We are a military family, my husband is a Marine and was stationed with II MEF II MHG from Camp Lejeune, NC. Chad was injured during his deployment to Fallujah, Iraq in 2007 and was being Honorably Medically Discharged in 2008 after his surgeries. In 2007 we found a home in Huddleston, VA (Chad's hometown) and the children and I took possession on July 13, 2007 while Chad stayed at Camp Lejeune to complete his surgeries and therapy. April 2008 we closed on our home, this is during the mortgage crisis, with Acquisition Title (AT) in Hardy, VA with Kathi Anderson. February 25, 2009 we contacted AT because we were informed that the Updike's actually owned a portion of our property. We were instructed by AT to contact LandAmerica (LA) to submit a claim. At this time AT produced a printout from their computer on the procedures to submit a claim. We contacted a representative from LA, Tiffany, on February 26, 2009 by telephone and by letter as instructed to start a claim. We have been in communication with this company since 2009 and have recently been told that since we no longer live in the home - we had to move because the loan was null and void because of the discrepancy of the plats - and FNTG is denying the claim. We have had to find suitable housing for my disabled Veteran husband and our Autistic child. AT has admitted the fault is theirs, but say that FNTG is responsible for paying the claim on the title insurance. We paid for the insurance when we purchased the home in 2008 and it seems that FNTG has dragged their feet with the process. We only want the value of the policy that we paid for. Now we are faced with going to court, which I am sure will be a lengthy process, just to get what is rightfully ours. We are fully prepared to make this as public as possible and have the backing of the Veterans Administration, DAV, AL, VFW, Acquisition Title, Flagstar Bank (the original lander) and Bank Of Botetourt (our current lender on our current home).
