cavalry portfolio put a levy on my monthly disability pension, which goes directly into washington mutual account. preventing me from paying for my medications, rent, light, phone and grocery.

I have made several payments to them and yet they still say that I owe them the same amount which is according to them $3,600.00. so that means that I am back to point one with them.

the levy was place on january 2, 2009. I called the bank and they gave me thier phone number. I called cavalry portfolio on january 5th and they requested that I fax them. 1. bank statements for the pass two months.

2. award statement showing how much I receive. 3. a list of monthly expense.

I fax all the above and called to comfirm that it was received. then I was asked how much of the $1,101.18 will I be able to released. I told the $200.00, and $100.00 a month thereafter. I was told that my offer will be handed to the committee.

I called back on january 8th. I was told that they want to keep $600.00. I explained once again that its becoming a health issue because I cannot get my medication, and could only afford to release $200.00. I'm still waiting for a call back.

Lovely what a name for a bottom feeding debt collector.  Notice how all the bad agency folks come here and troll trying to protect their "good name". 

The bottom line is all consumers do not, never, ever give bank account information to a collection agency.  They all use hard tactics to get that account number from  you for "one payment" then they just keep making debits from your account until you are bled dry.

 

There is no court that would allow or give an order to allow a levy on government benefits payments.  So like many people here indicated that the folks like Lovely at Cavalry lied in court documents or they are just using account information you supplied to make debits from your account.

Either way - Close the account and get a new one ASAP.   

 

If they call you tell them to not contact you by phone in writing.  If they violate get a good consumer lawyer and sue them.

If you are reading this, and you are on some sort of exempt government income such as social security, etc., then read the new law to protect you from this ever happening again...

Apparently, the new IRS regs say that when the collection agency such as

Calvary, discount the amount they deem due them they send you an IRS 1099

to report to the IRS that you WILL PAY TAXES on

Yes someone needs to find out what this is all about

The only debts in which respective creditors can seize bank accounts or garnish disability checks without first achieving a civil judgment first is student loans, child support, and government loans (Including IRS issues as well).

If it's an unsecured debt not pertaining to the categories in my first paragraph, then Cavalry is COMPLETELY in the wrong unless a civil judgement has been successfully won. Even if a civil judgement is won, the bank account cannot be seized unless there's other income outside the scope of the disability check being deposited. I know in NY State if the sole source of money going into a checking account is through disability and/or SSI, that money cannot be seized. Not exactly sure on other states however. Regardless, this longtime poster Steph I agree states both misinformation at times and sometimes makes statements like a 10 year old with advice on other posts like  "Tell the bill collector to f*** off and hang up the phone." Really? With all due respect, you don't bring anything to the table.Have you ever shaken down an agency for FDCPA violations or successfully defended yourself pro se in civil court as I have through foreign concepts to you such as discovery to force the creditor to walk away the times I was sued? Let the articulate professional debtors give the lay of the land on these topics.

Hello I am a collector from cavalry portfolio services and I would like to explain a few things to you. First of all YES it is Illegal to garnish disability checks, but it is NOT illegal to levy your checking account! There is no way in any shape or form we put a levy on your disability check. First of all the government would not allow that, and anytime a garnishment is filled it first has to go through your payroll department of the company you work with or in your case would have to go through the social security administration. If you still claim what you say is true I would like you to write me back with your account number so I can help you. This is how our legal process works, once we approve an account for legal and we file for judgment before we can do that you have to qualify which means you either have property, an employer OR an open and active checking account. Once we file for suit we send your account and documents to an attorney in your location to pursue and file the suit against you. Cavalry is a multi million dollar company with 4 locations. We are not going to put our company in jeopardy over 1 account or should I say YOUR account and if in fact this is true and we did this to you. Why have you not done anything about it??? That would be a HUGE lawsuit??!!! To steph, your rebuttal makes you sound like a true debtor. Learn your facts before speaking out. Debt collection company's are not out to rip people off, If it weren't for us collectors... the economy would be in even more worse shape then it already is. But people never think about that. All they want to do is blame us for their failures/problems. If you would like me to review this for you I would be more than willing if you provide me with the account number, If what your saying is true, I cant see you have any issue with that. By the way steph, collection company's know that there are complaints about them on websites like this and it's people like you who make a legitimate company look bad.

To the guy who had his disability payments garnished:PLEASE seek legal advice,as NO creditor,or in this case,jerks who purchase previously pd accts,& some closed,unpaid accts....they simply are NOT allowed to take any type of disability or gov. sanctioned payments to satisfy these so called 'unpaid bills'. Add to this, CVPS of NY,main offices in Arizona,are the biggest scammers with horrid employees....MANY of whom have online social network sites, holy crap these people are vile! I speak from 1st hand experience, as I was taunted by 1 in particular,thru MYSPACE, who now has her profile on private, as it shows her in various states of undress, vile remarks bout her drug use, attacks on people, & MY interaction with this tart began due to a personal issue,a breakup with my baby daddy actually, & from THIS, he was sent packing, then moved back to NY, got a job with PORTFOLIO & THEN this tart he worked with actually threatened me with her job status, CLEARLY, in emails,etc, telling me she'd find a billing with her employer & make my life a living collections nightmare hell! Well, long story short, she couldn't!But DID find an old bill for ATT&T in my daughter's name that in reality WAS owed, but was owed by the ex! When I refused payment, the Hell began, even MULTIPLE biilings for this 1very small,under !))$ bill! End result? The ex no longer works there, STILL is a damned druggy & this company, well, HE was actually USING his employment there to spy for his father's company, a direct competitor of CVPS,yup,another of these foul collection agengies! LOL! Sadfly, I hadda change my phone number, still get multiple mailings of various amounts, now 2 supposed ATT&T unpaid bills.....um,which are indeed BOGUS! They can't attach to MY bank acct, haven't tried that crap with my daughter's acct & if they do, believe me, there will be a legal batle they not only won't win, I'll make every attempt to show the many vile 'personal' issues not just of a few employees, but something extremely personal & possibly damaging regarding the owner.....cuz this fool hired my ex, had him doing IT work in 1 of his homes in the city(NYC) & yup, the ex not only snooped(huh?he was left unattended? ;-) )....he tried shmoozen me with the info! LOL! Let's just say the owner of this company has a few skeletons I'm more than willing to let outta their closet if the need arises. Funny tho, they now refuse to discuss the bill with me,claiming it's in my daughter's name.....but they have no problem calling MY home,sending letters to MY home, & if I was a shady as tyhem, I could pretend to be her! The ONLY slight reprieve I've gotten from their collection practices was temporary, when I emailed the owner ( Mr.Zaro) regarding the ex & his dirty deeds.So,basically, more han 1 of their employees USED the company in a personal manner, to cause chaos,etc.....& she still works for them! LOL, cause she's a knee dropper, a pole dancer & a con artist herself.Yeah, & a drug user who blatantly brags about it on social networks! As is the ex. They seriously should check their employees deeper insteada bothering people with their false collections.
