I leased a house from David Revell in April of 1999, giving him a 2 year lease and a $625.00 security deposit. In November of 1999 two people I did not know knocked on my door and told me they were my new landlords.

Apparently my landlord had lost the property to his ex-wife and her new husband. December was a nightmare. At first my original landlord, David Revell, told me I had to pay him Dec. rent and at the same time I was receiving threats of eviction from his ex-wife. By the middle of Dec., both Mr. Revell and his ex-wife were telling me not to pay Dec. rent to anyone until I heard from them. It is my understanding that the issue of who controls the property was going back to court that month.

I didn't hear from anyone until the second of Jan, 2000, when the ex-wife and her husband showed up at my door with a new six-page lease requiring a new security deposit and containing terms that were unacceptable to me. So I moved on Jan. 8th. I was sued for Dec. rent and was found to be liable to the ex-wife for Dec rent in the amount of $625.00 plus $580.00 for Jan. rent.

I tried to get my security deposit back from my original landlord, who at first said he was keeping it for Dec. rent. Upon informing him that I am forced to pay Dec. rent to his ex-wife, he refuses to return my deposit because I didn't give him 30 days written notice (He did not own the property and was not entitled to received rent for the property at the time I moved) Therefore I tried to sue him for return of my deposit.

Alas, he has eluded the sheriff and I cannot get him served so I can have my case heard. Besides being out the 625.00 security deposit, which cannot be applied to my outstanding debt to his ex-wife as would normally be the case, I am know being threatened by his ex-wife for my perosnal belongings, my car, my furniture and personal possessions, to pay my judgement to her. I am also out moving expenses, a new lease and rent for Jan. in my new apartment.

I am told that in order to have my original landlord served I must now find him and pay another service fee, take another day off of work to go to court, possibly only to find out that he still was not served.

I am just a hard working individual, struggling to make ends meet and I cannot get any justice out of the court system. Please help.
