In October 2004 my wife and I went to Clearview to have them build us a custom-built home. During our construction agreement signing Clearview requested a check for the amount of $6,500 which was to be used to cover administrative expenses. Clearview also requested an additional %$5,180 once we had mortgage approval from an approved mortgage bank. Before leaving Clearview's office my wife and I signed all the necessary documents as well as handed over a check for $6,500.

A couple of weeks later we received a letter from the bank stating that our mortgage application had been accepted so we sent Clearview another check as requested in our Construction Agreement for $5,180. At this point a closing date was scheduled with the bank, our attorney, the sellers of the land which we had entered into a land agreement with and Clearview.

The first two closing dates were cancelled or postponed by Clearview and their reason for postponing the last closing date was because "management" had stopped all new construction for the month of December. Clearview sent my wife and I an addendum which requested an extention of the end of January 2005 from us as well as the land sellers. We signed the addendum and sat back for our new closing date.

Two weeks before our new closing date our attorney had spoken to Mr. Slayton (the owner of Clearview) and asked if he would be willing to move our deposit monies totally $11,680 over to an escrow account if we agreed to have Clearview as our builder and Mr. Slayton verbally agreed. The problem was that Mr. Slayton never agreed in writting nor did he ever more our money over to our attorneys escrow account.

A week before closing I contacted Clearview to make sure everything was still going as scheduled but I quickly learned that they we not! When I spoke to the person reasonable for financing at Clearview she had no idea that my wife and I had a contract extension set for the end of JJanuary. She informed me that she would contact me right back with more information but that was the last time I ever heard from anyone at Clearview Builders!

At this point I contacted my mortgage bank to see if they had any idea as to what was going on and that's when I was informed that "Clearview builders was no longer a registered builder with Countrywide Home Loans and that all inquires should be made to Mr. Dennis Slayton of Clearview Builders." I informed my attorney of the news and he said that we needed to allow Clearview to bypass our latest closing deadline in order to have them be in default of our construction agreement.

We took our attorneys advice and allowed Clearview to go into default. Our attorney sent a letter to Clearview demanding that our deposit monies of $11,680 be returned no later than February 4th, 2005. Needless to say that my wife and I have not received a single cent back from Clearview even though they did absolutely nothing for us. Nothing!

I've reported Clearview to the BBB, Attorney General's office, and The Pocono Builders Association. I came out on the front page of the Pocono Record on 2/12/05 regarding my experience with Clearview and I've even created a website to share my story with the world! Lastly, I was recently interviewed by NBC regarding Clearview and my attorney who handling my closing (which never occured with Clearview).

But what about all those BBB member businesses that had complaints filed against them? Consumers never get to hear about them. What about the BBB advertising to the public? Is this a false and misleading perception they are giving about consumer confidence when dealing with a business? I filed complain with BBB for my builder but they refuse to log b'case there were no other complain except me...this does not make any sense. wondering how much can we rely on BBB
