On June 18th, 2018, Cinthia Nicholsen and Robert Nicholsen charged back their credit card for multiple purchses after their vacation in Miami, hurting individuals and small buisness owners. They have also been investigated for review extortion, fraud, and violations of fair equitable busines. They are both banned for life on HomeAway and their account has been suspended since April 18th 2018.

1) On Feburary 26th 2018, Cindy and Bob Nicholson made a reservation for a stay on our boat in Miami from March 20th - 23rd. They tried to book longer, but all dates were completely rented for season.

2) During this time, all hotels and vacation rentals were either booked or skyrocket in price because it was Spring Break and busy season in Miami.

3) Immediately, weeks before their arrival they were looking for problems and trying to get free additional nights, free accommodations, and compensation for complaints about HomeAway customer service - which has nothing to do with our listing. After all of this their account was suspended for trying to gain monetary benefit for review extortion on my HomeAway listing AND another one! (see attached pictures)

4) Renting the boat is more of an experience and adventure as an alternative to hotels, it's a way for a couple to try something different. It's truly a positive, awesome experience. We also have apartments for rent, but the boat is the best one.

5) We have been hosting the boat on HomeAway since March 20th, 2015, and on Airbnb since April of 2014. Since then, we have ALL 5 star reviews! It's truly a fun experience! (see attached all 5 star reviews)

6) I believe Bob and Cindy rented the boat because it was the cheapest option for them, and they really wanted a hotel, but perhaps couldn't afford the seasonal prices or maybe hotels were not available. This happens sometimes.

7) On March 20th 2018, I met Bob and Cindy for check-in, but since they arrived late, I actually did a Video-Walk-through with instructions on how to use the boat in case they got there and I wasn't there! So I actually have pictures of the condition of the boat on the day of their check in. (see attached pictures of condition of boat for check-in). They acted pleasant when I showed them the boat, we shook hands, and I left.

8) They not only stayed the full amount of time, but they called HomeAway with so many complaints even prior to arrival that HomeAway just to appease them gave them 3 additional nights in a hotel for free in Hollywood, FL right on the Beach, which far exceeded the value of their reservation! They have nothing to complain about. Their complaints were nonsense, for example:

FOR EXAMPLE: One of their complaints was water was dripping on their head from a 'leaky hatch' - the irony of all things to complain about, in Miami there was a drought way prior to them arriving and way after they left. All the grass in Miami was brown. I attached the official weather history showing "0.00" precipitation for the week they were there. (see attached weather report)

9) Then after staying on the boat, then staying in a luxury hotel, On March 28th, they have the audacity to ask for all of their money back, or they were going to write several bad reviews. They made several complaints to HomeAway, but HomeAway found them to be frivolous and closed the Case ID 15115988. They also tried this with another HomeAway Listing. If the complaints were genuine, they would have complained DURING their trip, right?

10) They were reported to HomeAway by both listings and there was an investigation under Case ID 15354412. On April 20th, 2018 The case conclusion was "Cindy Nicholsen threatened to use our reviews platform for monetary gain. Our findings confirm that there was a threat to abuse the reviews system and to use it to force a specific response." And the account was banned and reviews removed from both listings.

11) Cindy Nicholsen and Bob Nicholsen have been investigated for 1 month for fraudulent activity and were ultimately guilty and banned for life on HomeAway. They somehow negotiated a 3 night additional stay at a Hotel in Hollywood Beach, Florida right on the ocean, at least worth $1,000 for those dates. Also, their HomeAway account became suspended from this behavior. And now I am not surprised they have the audacity to do a charge back. Shame on them!

Let me tell you why you are wrong and give you a life lesson: The right thing to do if you truly felt you didn't like the experience, is call the hosts and say "Sorry, this isn't for me" and then we work it out and rent it to someone else. That was the proper action. Instead, you never contacted the host, you kept your reservation, leveraged your complaint to benefit from free hotels, then weeks later did a charge back on your credit card. For that, you are untrustworthy to deal with and this ripoffreport is completely valid. There are no lies here. I hope no one does the same thing to you. Good luck with your life

1st PICTURE - LETTER FROM OUR BANK, FROM CENTRALIZED FRAUD CLAIMS DEPARTMENT SHOWING ARE CLAIM WAS VALID THEREFORE DISPUTING THE CLAIM MADE BY CHRISTINE AND CRAIG.  VISA FOUND OUR CLAIM TO BE VALID.

2nd PICTURE - REVIEW LEFT BY ANOTHER TRAVELER FROM AIRBNB SITE SHOWING THAT BOAT DID IN FACT HAVE A LEAK ABOVE THE BED.  EVEN THOUGH CRAIG AND CHRISTINE POSTED WEATHER REPORTS THIS REVIEW BY THIS PERSON VALIDATES OUR CLAIM THAT THERE WAS A LEAK OVER THE BED.  IT MAY NOT HAVE RAINED THE NIGHT WE WERE THERE, HOWEVER, THE HUMIDITY WAS VERY HIGH THAT EVENING CAUSING CONDENSATION TO DRIP ON US AS WE SLEPT.

All of the payments she used to "make good' on her last scam were AGAIN reversed! This family is unbelievable. I am taking action against this person. I will post update with the action I take. If you see this person, make sure you let her know she is a SCAM and a FRAUD.  After a thorough 30 day investigation by Visa, we were awarded our money back.  You call us a scam and a fraud?  Once again you are defaming our characters and names, this is unaccetable, untrue and will not be tolerated.  If you think you can bully us on this platform, you are mistaken.  Evidentally Visa saw the truth in this chargeback and sided with us.  Case closed!  See attached letter from our bank

I will not allow you, Bob Nicholsen, to decieve readers with your responses. You should know I have plenty of documentation including the recorded phone calls from you to my business line, which starts in February, 2018 from phone number 1-856-466-3960 which was a 3 minute and 31 second phone call was about you complaining about the customer service of HomeAway and VRBO because they were people in foreign countries.  I am not decieving anyone, are you decieving me?  This post was written by Christopher.  We rented from Craig and Christine, who are you?  Phone calls made to you in February are irrelavant, that was before our stay.  We also have extensive documentation proving that we were not at fault in this case, rather you are victimizing us, and I WILL NOT TOLERATE BEING DEFAMED AND LIED ABOUT!

I will just continue to post documentation like the official email from HomeAway confirming review extortion, which will include the recorded phone call or the transcripts. Post away

If you claim you canceled the reservation, go ahead and post your cancellation email confirmation here from HomeAway. If you are able to do that, I'll pay you $1,000. I never cancelled my reservation, we were offered alternative accomodations at a hotel as the condition of your property was unsatisfactory.  After sending pictures of the condition of your boat, they OFFERED to put us up in a hotel to enjoy the rest of our vaction as your boat was not what you claimed it was on your listing which at this time is no longer on HomeAway listings.

If you want to know if Nicholsen is lying or not, look no further:

1) HomeAway could not possibly instruct the guest to do a chargeback, because HomeAway's chargeback department are the ones fighting the chargeback. Again this is false.  I was instructed by Home Away to file a chargeback with my bank.

2) If you received an accomodation to a hotel and you were happy with it, why on earth would you chargeback? The only reason is because this is an oppurtunity for you to have a vacation and not pay for it. Period. Again, we filed the chargeback as instructed by HomeAway customer service team.

But in your mind, you somehow feel that it is equitable that you can enjoy the benefits of having an active reservation, a free hotel, a free trip to Florida and then chargeback your credit card to avoid paying for it. Equitable?  Your property should have never been listed as it was unsanitary and completely different from the listing therefore decieving travelers into thinking they were going to stay on a luxorious yacht (I have pictures of your boat from you listing and pictures of what it really was like when we arrived, and when we arrived your boat was in a different location, not as pictured in your listing.  You also claimed it was steps to the beach when in fact it was a 15 min car ride to the beach)  Secondly, our trip was not "free" as you state above.  Besides the cost of airfare, Uber rides, car rentals and dining out the trip was far from "free"

THAT is why people should not to business with you, and that is why there is a ripoffreport to warn others. People have done business with me for over 25 years because I am an ethical, honest person with a clean record.

Here is our rebuttal to these claims/statements made against/about us:

They are both banned for life on HomeAway and their account has been suspended since April 18th 2018"After explaining to Homeaway how dissatisfied we were with the condition of the rental property, we were instructed to go to our bank and file a chargeback for the amount we originally paid for the rental.  After a lengthy conversation with Homeaway, they nor we have any knowledge of being investigated for extortion, fraud or any violation of fair equitable businesses or any other false claims or acusations which can all be disproven.  As of 7-19-18, we are not banned nor were we everbanned from Homeaway and our account is active.

They tried to book longer, but all dates were completely rented for season" This is false.  First of all the boat was located in Aventura which is 18 miles north of Miami.  We originally booked from 3/20 through 3/22.  My wife booked for 2 nights and asked to book for a 3rd night which Christine accepted and booked for us.

Christine wrote "2) During this time, all hotels and vacation rentals were either booked or skyrocket in price because it was Spring Break and busy season in Miami." This very well may have been true as we didn't search for hotels in the Miami area due to the fact the we had booked our stay with Christine on her boat.

(see attached pictures)" Again, this statement is false.  How could we look for problems weeks before arrival? We did not try to get free nights or accommodations at Christine's or any other property nor were we seeking compensation for any complaints about Homeaway customer service.  Homeaways customer service to us during this ordeal was superb.  Again, our account with Homeaway is and never was  suspended as confirmed by Homeaway.

We also have apartments for rent, but the boat is the best one." Having owned 2 boats in the past, we were aware of what we were going to experience.  This rental was far from an awesome experience. 

Christine wrote "6) I believe Bob and Cindy rented the boat because it was the cheapest option for them, and they really wanted a hotel, but perhaps couldn't afford the seasonal prices or maybe hotels were not available. This happens sometimes."  This is an unfair acusation to make.  How does Christine know our financial status?  My wife booked this as a surprise for my birthday for us to stay on a boat instead of a hotel for a unique experience. Much to our surprise we were very dissapointed as we did not experience what we should have as Christine's listing for the boat implied.

The hotel, Ramada Inn, located at 1925 Harrison St, Hollywood FL, which is 2.3 miles from the beach, not "on the beach" as written above.  By getting us a room shows good customer service on the part of Homeaway.

(see attached weather report)" Although Christine provided a weather report from that day, according timeanddate.com, the dewpoint was 75% the 1st night we stayed on the boat and there must have been condensation that dripped on my wife's clothes that night.

We have documentation to back up our rebuttals to these false claims made against us.  Every claim made against us can be backed up with proof showing we did noting wrong.
