I understand you find these calls harrassing but unfortunately under FDCPA guidelines COAF can technically call you 15 times a day Mon-Sun from 8am-9pm in your timezone. Not all of the collections departments use the automatic dialer(which is what we call it) I hand dial every number up to 15 times a day and work on average 50 accounts a day. We do have the option of stopping the phone calls but as they say, you scratch my back I'll scratch yours and set up a legitimate payment plan we can cement in our systems, such as our Fresh Start Package. Look into it! You might find out we are more willing to work with you than you think :-D

Look what laws are being broken. First Capital One is not subject to the FDCPA as is no orgianal creditor. That applies to collection agencies. Second they have every right to call you between the hours of 8am and 9pm as does any creditor. Yes you had a unfortunate situation and you are trying to pay your bill however creditors here this everyday and yes they use a robocall system as does every major creditor as well as cable companies phone companies etc etc etc. They just want what you agreed to pay them. Everybody thinks that these caompanies are relentless well they took a chance on you and right now you are not keeping your end of the contract

Who are you more likely to pay first? The people who annoy the ever living crap out of you? Or the ones who never call? I know I personally would pay the one annoying me. I also know that last month when I couldn't pay one of my bills, and I had work, I went to get a pay day advance. That was the ONLY time I have done one and will be the only time I do one. It cost me $166 to get $150. That was so my payment wasn't late ($16 to borrow is better than $35 for a late fee in my book). Just food for thought in the future.
