I had purchased a Samuel Lawrence Bellagio Bedroom Set that was offered for sale via Ebay, Internet, or telephone. My order date was 8/28/2004, and my credit card was billed immediately. I was told by the merchant that the expected delivery time frame would be 4-5 weeks, and that the freight company delivering the furniture would contact me to schedule delivery. The total amount of the order was $5192.92.

I received an invoice via USPS stating that the goods would be available in the warehouse on 10/4/2004, with an expected delivery date of 10/15/2004. On Monday, 10/18/2004, I spoke with Crystal Brooks, my sales representative, regarding the order, and she told me to the effect that the truck was late, but the freight company should be contacting me shortly. To date, there has been no contact from any freight company to either home or work telephone numbers.

I have made several attempts to contact the merchant by telephone at 866-891-0011 and 903-891-0011 several times on 11/8, 11/9, 11/10, and 11/11, and I sent an email on 11/10/2004. To date, I have not received any response to my repeated calls, despite my notification to report the transaction to my bank.

They ALWAYS have a recorded message / answering machine on when I have called. The really scary thing is that this company is continuing to offer items for sale on EBay under the seller Hometown2004.

At this point, I just want to recoup my money. Because they have failed to deliver, I have had to reorder the set from a company in South Carolina, and it will cost me an additional $700 because of the increased freight charges. Not to mention the disappointment of having to wait over ten weeks for something that never showed up!

Today I was contacted by Brice Smith at the Sherman, TX Police Department regarding the fraud complaint we had filed against Hometown Furniture. He told me that the Texas Attorney General's office would be handling the matter from here on out, as the Sherman PD has over 20 documented complaints on the business. If YOU have been ripped off by these guys, you need to contact Joanne Ferris at 214-969-7369 x125 to file over the phone.

I am delighted to say that MasterCard is taking good care of us regarding this scam. We have been given "provisional" credit (provided the merchant doesn't give proof-of-delivery / justification of charges, etc. in the next 60 days...) which, in this case, is as good as cash. I cannot stress enough how important it is to document your purchases with plastic whenever you can...

Still No REFUND, Same Story

I was finally able to get through to Robert Brooks about a week ago, and I was told the same complicated story of holding funds to get $100K in escrow to secure letters of credit to buy the furniture. I told him that the practice of holding funds without intent to deliver is ILLEGAL and constituted FRAUD on their part. He didn't seem too concerned about that, but he promised that his credit card customers would be refunded by the end of November. It's 12/5, and there has been no refund. This guy even had the audacity to say that I was "lucky" that I had paid by credit card, as he dosen't expect his cash customers to be paid back at all. If this is "lucky", please have somebody send a black cat to cross my path, a ladder or me to stand under, a mirror to break, and please...do it all on the 13th of the month! $5192 is a big deal to me. I guess I'll have to wait for the good folks at MasterCard to help me out here...
