Harassment and Property Damage (Criminal Mischief and 2nd Degree Criminal Trespassing)

The towing agent, was hammering my door for 3 minutes straight as I told my sister to tell him to leave. She greeted him at the door. She spoke to the repo man through the closed front door, explained that I was not available, and asked him to leave. He yelled through the door to my sister.

My sister indicated that he told her he had contacted the police. At this time the repo man returned to his vehicle. A about a minute later, backed his tow vehicle across the front lawn to reach the car he wanted to repossess, since another car was parked in front of it in the driveway.

Immediately, I contacted the police about the violations. The repo man quickly moved to maneuver the vehicle so that he could position it for tow. He could only obtain access to the rear of the vehicle due to the proximity of the car to the house. After hoisting the vehicle up by the rear for towing he continued to push and pull the car on it's locked front wheels to a point where he could remove it from the driveway. He then proceeded to drag the car on it's front locked brakes, across the front lawn around the house for sale sign, over the large rocks hidden under leaves, and down the street.

Police officer arrived and obtained his information as he filed a report for which I followed-up by filing criminal trespass and criminal mischief charges.

Here is a list of items that have not been returned and were with the vehicle at repossession.

1 pair of white frame D&G Sunglasses (made in China)

4 Ikea large carrying bags (blue bags sold in store)

1 Unused emergency red plastic gas container

1 Emergency Car/Medical Kit (first aid kit with emergency car tools such as flares, flat tire repair, pump, etc.)

1 Garage door opener

1 Long umbrella

$5 in center compartment change

1 Miniature waste collection container with drawstring top

4 Boxes of facial tissue (travel size)

2 License plates

1 Black Isotoner leather gloves

3 EZ Passes (1 for window and 2 for license plates)

I am also collecting data, so please contact me at badrepo aol com if you are/were a victim of harassment, criminal activity, and/ or trespassing in the process of a repossession agent obtaining your vehicle. Please include your best contact info (email preferred) and as much details you can remember to include all businesses and financing companies involved.

I plan to create a comprehensive report and will be more than willing to share details of my findings.

The company has the right to come and get your car when you don't pay for it. If you blocked the car in to deter a repo man from being able to get it then that is not a violation of his but yours. Not advising you did this, but when the repo man came to your house you should have surrendered the car and the agent would have let you remove your things before he left. You put this man in a position where he had to find a way to get your car out. I dont think its fair to call this a ripoff as you had to have not made any payments for 90+ days to be assigned out for repo. You cannot just tell the repo man to leave, he just like the rest of us has a job to do. If you would have made payments on time you wouldn't have been put into this situation in the first place.

So this guy doesn't pay his bills, asks his sister to cover for him while he cowers inside his home. And now he's upset and wants his car trinkets back. Give me a break. People are expected to pay for their cars and if they don't someone looks for them. If you can't pay; man up, give the driver the keys and call it quits. People have to pay bills, when they don't, banks lose money and paying customer's end up paying more or worse; Banks don't exist. Then he called the police. haha, the driver had already cotacted them buddy, they knew where he was. haha.

This is to the 2 very long and winded rebuttals before me: If you take time to actually read the complaint, you would note the fact that a type-a personality repo man went overboard. I think you contribute nothing when you leave such assinine comments like "pay your bills". Have a brain and post something with intelligence. Better still, read the d**n complaint before commenting. To the OP, you have a case. Look up the peace laws in your region and take Capital One to court for violating your rights. Repo folk are not allowed to disturb the peace which is what they did in this instance. Your witness should also help you out on this one. Repo people get paid to tow and some of them are overzealous. Id imagine this freak of a repo agent traveled far or was bound/determined to get the car. He probably wasnt thinking straight and for that he should pay. Your rights were violated.

If they are doing a repo on your vehicle, youre grossly overdue on your payments. They loaned you money to get the car - time to pay up. Only person you are hurting is yourself...and your credit.
