Im writing in because I just recently heard a story from a person I met. The nicest guy I met and I HAD to write about it because it was horrifically appalling! So this young man Michael tells me about an incident which took place in Scottsdale on the night of 5/28/2012. He was driving in Scottsdale on Indian school road when an officer known as Anthony Cappucci pulled him over for no apparent reason. He had been obeying ALL driving/traffic laws. The officer began to ask him if he knew why he had pulled him over and if he was drinking. He told him he was swaying in and out of his lane "drifting" and that he wasn't driving straight within his lane.

Officer Anthony Cappucci then asked him to step out of the car. Michael told him he was the designated driver and then the officer wanted him to perform monkey tests (walking, staring at pen's, alphabets, etc). He refused to do them so the Officer Anthony Cappucci hand cuffed him and arrested him for no apparent reason as well as impounded his vehicle.

As they were performing an "inventory" check on his vehicle, they came across his pistol under his seat. Officer Anthony Cappucci then asked him why he didn't tell him he had a pistol in his car, and he told him, because you never asked me. Officer Anthony Cappucci then added a charge of "Deadly weapon/Failure to Admit" to his ticket. Michael then asked him why wouldn't he admit to having a pistol in his vehicle if he had asked? In the state of Arizona, you are only required to tell an officer you have a weapon when it is asked. He tried explaining to the officer that he was a Federally Licensed Firearms dealer and that he sold firearms to police officers as well as military personnel. He was familiar with gun laws. Officer Anthony Cappucci  then said with a cocky,  unstable/volatile attitude, "boy you're lucky I didn't see that, ohhh I was in Iraq, you would have been in trouble!", Im assuming he was referring to his combat flash backs.  Michael told me that attempting to explain anything further didnt matter to Officer Anthony Cappucci, and that he continued to brag on how he has over 1000 DUI's in pocket and was very proud. It sounds to me like he was hoping to increase his personal DUI record.

I can see how Officer Anthony Cappucci has accomplished such a high score card. I guess it's more of a competition in the Scottsdale Police department.  He utterly lied on his report to make him sound like a swaying slurring armed drunk.  

Anthony Cappucci enjoys ruining people's lives with lies and competing for score cards. Michael had never been in trouble with the law until this encounter with Officer Anthony Cappucci, and quite the opposite. You will find police officers in his small store/shop bringing him there Glock's for maintenance or cleaning and purchasing boots for duty. Something needs to be done to prevent Officer Anthony Cappucci from falsely arresting and destroying people's lives.  

Please let me know if anything can be done or if you can help him somehow. I dont know what else Michael can really do.  People like Officer Anthony Cappucci give ALL police departments a bad name. He needs to undergo a psychiatric evaluation before he really hurts someone if he wasnt all ready.  Im a BIG fan of Ripoffreport.com and I know if something can be done, you guys would know how to get it done!  Thank you so much for your help. I ran across the complaint filed against Officer Cappucci in 2012 three years after it was written.  A sense of deja vu pervaded me as I recall my own experience with this officer in late 2010. Same MO.  It was abusive policing in a DUI witch hunt that goes on all too often with this guy and, apparently, condoned by the municipality. 

I'm all for getting drunks off the road.  The methods used by Cappucci are flat out wrong and, my guess, rooted in part to his stint as a military police officer.  The heavy handed methods can only be rooted out when police cameras are required, particularly for officers like this one. 

In the meantime, I encourage anyone pulled over by Cappucci to have your iPhone ready to roll so that his fabrications of what took place are countered with objective evidence.  In the meantime, it would be really great if somehow all those who have been abused by this guy's authority would be able to bring the allegations to the attention of the City of Scottsdale. My guess is they are like me, afraid of retribution by the authorities. 

Unfortunately, all I'm left with is a sense of police state in Scottsdale that has removed any sense of appreciation for what I thought was a job to serve and protect.

So what is Scottsdale going to do when the Supreme Court rules that the lab results cannot and should not have been used in all those DUI cases?

So it appears the county judge has brought the truth out about Scottsdale's blood lab.

To sum it up, the truth has come out. I wonder how many innocent people were convicted, put in jail, paid attorneys, etc since they have been using this known to be faulty equipment. 

I smell a class action suit coming. Plus all blood reading related DUI's that went thru this equipment to be expunged. 

Hopefully, the innocent people see justice and are fully reimbursed and compensated due to Scottsdale using known to be faulty equipment.  

God Bless the wrongly convicted...

A. Merry Christmas to you. Has nothing to do with it. The officer LIED in order to add another firearm to the department’s collection. This person  is a Federal Licensed Firearms dealer. Try reading. Gee, let me lie to the cop so that he can keep my firearms when I sell them to the department. 2 + 2 = 4 by the way.

b. Incorrect. Michael was allegedly charged under falsified documentation until the blood came back. Guess what, read a book. The Scottsdale department is under extreme scrutiny for their illegal improper use of a BAD MACHINE!! Guess what’s going to happen to Cappucci or Scottsdale? NOTHING!! Their criminals and they get away with it! Thank fully this should clear 1’000s of illegally charged people that spent a lot of money, time, and nonsense due to their false practices. They need to all ban together and slap Scottsdale PD with a class action law suit.

c. Again, using illegal machines to condemn good people and breaking the law to do it. The biggest scam I have ever seen in a city. Unbelievable.  Easy to get 1000 DUIs when your lying on the police reports and using known bad machines.

d. Stop defending your buddy Cappucci. That jerk is well known in Scottsdale for his DUI contest he has going. Fortunately good lawyers and people are fighting for rights. It’s only a matter of time till he gets busted for illegally falsifying reports for over time cash and confiscating firearms illegally. Only in Scottsdale. BLOWS my mind. Try reading, it does a brain good.

Not too long ago my sister was dating this poor excuse for a man Anthony Cappucci of the Scottsdale Police Department. Over a 3 month period Anthony Cappucci injured my sister with bruises so bad she needed to treated by a doctor. She even has a permanent scar.

Besides psychically  abusing my sister, he abused her mentally. He is a control freak and caused my sister to lose her job because she did not want to date him any longer. He is not stalking her.

Because he is a Scottsdale cop, the police will not do anything.My sister went to the Scottsdale Police department. They insisted on not taking a report, and said someone would contact her back. This was 7 months ago and to this date, no one has called. I even went down to the main headquarters 5 times and they keep telling me someone would be in contact with us after making me wait over an hour each time.

On several occasions we had dinner together with family. Every time we meet, my experience with him got worse. I am Puerto Rican. I was adopted at the age of 2 as my parents were killed in a car accident. Once Anthony Cappucci found out about my Spanish heritage, things got worse for me and even my my sister. He accused her of being a wetback and called her a d**n liar, slapping her to the ground and needed medical assistance. He was mad because she did not tell him I was Spanish. He did not  believe her saying that she must be a mut of some kind and not white.

I was perplexed at his strong attitude and prejudice. Before Anthony Cappucci found out about me, I had already realized he has a strong hate for anyone that is not white. He hates with a pation African Americans and Spanish people. He brags on how he knowingly killed inocent civilians in Iraq calling them sand (with the N word!).

He brags, let me quote him, "I love my power as a police officer, crusin the streets and charging people with crimes I know they deserve". So I asked Anthony Cappucci "are those you charge really guilty?" He responds telling us that, "It makes no difference, I know what I know - even if I have no proof, I will make sure the charge sticks to get them into the system".  - "It's my word against theirs" I again asked Anthony Cappucci what does that mean exactly, again I asked, are they really guilty when you charge the people that you do? he responded, again, "it makes no difference".

From what we understand from one police officer, they are pretty sure Anthony Cappucci has complaints by others in his file. My sister may hire an attorney to press charges against Anthony Cappucci and will request a copy of his file.

A.  Not a wimp that has to go find the police.  I love that Arizona is a Constitutional Carry state and has  the most lenient gun laws in the country.  The only rule is that when you are pulled over or directly approached by Police, you must let them know you are carrying.
I love that I have the right to protect myself and family.

B.  An easy search of the police bookings for the night in question revealed that a Michael was booked and charged with DUI, verified at being over the legal limit.  So I guess the officer must have seen a reason to pull him over.

C.  Thank heavens the officer was doing his job well, got this drunk driver off the road before he killed somebody.  Trust me working in Emergency and having to tell parents that because of a drunk driver they no longer have any children is a horrible feeling.

D.  My original reason for the post was to wonder why someone would be so vindictive as to try and malign a reputation from a story by a friend.  Let the friend post his own story.  Back it up with the facts, not heresay.

Hey, yeah, speaking that Insane-o Power-tripping cops are all too common (daily occurrence), let's all just swear allegiance and do everything we're told to do. These are good people, right?

Never mind our Constitution, just report to the police always. If I have a gun, let me be a smart (stupid, ignorant) citizen and go tell the nearest cop that I'm armed as this is required by statute- not an actual law. I think the 5th amendment is bad because we should always be subject to police interrogation because that's what keeps us safe, right- more cops?

Yeah, let's be subject to blood tests and sobriety tests at any time to keep the roads safer. They're always nice & polite when they take you to jail for not having a license (Oh, shoot, I should have known better! Guess I get what I deserve!).

AMERICA IS DOWN FOR THE COUNT!

THIS IS A POLICE STATE!

Now in America, just go cruising down the streets. You'll see 2,3,5, maybe 10 cars being pulled over, MAULED by the government. Tickets, citations, court dates, AND I'M SUPPOSED TO GO ALONG WITH THIS, RECITING THAT I AM FREE??

You should be a wimp and trust the police. They're gonna do what's best for your rights in AmeriKa.

Its frustrating to see someone trying to ruin a reputation.
You have posted this as a story from a person you met.  You don't know the whole details of the situation, only one side of it.
In Arizona, you are required to immediately notify an officer if you have a weapon.  That is the law either if you are pulled over, or approached by Law Enforcement.
Many times people who are intoxicated feel that they are not impaired and are unaware that they are all over the road.  So if the officer feels that it was in the interest of safety to other drivers to pull this person over and verify sobriety or not, I'd trust him.
And by refusing to submit to the so-called "monkey tests," your friend should have expected a trip to the station.
From your post it is obvious that your friend should have done several things differently.

Now just so you know, I do not know Officer Cappucci, nor am I associated with Law Enforcement.  I work in an Emergency Department and see drunk drivers all the time.  I just had to provide a rebuttal to this post because it upset me to think that you would so readily try to ruin a reputation when your friend Michael appears to be in the wrong.
