By the time I wrote this letter to Berkshire and posted it on Ripp-Off Report, I had a large file of paperwork. The most important was my requests for copies of receipts, bills, statements, bill of sale etc. showing proof of debt that they claimed I owed. 5 or 6 of those letters had been sent over the years. I copied my entire file and sent it to the Tennessee Division of Consumer Affairs and requested their assistance. Vanderbilt's home office is in Tennessee. Their response was:
Dear Mr. Groom,
Please except is as response to Mr. and Mrs. Cushing's complaint. The issue appears to be that the Cushing's are requesting a complete break down of the deficiency balance on their account.
This is a loan that has been acquired by Vanderbilt Mortgage and Finance, Inc., from Oakwood Acceptance Corp., L. L.C. After an extensive search, we were unable to locate the documents that would support the current deficiency of $10,387.17.
Therefore, our resolution to this matter is to waive the current deficiency in its entirety and report this as a Paid in Full/Repossession. We have already requested the update to the credit bureau agencies and they should reflect the new status of the account within the next six weeks.

Georgianna, Did you get a response from the letter you wrote... I haven't been contacted since I told them that the attorney general for the state of TN told me they no long have a business license and if they are trying to collect a debt representing Oakwood, it is illegal. Because Oakwood filed bankrupt and they no long are a company... yet I see dealers in the next city operating under the name Oakwood Mobile Homes... what is up with that... well, if they don't bother me... I won't bother them... they have already destroyed my credit... and my husband says don't going kicking a bee's nest...
