I have filed a compliant against a Missouri licence dealer to the Missouri Motor Vehicle Bureau.

I have contacted the owner of CJ's Auto Sales located at 4324 South Kingshighway, St. Louis MO 63109 several times requesting that he file a quick title in his dealership's name so that I can obtain the title for the 1989 Dodge Shadow purchased March 16, 1999.

I have been unsuccessful in obtaining this title. On February 28, 2000, the 1989 Dodge Shadow totaled by a driver insured by Geico Insurance Company. The insurance company settlement was for $1350. There was a remaining balance of $300 left on this car owed to CJ's Auto Sales. The insurance company will release the final payment of $300 to CJ's Auto Sales with the remaining balance of $1050 due to me only after they receive the title.

The owner of CJ's Auto Sales stated that he could not obtain the title because I had not paid the sales taxes. At this time he suggest that he file for a repossession title. I told him not to do that and that I will pay the taxes the following day. I phoned Jefferson City immediately to get the amount of taxes due on this vehicle. Jefferson City informed me that the title had been rejected and sent back to the dealer on September 16, 1999 and was never returned to the office. Since the title is incomplete and not on file this prevents me from paying the taxes. I was advised that numerous titles were sent back to CJ's Auto Sales to be corrected. I have also learned that there have been many complaints reported to the police department in reference to CJ's Auto Sales.

I spoke with a representative at the Department of Revenue in Jefferson City on several occasions. The representative spoke with the owner of CJ's Auto Sales also. The representative suggested to the dealer to apply for a quick title in the dealership's name. The owner agreed. The representative also gave me another option of writing to the previous owner of the 1989 Dodge Shadow to ask if he would apply for a duplicate copy of the title to then sign over to me. I did write to the previous owner, but with no response.

I again contacted the owner of CJ's Auto Sales several times, but he continues to state that he has already applied for a quick title in the dealership's name. I have been unsuccessful in all attempts to obtain this title since March 1, 2000. I am confused and frustrated because I do not understand why he refuses to release the title to me so that we both can receive our payment for the vehicle. Please advise me as to what other alternatives I have.
