THEY'RE TRYING TO STEAL OUR HOME AND THIS ISN'T THE FIRST TIME! .....

Our mortgage loan was sold to Fairbanks Capitol Corporation and we were sold down the river.

Two and a half years ago, we found our dream home and because of this company, it has turned into a nightmare.

They continually harrass us stating that we have not paid them, that we are late, that they are foreclosing. They use intimidation, threats, outright lies to force you into a corner.

I am sick an tired of their business practices and want to join any fight in a class action lawsuit against these people.

The latest of many ploys is to claim that my check this past November 2002 did not clear my account. This was after they attempted to withdraw (illegally and without my authorization, a payment from my checking account that did not clear because they had already cashed my November check) They presented it twice and caused an additional $50 in overdraft fees on my checking account.

Now they are threatening us with foreclosure (once again) and have charged us fees when we have made our payments. I will be sending the monies they demand (to prevent further action) and will be making demand for credit toward my February payment and a refund (yes, they have demanded that much!) I will be corresponding via certified mail only in the future with these monsters and suggest everyone do the same.

Because of the erroneous reporting done by these people, I doubt we will have an easy time of it refinancing our home this coming July, but will have this history to help (I hope). We have a 3 year early payment penalty of 6 months payments and are stuck until then, but at this rate, Fairbanks will have that 6 months in overpayments before then.

My nightmare continues. Because of their continued demands for money, we cannot landscape our yard. We cannot furnish out home. We have borrowed from friends and family to keep ahead and prevent losing our home. I sold a home to purchase this one and feel I would lose a 23-year investment if I just walk away, but sometime the fight seems just too much.

Because of the great work that has been done by this website and other consumer advocates, we are all very close to putting a stop to the abuses that Fairbanks has grown accustomed to perpetrating. Patience is a hard thing to find when you are fighting with politically protected criminals, but a favorable resolution is very close. Hire a lawyer with experience in the foreclosure laws of your state. Whatever she charges you will be minor compared to the amount Fairbanks is going to steal from you, if you do not fight.
