Judge rules in suit over Web site billing

Hundreds of people in Missouri, Illinois and elsewhere got billed for connections to pornographic Web sites they never requested. Now a federal judge has ruled that those people don't have to pay - or can get refunds.

In May, the Federal Trade Commission and the attorneys general in Illinois, Missouri and 11 other states sued Alyon Technologies Inc. of Secaucus, N.J., and Telcollect Inc. of Norcross, Ga., accusing them of billing for unordered services, refusing to cancel bills and threatening to turn the accounts over to collection agencies.

FTC investigators found that the companies were using a modem dialing program to disconnect consumers from their own Internet service providers and reconnect them to Alyon's network, without permission.

U.S. District Judge R.W. Story in Atlanta ordered the companies to pay restitution and to stop collecting on overdue bills.

which basically means that they negotiated an agreement by which they must process refunds to some people who paid them, they will be monitored for compliance (The FTC can "pose" as customers of Alyon, to see if they are complying, and much more was agreed to by Alyon in the consent order.). Compliance will be tracked.

IF ALYON doesn't comply, they can be taken back to Court. THe lawsuit is still alive, except that Alyon has AGREED to A CONSENT ORDER to avoid a WORSE FATE.

EVERYONE needs to go read the actual order, it is quite interesting, Alyon has agreed to quit practices which consumers complained about and an Arbiter has been assigned to overssee that Alyon does what they agreed to.

On July 10, 2003, Judge Richard W. Story filed his order. Here is a link directly to the actual court document:

Ah, Peter you Alyon employee you. That "confirmed source" you mentioned is Alyons public relations firm, their press release is baloney. The judge denied The FTC request for a preliminary injunction because it was a MOOT issue. Note the word "MOOT" , it is all over the judge's decision. It means that Alyon caved and gave The FTC almost everything they wanted. Alyon's spin doctors are trying hard to provide a victory out of a total loss. Won't work. I cannot hardly wait until the trials start. PS. IF ALYON SENDS A BOGUS BILL OR A THREAT OF COLLECTION TO ANYONE, JUST FORWARD IT TO THE FTC FOR INVESTIGATION. Peter, your Yahoo article reads like more Alyon propaganda. Alyon may ATTEMPT to collect debts through a dispute process involving both Alyon AND the FTC...Ha,ha. I wish 'em luck! The very fact that Alyon is constrained by a dispute process tells me that Judge Story found reasonable cause to believe that there was something fishy going on.

You moles just keep coming, don't cha'? Give it up; Alyon is DEAD!

Don't believe everything the federal government tells you. The FTC made their press release misleading on purpose. There are already several confirmed sources that state that the Judge threw out all FTC allegations and allows Alyon to collect all pending debts.
