We were unable to pay our 2nd half of 2005s taxes until December. In January we received notice that our payments had went up from $716.00 to $909.00 due to our taxes being critically delinquent according to HomeQ. In January we paid the first half of our 2006 taxes, only to find out that HomeQ had also paid them. We were told by HomeQ to get a refund. I told them I would not pay DOUBLE for my taxes and that I had not signed anything to escrow my taxes and they were NOT to raise my payment without proper notification. Our taxes are now paid thru 2007! We still have to escrow them into our monthly payments!

April 2006

There were several unauthorized charges made on our checking account in April. They were small amounts, but totaled over $500. However with the overdraft charges that we were hit with the grand total was over $1000. There was a couple of refunds from the companies, but the overdraft charges were NOT DROPPED, which started our playing catch-up on bills that we had to let go to cover the overdrafts.

{We were notified, in January that adjustments would be made to our payments. They would go from $714 to $909 a month. This had followed the tax discrepancy.} I mailed in a routine payment of $714 which I was informed was only a partial payment and so was placed in a special account to cover any extra charges, etc that might occur on our account with them. {I had made that payment late due to the previous problems.}At the end of April or first of June I sent in a partial payment with a letter explain what was going on, again my money was placed in the special account and not applied nor returned. When we were able to send a payment that month, I mailed in the total of $909. I was contacted by Homeq regarding our payment being late, I explained I had mailed it, but they were unable to accept that, they wanted a payment BY PHONE, with the UNDERSTANDING that when the payment was received by mail, they would destroy it as to not cause my account to be over draft. I made that payment by phone (check by phone) of $909, 2 days later I was notified by my bank that I was over draft $700, with a overdraft charge of $250!!!

They had attempted to collect BOTH payments! I had to put STOP PAYMENTS on BOTH payments to cover overdraft charges as well as stop payment charges!! Again, I was unable to make a full payment due to having to cover BANK FEES stemming from overdraft. I was then contacted by HomeQ regarding why I had broken our agreement I explained that due to the attempted double collection of payments I had been forced to use the payment to cover overdraft charges. I was informed that whoever told me they would destroy the mailed payment was wrong. She stated that incoming payments are handled by a completely different department with no connections to the collection department which had contacted me for the payment by phone. They are unaware of what each other is doing. I told her that at that time I wasn't able to make a FULL payment due to the above, she would not accept a partial payment.

Numerous attempts have been made to make payment arrangements, I have called numerous times. There have been several calls that I have made or conversations had that have not been documented. When I have called back regarding certain issues or mention previous calls; I have been made aware that there was No Record of my having a conversation with them!

If I were you I would call in the office today and ask what it would take to bring your account current and how to make the payment. Then I would make the payment and remain current on my loan. You seem to have a lot of time to write on this website, when maybe you should be using your time for more important things, such as handling your mortgage. Actually Bankruptcy Protection is a good thing. If we filed bankruptcy what do you think would happen to your house? And since you do a lot of research you also know we got bought by Barclays, which would mean the chances of us filing for bankruptcy would be the same chances of you paying your mortgage on time.

We didn't choose YOU just so you know. You loan wouldn't get sold to us unless you had bad credit and/or bad payment patterns because we only service subprime loans.

Pay your bills? This from a Company currently under BANCRUPCY PROTECTION?? ( HomeQ Servicing Corp. DBA: The Money Store, FairBAnks Capital Mortgage, etc)I have done alot of research about this company! Shouldnt you practice what you preach? Dont you (Homeq) think that its funny that there are HUNDREDS of reports listed on here with the same complaints? Your failure to provide your clients with the correct information needed to complete their loan transactions are just as much at fault! I have TRIED to make payments!! You READ as well as you listen!! In the above statment I made it clear I have attempted to make payments!!! YOU HAVE RETURNED THEM!! Then I have to deal with employees who arent able to give accurate or CORRECT information! One person I talk to may be in the Carolina's the other in California! PLease dont respond if all you can do is make your nasty comments, or point your finger! I understand that this common practice since I have been subjected to far nastier comments on the phone! I am just trying to seek help!! Unfortunately you arent even offering help, nothing you have listed above has even brooched the subject of help for your clients! You mention the loan documents, yes I have read them, I have read them NUMEROUS times! They were signed with Argent Mortgage Company. You CHOSE ME as a client! I didnt apply to you!! My credit score was in the 700's when Homeq took over my loan, I am now in the 500's!! I understand the idea of "paying my bills", however when I have my payments sent back, I find it very distressing that you make your comments like those listed above.

Yes, Yolanda is 100% correct in what she said!! If you can't keep up with all the responsibilities you signed up for when you signed your mortgage agreement then you need to sell your house or try to refinance. You're bound to the contract you signed and so are we. If you don't keep up with your taxes or homeowners insurance like you agreed to we are liable and so we will pay them for you to protect our interest in the property. After all it is our house until you pay your loan off in full. You also need to understand we just want you to pay your bills on time like you said you would. D o that and everything is fine between you and Homeq.

Per the loan documents you signed, you agreed to pay taxes and keep homeowner's insurance for your property. If you fail to do so, HomEq does it for you. Also, HomEq sends out notice after notice that your payment is going to be raised before they do it, and everytime you call in, an agent advises you of the same thing. It's not HomEq's fault if you choose not to read your mail. Yes, whoever told that we would destroy a check you mailed was definitely wrong about that, collections has nothing to do with the cash department. The point of this rebuttal, however, is to read you original loan docs and you should find anything you need to know.
