We were ripped-off by a bad transmission repair shop called All Trans Parts, Inc.(1333 N. 21st Ave. Phoenix, AZ 85009(602)233-3835) They charged us $1,179.11 for a remanufactured transmission that was not done right. They refused to fix it right despite our bringing it back to them more than once while it was under warranty.

When the shifting problem got so bad that we could no longer drive the vehicle, we asked them to stand behind their work. They told us to take a hike; that the warranty had expired. We had to pay a more reputable shop to rebuild the transmission again. We had no other recourse but to sue All Trans Parts, Inc. in West Phoenix Justice Court, Small Claims Division.

They wouldn't even tell us who the owner was on the phone, so we had to call the Arizona Corporation Commission to find out who to serve the paper to. We were not surprised when we found out that All Trans Parts, Inc. had their status as a corporation revoked in August 1980 for failure to maintain a statutory agent. When I called the BBB in February, I was told they were not a member and had one unresolved complaint. When I checked back in early March to find out about that complaint, I was told they were a member and in good standing. I don't know what to believe. I filed a complaint against them with the BBB. We also filed a complaint with the Arizona Attorney General's office of consumer fraud.

All Trans Parts, Inc. responded to our small-claims summons by requesting the case be transferred to the civil court division and hired one of the largest and well-known law firms in Phoenix, Lewis and Roca, to defend them from a $1,200 small claims suit!!

Now, they are trying to scare and intimidate us into giving up. We are scratching our heads trying to figure out what the purpose of Small Claims Court is if the defendant can demand to have the case transferred so he can have an attorney, which we cannot afford. It doesn't seem right, does it?

We would appreciate any help you might provide. We just want our money refunded for the shoddy transmission work.
