I have been working with a collection agency for a year, in helping those SPS, fairbanks, etc. customers who were wronglly sent to a collection agency refinace their homes and get away from this company.

I have refinanced over 30 people out of SPS, and have heard all their stories. I have researched these mortgage companies, and I am ashamed to say we are in the same business. I have dealt with young families that were just starting out and got knocked on the butts, to the elderly are innocent to these crooks dealings.

I have also worked with SPS to obtain settlements for the people I am refinancing. I am outraged at how they even treated me, and I am not even their customer. It has taken up to 6 months to get a settlement from this company. Every payoff I recieve has over 5000 in extra fees added on to the payoff.

This company and everyone who works for them shock and appaul me, and karma is my only hope. I have become friends with a majority of my customers and I feel for their situations, and I shutter as I read all these reports of other people out there that have been burned.

I have seen and heard it all, and I would like to help.

If you are still stuck with any of these companies. I can help you refinance your home out of their companies. You may have been turned down before, but keep in mind this is how I get my business, this is my livelihood, and I will be honest with you. I am, also, a victim of SPS, Inc.  Are you still helping people get out of that company?  They, just recently, threatened foreclosure on me.  I have worked out a "payment plan" with them, but it has raised my payment by approximately $600.00.  If you are still doing this please get back to me!  Thanks!

Kinsey, As many others, the downward spiral continues. Any help on how to refi would be of great help. Does anyone know of a single modification done by SPS? It seems this is just a vicious cycle that has no end. Twenty years only to loose everything, to a company full of people that should be in Jail! The governments way of keeping people in there homes. Way to go. Any answers are greatly appreciated. Lawsuit, count me in.

I dont even know where to begin, we had benificial finance but fell behind a month went to refinance and went to mortgage broker...they said dont worry bout being behind we will get u financed and that will pay late pay and charges. So, when it finally came time to sign, it was a balloon and we could not back out, now too late to catch up with benificial finance, so we signed. I do believe it was Equicredit first or maybe fairbanks, not sure but next thing we were sold to SPS. After that, have no clue on timeframe, we almost got forclosed on. We tried to file a chapter 13, paid an attorney 2800.00 (Carol Cagle of Alton IL), after about 8 months to a year she failed to file some paperwork to adjust intrest (?) i think on our cars, and the courts discharged our case. Immediately the first car was repossesed and then the other one we turned in to a dealer (ford actually wanted what we originally paid for it after 3 yrs of payment) OK, so we got another local attorney to file a chapter 7, told him the whole story and he stated we would take care of the previous att. after we get the house out of forclosure. Well, Steve Stanton of Pontoon Beach IL, was just another nightmare!! Paperwork, Paperwork then we called the office one day, oh, he is in court about your house....we show up and pulled him out, he asked why we were there (obviousley we wanted to be there since is was about saving our home) and we told him, well there is court for our home and his response was "well i am here they are forclosing on your home!" Oh no, I thought my husband was gonna kill him! I asked him, well what about the lawsuit against our other lawyer? response: "Oh, I dont do malpractice suits".....OK now we go home call SPS< Select Portfolio, they want $5000.00 down and we go into a 2 year forbearance agreement (double payment still after already 2 years) we paid $1600.00 for 2 yrs tried to refinance...could not...owed more than house was worth....still in balloon....they said we were not until feb 2007 (balloon came mature in dec 06') sent letter stating balloon matured in 12/06 and they needed all monies. once again had to make arrangements....now 30 yr 8.9% original loan rate. It is now 6/23/2009 and I know owe $101,000 on a home that isnt worth 80,000. I did some research and in 4/2007 I owed 84,000 and then a "misapplication fee was added of over 24,000" I looked up the word misapplication and it means "fradulant" and so on. We really need help, there is no way out, neighborhood going downhill, we put new roof, all new plumbing gutted bathroom, complete rehab on 2 of 3 bedrooms and working on new kitchen but the more we fix up, the less it is worth.....statements never match what they say we owe and payoff is also inflated!!!! when they wanted to forclose, years ago, they said we were 24,000 behing!?!? I would think that they would have foreclosed after three payments behind of $749.00 but where did they get $24,000.00....sorry for rambling on, dont know where to go or how to get help...I do know, like all others, I am getting ripped off....BIG TIME....and just keep sinking deeper. Any advise will help..... PLEASE!!!

I had my mortgage sold to SPS 2 years ago. I tried to have them modify it because currently it's an ARM but they denied me because I have not been late on the payments. How ridiculous... I found the comments on your website by chance and I'm particularly interested in the one posted by Kinsey from Glendale, Arizona. I too am entwined in this never ending cycle with SPS. If there are any lenders out there who is willing to give a "Fresh Start" to hardworking people trying to save their homes, please let me know. It sounds as though we do need to contact the US Attorney General or someone who can put these people out of business once and for all. I recently met at least 200 people at a Save Your Home Workshop who had filed Chapter 13 trying to save their homes from SPS. It is apparent that Fairbanks as a new wolf in sheeps clothing. There are at least 9 foreclosed homes in my community just sitting that were taken back by SPS. Can anyone help us?

I have a conventional 30 year fixed mortgage with Select Portfolio Servicing at an 8.5% interest rate. Since I have read so many complaints on this servicing company and they have not offered any resolution to lowering my rate, I am looking for help to modifiy my rate on my loan. I am now 3 months behind on my mortgage and I don't even know who owns my loan, since the are a servicing company. Are there any government options to me as a homeowner with this company? Has anyone been successful at getting there rate reduced without going through a refiance by getting in touch with the loan resoulution department at SPS? Does my loan fall under any of the goverment modification guidelines to mandiate SPS to modify my interest rate on my mortgage. Any comments or suggetions would be appreciated. My note was sold to SPS October 2008- payment history perfect from 7/06-12/08, now have 2 reported late payments (30 day) for Jan and Feb 09, 50%LTV, 170k equity but haven't been able to refinance due to stated income (self employed) and, now, hit to credit for the last two months late payments... FICO is likely in 620 range by now... hoping to retain the equity and home and repair credit-am I asking for a miracle??!! I was hoping SPS would agree to remove reported late pays from credit b's if I paid the note current, but in researching have seen many reports that SPS will NOT remove late pays reported to the CBs... is this true? Does it matter (do I have a chance of a refi option)?

I called SPS and ask what happens when cannot make payment and they told me they would sell my house and i would foreclose on it. Some help this $700B package has done for consumers. I refinanced my house in 2006. I was astonished that the company (Acoustic)whom I refinanced with immediately sold their mortgage company to another mortgage company who also sold their company to SPS. All these turn over occurred within the first 6 months after refinancing. I had no choice since I am a single mother who is also the household head and had to keep mortgage payments for as long as I worked. Unfortunately, I was unable to work for 6 months after 18 months from refinancing, which certainly put me in a financial hardship and simultaneously the mortgage payments increased over that period. I still am interested in refinancing but my credit has been affected by so many events related to financial problems. I have moved to AZ so I have tried to sell the house but unfortunately that market remains in its poor condition and endless decline. If you can help me refinance my loan with SPS, I will entertain the idea. Get back to me via email. Thanks.

My friends, I did beat SPS to save a home. It is not as hard as you would think. If you have been trying to work with them and they are threatening to take your home tell them you are interested in a short sale. Meaning you want to sell your home for less than what you owe on your account to someone else. All you need is a family member friend etc who has good credit. Have them purchase your home at a reduced rate. The bank may go for 75% of the value of the home( not the value of your loan). Keep in mind they do not want to take your home they want money. It costs them money to foreclose on a home. If you offer to sell it, it does save them money.

I too had dealings with Fairbanks aka Select Portfolio. I had fallen into hard times causing me to fall into a forebearance agreement with them. Just when I thought I was all in the clear, I was somehow owing a huge amount of money again. I couldn't seem to get out from under it. The next thing you you I was in foreclosure proceedings and nobody would help because my credit was not too good (which is why they took me on to begin with). I lost my home of 20 years last year. The home that I raised my children in (with one still home), buried pets in the yard (hamsters...), and had landscaped with all the plants and flowers I loved. I had to pack up my whole life, and leave. It was devistating to my daughter, who still hasn't adjusted well to the move (she's 14), different school system and everything ! Life does go on, but it is not the same by any means. I wasn't smart enough I guess to investigate this company. I felt like a failure, and became so afraid when the phone rang that it was them. Sure wish I would have known about this site back then! I have a hard time driving past it now when I go to visit my mom in the same town.

Kinsey - I am a victim of SPS who bought out my mortgage from Accredited Home Lenders. After a job loss not due to my own undoing I began to struggle. I explained many times to SPS my circumstances but they are rude and uncaring. They hold 80% of the note on my house. Another mortgage company holds 20% and they have been very cooperative (Soveign Bank). Four months after the job loss I found another earning substantially less. I tried many times to refinance but my credit was ruined at this point. I missed my third payment and was served with foreclosure. Working with United Home Savers, really nice people, hasn't helped either. SPS refuses to set up any type of repayment plain for a negative dept to income ratio. Well that's because I'm stuck in an adjustable rate mortgage. I can add more but will save it for now. Please help! My home is listed for sale but the sherif's sale is March 6th. I will sell my home but don't want to give it to these people. Seven Year Battle with Conti, Fairbanks, SPS lost, need help!

First let me explain my situation. In 1999 after being serverely injuied in the line of duty as a police officer and becoming 100% disabled and paralyzed from the waist down my wife and were forced to refinance our home in a attempt to save it. We obtained a regular 30 year fixed HUD mortgage with a regualar mortgage company, but within 2 weeks our mortgage was sold to Contimortgage. That's when the gates of hell opened. We made over 18 months of regular, on time mortgage payments when one day we received a registered letter saying they where foreclosing on our home for non-payment of the mortgage! Dozens and dozens of phone calls, some even tape recorded got us nowhere. We were served papers that the house was being sold at public auction. I hired a lawyer with what little money I had. First, I found out the company they hired to foreclose did not have a license to practice in Virginia! They settled out of court and the agreement stated they would bring all records up to date, deleate all late fees, and correct all credit reports plus pay my lawyer and give me $1000 for my trouble. Then Conti went bankrupt. The next devil followed out of the gates of hell named Fairbanks. Same people, same building, same corrupt practices. I thought all was fine, for 2 years when all of a sudden I received a regular monthly statement that said I owed $18,000 in back payments and I had no home owners insurance so they were charging me for forced home owners insurance! I got the insurance straight, but from then on it was a constant battle on my mortgage balance! It went up and up every month, even though most of my payments were made by bank certified check or sent certified, return receipt. I could no longer afford a lawyer as he wanted $500 per hour plus expenses. Fairbanks was being sued all over the country and even the State of Maryland and their Governor went after them. The Fifth Circuit Court of Appeals for the United States even over turned a big case against them were they foreclosed on homes because they did not have a license to practice real estate, they were in essance a collection agency and could not take homes. So, they changed their name again to SPS and my battle continued. I filed numerous complaints and stopped foreclosure for over 2 years, then, in a blink of an eye, on August 10 they sold my home for $122,000 at public auction. Now, my next problem is this. They reported to all 3 credit reporting agencies that I owed only $80,000. My statement shows a principle balance of the same, yet they are telling me that I owe more than the $122,000 the house sold for therefore I will not get anything! The house was valued at $156,875 at the time of sale! What can I do? I need help and I don't know where to turn any more. If anyone can please help me, I really need it. I have been victimized by the SPS et al gang as well. I am very trusting and I have tried to do everything that they have asked. They have also said not to make any payments as they would not accept them. This was on the phone so I have no proof. They have offered me the short sell option but I am not sure after reading this article. This has been ongoing now for almost three years with me trying to keep up. What would happen if I just walked away? Is this at all an option? I have another place to live so that is no concern any Ideas. KINSEY do yuou have any thoughts. I have done what they wanted and after reading all of this I am at a loss as to what to do. They have experience in handling these type of loans. I am also a victim of Equicredit aka SPS aka Fairbanks aka EMC aka Aames Home Loans. I have posted my own comment on these so called people and just want everyone to know that if you get a call from Aames Home Loans that they are another company of theirs. They contacted us about refinancing our home and drug us along for 3 months telling us not to send in our bankruptcy payments and that we would close on the loan soon. They then tell us we are denied because we are behind on our payments when the court has been making them all along. Come to find out they were checking our credit report almost every month since May and are still doing so since I first posted on this site and my state representative contacted them along with the FTC. They are crooks and need to be stopped as they continue to put points against our credit rating everytime they check it. Also Countrywide is another one of their companies. I want to refinance if anyone knows anyone that is not affliated with them that can help us please contact me through this site.

I too was a victim of this bad company and Kinsey did a beautiful job and this company tried to squeeze every little nickle out of the people she used to help me get financed.And I know because thier credit agency did all but destroy your credit record.I even tried to get local help and I tried to explain to our agencies around here and they didnt want to help me because SPS gave them bad and inaccurate information and I was in with them fighting for about 5yrs.Things you can do to help your selves are to keep all pay histories reciepts and any info you paid them even if its for a dollar.Also check with you title agencies because SPS trys to foreclose on you and the title isnt even i thier names and dont.I would keep every thong because i have a feeling that in the future they may be i a lawsiut again.And finally Call Kinsey because she will help you get away from these people and still write your elected officals and tell the how you feel about improper serving issues with this company and maybe with the help of all we can help each other out and put this company to rest

Hello, I just want everyone to realize that Equicredit is also Select Portfolio. they try to act like they are different companies, but they are all the same. I bought my house 6 years ago. I was not aware that in the fine print the terms of my mortgage were a 7 year balloon payment due in Sept 2006. I don't know how to refinance because I am now on a SPS forbearance agreement. My credit is a total mess. Once again, they are all one big company who lies for all of their past misdeeds.

I will be out of bankruptcy in Sept. of 2005, I have been with Select Portfolio aka Fairbanks since 1998. They have tried three times to lift the stay on our property to try and take it back. Trustee has sent $5555.57 on our account and they still show us as 30-60-90 past due. (according to my status this was what they claimed at the beginning of my bankruptcy 12/30/01) Of the amount sent by the trustee 1250.00 is not accounted for. I would love to refi and get out from under them. I know when my bankruptcy is discharged they are going to start. I know I should wait until I'm discharged to start refi, but I am so ready to get away from the nightmare I have lived for 6 years. How can I get in contact with you? also, when the settlement came thru for the class action, they showed over 5500 charged in bogus fees, my setlement was $427.00.
