICLE!) At this point we walked the lot looking for a vehicle that we could start with and see how we could work a deal. I found this beautiful 2006 Trailblazer LS 4x4. Test drove it with him and came back to the lot to start the paper work an price deal. I got this b.s. on how my credit need to be run before we could talk price and feel for it.

At this point my trade in had some left over after there trade in offer that would have to be rolled over to the new/used vehicle.(Roughly about 2,500 bucks) At that point he asked me if I had anything to put down as a downpayment. I agreed to $500.00 and he told me that he could work with that. He left the desk again and was in the manager office for about 45 mins.

At this point he comes back and tells me that the pay off on my vehicle was $10,500.00 but it was only worth about $7,000 grand. But wasn't sure if the new loan company would care what was left over to the new loan.. He left for a few more mins and comes back and tells me that he has a vehicle that was a 2007 Trailblazer that had 40,000 miles on it but the loan company would carry the negitive balance from the trade in to the new vehicle. But I need to do atless $1,500.00 down.

I called my wife and asked if we could afford doing that much as a down payment. She agreed that it would be fine. I agreed to take delivery of vehicle that evening after going to pick up my wife to sign the paper work. I left the dealership with the new vehicle and drove home to get my wife. We returned to the dealership to sign the loan papers. (Before I left Hazim Sekban what the payments would be, he stated that they were in our buget).

At this point Hazim Sekban took us to the finance office of F. Garcia. A charming and funny man, While we were in the office the month payments were talking about and it was kind of high but we did agree to the payment due to the need of a reliable vehicle. F. Garcia started printing out the forms for "Arbitration Agreement", "Disclosure Agreement", "Landmark Chevrolet LTD. Privacy Notice", "Agreement to Furnish Insurance Policy","Notice to Cosigner", "Courtesy Delivery Agreement"(which is a crack of sh*t contract), and "Purchase Order" which had all the totals of the cost of the loan and date of the lien.

When we left that evening we "THOUGHT" we had brought a new vehicle. After the first week the only problems we had was getting the car detail, due to the evening we purchased the vechile the detail shop being closed. Everything was doing fine, intill on the afternoon of 10/25/2007 I recieved a phone call from Hazim Sekban stating that he need my wife and I to come back into the dealership to sign new finance paper work. I stated at this point "I thought we were already financed", Hazim Sekban told me that "Americredit Financial Services, Inc. turn down the appication and that they had new lender's (Mint and Drive) that had a better deal for monthly payments.

I told him that we would be in that friday evening due to use going out of town on Saturday. Well we didn't make it into the dealership do to family sickness. So on 10/26/2007 I called Hazim Sekban and told him what was going on and if we could come in on Monday or Wednesday of the following week. He stated that it wasn't a problem. On the evening 10/30/2007 Text mailed Hazim Sekban and told him we would be on the evening of 10/31/2007 to sign paper work.

On the morning of 10/31/2007 Hazim Sekban called me to confirm that we were still coming in. I stated yes and asked him what exactly what was going on. He stated that the new finance companies were ok'ing the loans but didn't want my trade. At that point I was kind of pissed but agreed to come in and find out what was going on. Was pissed mainly that this was a "done deal" on 10/11/2007. So my wife and I sat down with Hazim Sekban the same evening to talk about what was going on. He was right the finance deal was better in the price and the monthly payments but the thing that got use the finance company wanted a cash downpayment before "Landmarks Chevrolet" month end (which ended on the 11/5/2007). Which now goes against the "Authorization for hold Check Contract" we signed on 10/11/2007 to have our check deposted for our downpayment on 11/09/2007.

At this point the deal was starting to get ugly and my wife was majorly pissed off and so was I. Hazim Sekban was starting to act like a jerk because we didn't have the money right then or by the 5th. And truthfully he just wanted to be paid for the vehicle on his commission check for Oct. He wasn't concerned about making a deal or really working with us, like he was when we first came in the door. At this point there was no point in fighting about it because the contract "Courtsey Delivery Agreement" stated that if they were unable or customer was unable to committ to the deal that the vehicle had to be return on demand and that there was a $25.00 a day rental agreement and $.18 cents per mile charge for the time we used THEIR vehicle. (for the time we had it the total would have been $734.18, what the f*ck, u game us the vehicle making us believe that we owned it!)

At this point the deal was lost because of the state Hazim Sakban made when I wanted my father in-law who is a lawyer to look over the paper work. "Go ahead, No will ever hold me responsible for any of this". At this point the sales was lost. For the sace of me knockin this little twits head off his shoulders, I decided that to just give back the vehicle and have my trade returned to me. Knowing how much it hurt my wife to see it go. At this point we clean out the trailblazer of our personal stuff that we had already installed in it.

I also wrote a claus on the "Courtesy Delivery Agreement" contract stating that "No Money was owed on vehicle after contract is cancelled by customer" and had the sales manager sign it. Didn't want to see a bill show up for the use of the vehicle. Now I have to say I really do have a bad taste in my mouth about this whole deal, and don't know if there is even a legal recoil to it. I know there were no TRUE contract that were notorized by the state of Texas nor contract numbers besides the Purchase order. Just know that NO ONE SHOULD BY FROM LANDMARK if this is how they do business and the state of Texas should shut them down for all the lies and mainly heart break of honest working people!
