Complaint Review: Fairbanks Capital Corp. /Loan Svc. Ctr. - Wichita Kansas

I got an early morning phone call from Fairbanks, who had just purchased my mortgage, that my very first payment to them had been returned for (insufficient funds.) After informing them that I had never mailed a check because I have automatic/withdrawl set-up, I got an angry voice telling me that my bank had denied my automatic withdrawl payment and demanded that I go down to Western Union that very instant. This just didn't feel right, so I asked the woman if I could call her back to verify this wasn't a confidence scam (after all, I have never had a company try to use intimidation techniques.) She became even more abusive, yelling at me to "just do it".

I at that point became convinced that this was a confidence scam and replied that if they are who they say they are, they had access to the money. I immediately verified my balance, confirming that yes, the money was there. I received an early morning voice message, stating that the payment request would be immediately resubmitted. About three weeks later I started getting hate calls from Fairbanks stating that every time they tried to resubmit payment from the bank, they were denied. I contacted my bank, who showed absolutely no attempt for a resubmission. After calling back several times (and being screamed at for asking questions), I was again told they had several returned checks from me.

When I again informed them I had not written any checks, nor had my bank shown any request from them. I asked for specific dates from them so that I could show proof of my daily balances. The representative became hostile and started yelling at me. When I asked again for specific dates, she yelled at me that she couldn't share that information with me. I got a letter from my banker, proof of account activity to submit to them, and then the dates changed. I obtained that proof and yes, the dates have changed again. I knew immediately that I was with a shady company. I applied for another loan, with a lower rate, only to be told that Fairbanks had listed on my credit report that I have been over 30 days late on my mortgate payment (quite impossible having automatic withdrawl.) I have now been told that no lender will consider me with that on my report.

Every attempt I have made to contact that company has resulted in hateful tones, yelling at me, telling me I need to verify all of this information, (again.) and hostility resulting in a phone slamming in my ear for asking them who to contact. What number to call. The specific dates of their submitions, and THATS from the supervisors. And though Fairbanks has claimed insufficient funds for multiple submitions, they will not release to me the dates of their resubmitions. And they hang up on me when I ask that the $50 late payment fee be removed. I am now on to dispute this with the 3 credit bureaus.

Thanks to all of you, I not only have the letter from the bank and my bank statements verifying their deceptive practices, I also have 24 disputes with this same amoral company. I am repulsed by their sick attempts to try to keep me enslaved to their rates, and blocking any attempt to leave their company by marring my credit report. Beware of any company trying to conduct business using hostility and intimidation techniques which have more than once brought me to tears. They are simply big, nasty bullies. Any effective tactics in dealing with this company would be greatly appreciated!
