I handle the bills for my parents because they speak little English. My parents refinanced their house last year of 2004 towards the end of summer. About five months after dealing with the new mortgage company, HomEq Servicing took over.

They sent us a letter telling us to pay them starting March 1st, 2005. I handle my parents' bills through bill pay, which pays online from their checking account. The first payment we sent HomEq Servicing through bill pay came back five days later. HomEq Servicing also called to ask where payment was.

It was later followed by a letter telling us that they sent us the wrong loan number and for us to correct our records. We sent in the payment again through bill pay and it went through. My father told me to set up automatic monthly payments where the bank pays the mortgage company monthly, and that's what I did.

About a month ago HomEq called saying they never received April's payment. We checked my parents' bank account online and the money was deposited back. I called the bank and asked what's going on. The bank said, what they do is send the company a check. The location wasn't found, which I don't understand because a payment went through before.

The bank is blaming the mortgage company and the mortgage company is blaming the bank. I got tired and said fine, HomEq, what do you want me to do? HomEq said, do an automatic debit over the phone. I did that. I gave them all the information they asked for, account number and routing number for them to take the money from my parents account.

My father and I called two days later to check the status of their loan, and a HomEq representative said everything is fine and all payments are caught up. The third week of May, we received a letter from HomEq telling us that we're in default of our Sale Contract and Mortgage/Deed of Trust and we have thirty five days to bring our account current or pay the full amount due.

HomEq sent the check that they sent to the bank for automatic debit to us with a stamp saying account not found. I called the bank again and the bank said, they don't know who wrote that check, but if it was the mortgage company then they wrote it wrong, that's why the bank isn't cashing the check.

The blame game between the two goes on again. I said fine, HomEq what do you want me to do? They said, go to Wal-Mart and send a money gram to us. That's what I did two weeks ago. At this point, we don't know what to do anymore. It's stressful and we feel like the mortgage company doesn't see it like it's also their fault.

We've made every attempt to pay the mortgage. I don't understand why there are so many problems? Does HomEq want to repossess our house? Is that why they can't seem to receive most of the payments we make? Through all of this we've had to pay late fees, my parents' credit scores suffer, and our mortgage went up due to the insurance says HomEq.

I'm writing this report, asking for help. We do not want to go through this again, especially with a mortgage company like HomEq, who isn't very cooperative and who doesn't seem to care much about their customers. What's our option? Refinance again through a trusted mortgage company?

My father died in DEC. 2004 and since I have been handling everything for my mom. Homeq has really put us thru it. They returned every payment sent to them from April 2004 - December 2004. When my dad died we found out we were a week from foreclosure and my dad didn't tell anyone. (He was a very private person) My dad kept all the money orders he had sent to them over these months that they returned. There was over 8000.00 in money orders. If they would've accepted these we would never had been behind. My mom ended up filing a chapter 13 bankruptcy to save her home, but it only put her deeper in debt. She still pays the same amount on house payment, but she now has an additional 300.00 a month. When we were to start making our payments again I called to find out the address.... I was given 5 different addresses in 5 different states. I then asked for their Western Union information, and that is how I have sent it since then. They receive it within 15 minutes of the transaction. The reason I was given 5 Different addresses is because if I was even 1 day late they could have our bankruptcy dismissed and go thru with the foreclosure. We all need to find an attorney that is willing to take a class action law suit. They should not get away with ripping people off and forcing them out of their homes. Good luck to you.
