My situation is very unusual and complex, but in short form this is what has happened. Chase Manhattan Mortgage sold a loan to Citibank, N.A. as trustee. The document that is registered and notes the sale says sold completely all of it's rights, liens, deeds of trust etc. Chase attempted to foreclose on the property stating they had retained the right to service. No paperwork registered for this and in fact the paperwork that is registered states otherwise.

Chase attempted to foreclose on the property using Wilson and Assoc. Wilson and Assoc. prepared at appointment of subtitute Trustee and registered it, however the appointment was made by Chase Manhattan Mort.(not by Citibank)and no P.O.A. exists allowing Chase to do this. When confronted, Chase Manhattan attorney-Tom S. says loan was sold to Citibank, N.A. in name only (not legal). After inquiring at Citibank, N.A. as Trustee, I recieved a response from their Trustee Corporation stating they didn't have a loan in the name or address inquired about and that they had no liens on the property. They denied a loan existed. Chase Manhattan Mort. (Tom S.) stated that Citibank didn't know what it was talking about.

Ultimately, Chase is trying to collect for a loan that doesn't exist and refuses to release it's liens on this property (even though they have already been paid in full by Citibank) They have also demanded money from me (the owner of the property) for a loan I don't owe for. Wilson and Assoc. has also been involved in attempting to collect money from me for the same loan. I haven't been able to obtain an attorney to represent me in this case (Chase Manhattan to big? or many mistakes made by many people? I'm not sure) All that I know is my property is being held for ransom by Chase for a loan that does not exist.
