{1}.  While driving on a rainy night along a highway with no street lights the sound of a LOUD EXPLOSION occurs, the car is suddenly bouncing and swerving out of control from one lane to another. What just happened? A tire blowout transpired from the excessive strain of a tire’s internal structure. Specifically a NAIL that the staff members of Firestone Complete Auto Care® KNOWINGLY AND FRAUDULENTLY left in a brand new tire for more than a month. A brief description of the facts leading up to this potential risk is described herein below.

{2}.  Several months ago I paid approximately $300.00-$400.00 for 2 tires, a Road Hazard Protection Warranty Plan and a 90 DAY BUY & TRY GUARANTEE that specifically says: “Here at Firestone we have your back with our industry leading 90-Day Buy & Try Guarantee. Get out there and hit the trails for 90 days. If you don’t love ‘em, we’ll refund or replace – NO QUESTIONS ASKED.

{3}. After Firestone installed my tires I heard a constant squeaking noise. I then returned to the Firestone store at 10735 Little Patuxent Pkwy, Columbia, MD 21044, because it was raining heavily that day no one could hear the noise and I agreed to return after the rain had stopped and the ground was dry. After returning I got no service.

{5}. Several weeks later at $3.35/gl, I drove back to the Firestone store at 10735 Little Patuxent Pkwy, Columbia, MD 21044, because I had a nail in my tire afterwards I got no service I requested that the area manager call me, it didn’t happen.

About a week or two later at $3.35/gl, I drove to the Firestone store at Leonard Wood Ave Bldg 4587, Fort Meade, MD 20755 after I spoke to the store manager who told me Im clear for service come on in I said Im on the way. Afterwards the military police ran my ID through the system and escorted me off the base because I didn’t have a security clearance to be on the base so I could get to the Firestone store. The store manager never said anything about a military base or a security clearance.

 

{7}. Afterwards at $3.35/gl, I drove around in circles looking for another Firestone store at 1492 Annapolis Rd # 94, Odenton, MD 21113.  After arriving I got no service I requested that the area manager call me, it didn’t happen.

About a week or two later at $3.35/gl, I drove to the Firestone store at 11821 W Market Pl, Fulton, MD 20759 on or about 9.19.21, to fix the nail in my tire afterwards, I got no service I was told no Firestone store in Maryland has my size. I requested a call from the area manager “Fabian Baker”, it didn’t happen.

{9}. A week later at $3.35/gl, I drove back to the Firestone store at 11821 W Market Pl, Fulton, MD 20759 on or about 9.26.21, to fix the nail in my tire afterwards, I got no service I was told by “Rob that they did have my size tire. Afterwards I waited for about 45min. at 11:15 Rob gave me the phone to speak with the store manager “Nick” of the Firestone store at 1492 Annapolis Rd # 94, Odenton, MD 21113.  On a recorded telephone line Nick told me he cant service my car until 4:00 or 4:30.

{10}. At $3.35/gl, I drove back to the Firestone store at 1492 Annapolis Rd # 94, Odenton, MD 21113 and was told by the store manager that its 4:15pm and he cant service my car.

 

COUNT I.   

RECKLESS ENDANGERMENT

{11}. At all times relevant to this complaint, Firestone staff members knowingly, willfully, fraudulently and recklessly engaged in a conduct that created a substantial risk of death and/or serious physical injury to me as a Firestone Complete Auto Care® customer, any  passengers riding with me in said car they refuse to service and to the general public at large.  Moreover, each staff member consciously took an action to disregard all public safety laws relevant to the foregoing facts.

 

COUNT II.           

Misdemeanor Imprisonment Of 1Y And/Or A Fine Of $500

Md. Code, Com. § 14-2903 FRAUD-FALSE ADVERTISEMENT

 

{12}. Md. Code, CL § 14-2903(a)(1) provides that: “A person may not advertise for sale merchandise, commodities, or service through an advertisement describing the merchandise, commodities, or service: As part of a plan or scheme with the intent not to sell the merchandise, commodity, or service at the advertised price

{13}. Md. Code, CL § 14-2903(a)(2) provides that “A person may not advertise for sale merchandise, commodities, or service through an advertisement describing the merchandise, commodities, or service, with the intent not to sell the merchandise, commodity, or service.

{14}. Md. Code, CL § 14-2903(b) provides that “A person who violates this section is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 1 year or a fine not exceeding $500 or both.

{15}. After January 2021 the Firestone Complete Auto Care® store mangers and several members of its staff referenced in ¶¶ 1-14, supra, did verbally convey and by means of the internet and offered for sale to the general public the aforementioned Road Hazard Protection Warranty Plan and the 90 DAY BUY & TRY GUARANTEE in ¶¶ 1-14, supra, with the intent not to sell and/or provide said GUARANTEED services and said Firestone supervisors, agents, employees and other staff members knowingly violated Md. Code, CL § 14-2903, which is generally referred to as "bait and switch".

 

COUNT III.       

Md. Code, CL § 13-411 Criminal Penalties

Misdemeanor Imprisonment Of 1Y And/Or A Fine Of $1000

Md. Code, CL § 13-303 Unfair, Abusive, Deceptive Trade Practice

 {16}. Criminal Penalties under Md. Code, CL § 13-411(a) provides that: “Except as provided in subsection (b) of this section, any person who violates any provision of this title is guilty of a misdemeanor and, unless another criminal penalty is specifically provided elsewhere, on conviction is subject to a fine not exceeding $1,000 or imprisonment not exceeding one year or both, in addition to any civil penalties. (b) A person may not be imprisoned for violation of any provision of an order of the Attorney General or an agreement of a party relating to unit pricing under Title 14, Subtitle 1 of this article.

{17}.  Md. Code, CL § 13-303(1) provides that: ‘A person may not engage in any unfair, abusive, or deceptive trade practice, as defined in this subtitle or as further defined by the Division, in the sale, lease, rental, loan, or bailment of any consumer goods, consumer realty, or consumer services”

{18}. Md. Code, CL § 13-303(2) provides that: ‘A person may not engage in any unfair, abusive, or deceptive trade practice, as defined in this subtitle or as further defined by the Division, in The offer for sale, lease, rental, loan, or bailment of consumer goods, consumer realty, or consumer services”

{19}. At all times relevant to this complaint the supervisors, agents, employees and other staff members of Firestone Complete Auto Care® knowingly, willfully and fraudulently engaged in an unfair, abusive and deceptive trade practice in the sale of a consumer services and goods, which is briefly described in ¶¶ 1-18, supra.

{20}. Md. Code, Com. § 13-401(b) After the filing of a complaint, the Division shall investigate the allegations to ascertain issues and facts. If appropriate, the Division shall refer a complaint to the Federal Trade Commission.

They are at capacity with customers who need help they are understaffed, overworked and warehouse supplies are down. They have tons of employment openings and need new applicants ASAP
