I contacted Capital one today and they were closed. They have charged me an additional $73.00 on my current payment which is due on 2/17/009. I have never been 30 days late since, receiving the car. I informed them in June that I had some health issues and then became umemployed in October of 2008. I receive unemployment compensation and told them the payment would not be made on the 17th but before 30 days.

I have emails from them informing me that they appreciated my efforts to pay. However, they keep sending letters and calling me. I called to check to make sure my payment for January had been received and this is when I learned of the $73.00 charge. I sent an email requesting that this charge be cancelled because they are closed today.

I am very surprised to hear such negative things about this company. I have been a customer of Capital One for over 3 years and have never had any problems like those mentioned. I am one month behind on my car payment. They have never been rude to me or threatened to repossess my car. They told me that I could make partial payments for the past due amount or even schedule my payment to be divided by my pay periods so that I wouldn't have the entire amount taken out all at once. When they call me I tell them when I will be able to pay and how much. Yes, they do ask for check by phone or if I can borrow the money from someone but I firmly tell them I can't and they never push the issue further. They did explain to me about the continuing phone calls until my account is current and they are constantly calling my cell and home phone but I just ignore them until I can schedule a payment. After I go online to schedule a payment, which can be done 7 days before the date, the calling stops. I understand how frustrating it is to owe someone and not be able to pay but I also understand that the people want their money just like I would if someone owes me. The constant calling is something we just have to bear until we can pay and we will always run the risk of repossession when we don't pay.

I have called this number several times in order to resolve a similar problem with Capital One Auto Finance. First of all they were of no help whatsoever and tried repeatedly to get me to give them to give them a post dated check. I am not sure where they are really located, 1/2 of the people I have spoken with are Indian so I am assuming that they are outsourced. I have explained the situation to them several times and yet, everyday all day every hour my phone rings. As I stated above, they were useless in helping. I tried to come up with a solution that was good for all, but that did not work either. It seems they either don't or cannot document the calls. I was told that the calls are computer generated and they cannot stop them from coming in. That is fine, but when you finally do get through to them after holding for fifteen to twenty minutes, it is as if you were talking a brick wall. They are rude and constantly talk over you. This is not customer service. In fact it is no kind of service. They need to be properly trained. Customer service is by no means an easy job, but it could be a more pleasant experience if they knew how to deal with people properly.

30 days late only applies to late payment credit reporting and does not usually apply to when a late fee is assessed. Some loans assess a late fee after 5 days, some after 10, some after 15, etc. I haven't seen any loans lately that give you until 30 days late to assess a late fee.

You are getting additonal charges because your payment is late. Depending on the terms of your loan the 73.00 may be the cost of the late charge based on a percentage of the outstanding balance. Also Loans accrue daily interest which would be shown as a finance charge on your statement. Not paying on time means that not only are you not paying on the principal but the interest itself continues to be applied to your balance on a daily bases. How are they ripping you off? Your payment is late and there is a penalty for being late.
