LETTER TO ABODE CEO LOUIS CHICOINE RE: LANDLORD ALFIO JOHN RAGONESI

Mr. Chicoine,

On September 26, 2019, I had told the landlord, John Alfio Ragonesi, via text that I was planning on lettering a 30-day notice and if he could assist me with a portion of my deposit so that I could begin packing my property. 

Given that I have renters insurance for property damage, I offered to pay it back once I got paid the following week. I never gave the landlord any reason to think that I was irresponsible. Furthermore, it had been understood that I pay close attention to detail.

The landlord had recommended I hold off writing the 30-day notice, and he would do his best to advocate for me. He knew people at Abode. I acknowledged that he was presumably the most qualified person to support me.

On approximately the third week of October, Alfio Ragonesi ordered me to write him an affidavit swearing I had given him my 30-day notice on September 26 via text message. 

Due to the landlord's tone, I questioned the landlord's intentions because he was forcing me to sign statements without any other witnesses present. 

Moreover, the landlord continued to pressure me into vacating the unit within hours as he ordered me to overnight my responses via certified mail concurrently.

I responded that I could not write any statements under pressure. Can the landlord claim I was negligent in not providing him a 30-day written notice? 

Would it be reasonable for the landlord to ask me to hold off on a 30-day notice for three weeks and then compelled me to write statements to favor him in an eviction?  

Since my case-manager from HomeFirst always addressed the lack of funding or grants for supportive housing, I had made the mistake of telling my landlord that I had been writing to several government agencies, such as US HUD Secretary Ben Carson and California Congressman Devin Nunes reporting on the housing crisis in Santa Clara County.

Although never implied, I knew that both the landlord and HomeFirst had seen my signed photos ( with my name) from our current administration when coming to the apartment. Still, I did my best to inform my case-managers and my landlord that I would be the best candidate to address the need for more assistance from the Federal Government.  

This can only be my single explanation as to why I never received any acknowledgments or credible responses. The only solution I am ever provided is that there is no funding for supportive housing, which furnishes with further incentive to address homelessness and the housing crisis in Santa Clara County. 

And since the landlord's conduct was unreasonable and was not willing to provide me with any answers to my own concerns or receipts, I had asked myself if perhaps my landlord was striving to prevent audits or inquiries into his past rental history and building inspections. 

My therapy reports specify that under times of extreme hardships I am resilient and write to government agencies as a coping method due to the lack of friendships and familial status. Furthermore, I was a bit shocked as to why my landlord had behaved in such a manner when mentioning writing to government agencies in good-faith. I found the following on your website:

* Free assistance finding and screening tenants who seek long-term, stable housing.

* Higher security deposits that meet landlords’ needs.

* Free inspections to keep units up-to-date with Housing Quality Standards.

* Financial coverage for vacancy loss between tenants. (Subject to county-specific funding)

* Bonuses for signing on and continuing participation. (Subject to county-specific funding)

* An opportunity to use their properties and investment to make financial returns and a positive, lasting impact on the lives of our vulnerable neighbors.

Mr. Chicoine, as an Abode Partner, would it be reasonable for the landlord, John Alfio Ragonesi, to ask me to hold off on a 30-day notice for three weeks and then compelled me to write statements to favor him in eviction to maintain a good reputation? 

Other than withholding information from his attorney, how can my landlord reasonably attest that he did NOT seek to advocate for me to stay in the apartment which resulted in an eviction due to lack of grants or program funding?

The federal probe into Oportun Inc. starts as President Joe Biden's administration is picking his team at the bureau in hopes of more enforcement activity.

Oportun Financial Corp. unit Oportun Inc. received a civil investigative demand from the Consumer Financial Protection Bureau requesting information on the company's legal collection practices from 2019 to 2021 and hardship treatments offered during the COVID-19 pandemic. The demand aims to determine whether the lending and debt-collection practices of small-dollar lenders or associated persons have not been in compliance with certain federal consumer protection laws, according to a filing. EMAIL TO HOMEFIRST SERVICES OF SANTA CLARA COUNTY JANUARY 1, 2020: 

 

Is there an immigrant community at any of the shelters? 

 

I had noticed that there were Workshops for Green Cards and Citizenship as well as Community Resources targeted to Non-Citizens on the Community Board at HomeFirst. 

 

I have some concerns since I had to leave my previous place of employment due to an increase in warnings of ICE raids by “Word of Mouth” (OR THE DISTRIBUTED FLYER INSIDE THE SHOPPING CENTER). 

 

Reported were people staying home out of fear of being detained or being harassed: depression, anxiety, social anxiety, and agoraphobia (not wanting to leave the house), negative thoughts, paranoia, and psychosis.

 

When I observed that these Federal agents entering the workplace could be armed to conduct collateral arrests or "community or at- large arrests," I too felt my place of work was no longer safe to work. 

 

My CBP therapy with my Mental Health Therapist with Family and Children Services had been supporting me with the signs that identify with Cumulative Trauma for the last two years. 

 

I just received my Mental Health case-file from my therapist to provide evidence that I was making progress until mid-November 2019.

 

Being out socially and at different events, shopping centers, or parking lots tend to trigger my anxiety and have difficulty coping with psychological stressors since. 

 

The combination of being (CONSTRUCTIVELY) EVICTED ( LIKE A HOME INVASION), invading my personal space, and having my property suddenly taken from me, is NO DIFFERENT than Federal Agents agents entering the workforce to seize electronic equipment and personal property and not return it.

This information was given to me by my landlord back when I had felt he was the most qualified person to advocate for me (SEE IMAGES).  

I began to express my own concerns about the services provided by HOMEFIRST SERVICES OF SANTA CLARA COUNTY. Documentation for Grants and Program funding was redirected to pay the employees' salaries rather than to provide financial assistance to program participants who are both gravely disabled and in critical need of Permanent Supportive Housing.

I suffer from generalized anxiety, and the landlord knows this. I am trying to find new housing, but settling outside of court should not be an incentive for the landlord to continue to harass me by using pretexts and false accusations.    

I have asked him several times to respect my privacy so that I can move on from what happened.      The landlord said that he has three weeks of complaints about me from other tenants and will turn it over to his attorney. I want to know who it is and what was said. That is fair.  

  I explained to the Landlord that I understand the concept of Triangulation in psychology which is a manipulation tactic where one person (e.g.LANDLORD) with not communicate directly with another person (ME), instead using a third person (OTHER TENANTS, CASE-MANAGERS OR THE LANDLORDS ATTORNEY) to relay communication to the second (ME), thus FORMING A TRIANGLE, all which I learned from my therapy discussions. In order to harass or retaliate against me for filing complaints with GOVERNMENT AGENCIES me indirectly.

 

The tenant to my right in Unit 5, has not been home in weeks because he is in and out of programs for treatment. We rarely speak, unless he knocks on my door and needs to know if I have spare change for alcohol.

 

Unit 1 is to my left, is two floors, is a Mexican Family, and the second floor is connected only by closet space, and Unit 1 faces the front of the apartment complex.

 

The only time I have had conversations with them was when I had found they had possession of my AMAZON DELIVERIES. This may have happened once or twice until I decided it was best to have my deliveries sent to a safe locker provided by Amazon.

 

I have never received any complaints from them; moreover, the only time I can hear the tenants in unit 1 speaking is when the tenants smoke marijuana on the balcony next to my window, yet I have never made a complaint. However, I ASSUME DRUGS ARE NOT ALLOWED.

 

I presume that SMOKING MARIJUANA is not permitted even if it is for "MEDICINAL PURPOSES," since it is also a FIRE RISK, and there are very young children in that unit. 

  The tenant in two below me is an older man who has "SPECIAL-NEEDS or SELF-MEDICATES” ( as I have been told), and scrapes the walls in circular motions and hits the ceiling with extreme force.      The tenant in two did this to other tenants too. I don’t think it's a good idea to bring this up to him because he could have a weapon on hand or could be engaged illegal behaviors that I don’t want to get involved with.     I want the landlord to stop harassing me in one way or another as I mentioned to him," I feel he is just trying to waste a disabled tenant's time and resources.” If this continues to happen, what are my options?   The Landlord keeps Texting me with my full name as ”ADRIAN QURIETE” ( WHEN SAYING I AM DEFLECTING THE CONVERSATION!) is this OK? The landlord is making NEW allegations about me but after two years he does not even know the spelling of my last name?

The landlord called me on the morning of December 24, 2019 (Christmas Eve), while I was at the Post Office, mailing some Records and Personal documents for safekeeping.    

I had been clear with the landlord that I may not be home since he had previously intimidated me by stating that he had the key to my apartment, and he could enter the unit to show it to a future tenant, whether or not I was home. With no other choice, I told the landlord it was okay; my only request was that he informed me when he arrived and left and not to forget to lock the door on the way out.    

When the landlord and I spoke via telephone, he began to mention specific characteristics about me because he had the wrong key.  Although I suffer from generalized anxiety, sleep apnea, and narcolepsy, the landlord previously threatened to lock me out of the apartment and change the locks.    

One way or another, we got off-topic, and I had said to him that we both had agreed that I had until February 10, 2020, according to the Stipulated Judgement. For one reason or another, he seemed confused or in shock as if his attorney had never given him that information. Perhaps because the landlord was with the new tenant and he had told him differently, I do not know.    

The landlord has been shifting the conversation and began to intimidate me again by saying he had received complaints about me for three weeks now that he turned it into his attorney, and he is taking care of it.

Three weeks ago was December 5, 2019, and I have no clue what complaints the landlord is alleging. The landlord and I have not conversed, either by telephone or text since the first week of November.     The landlord had always said I was a good tenant, so this comes off as yet another of his tactics to not keep his word and save money.     

The landlord declares I am causing him " undue stress and causing potential long term problems with his unit and building."      For this reason, I do not want the landlord to contact me or make any attempts to manufacture false evidence at my expense.     Other tenants have already told me that he is going around, saying that I am causing him lots of problems. The landlord did the same with me to get other tenants evicted.     

My only "wrong-doing" is that I could not afford to pay SIX-TIMES my standard rent subsidy of Three-Hundred and Fifty Two Dollars.     

If the landlord is alleging that he has complaints about me, I want to know who it is and what was said about me. They say they can't fix the problem unless you tell them about it. This gives me no incentive to speak to the Landlord without a third party involved.

I genuinely believe that I am have been discriminated based on both my disability and conservative political beliefs. This can only be my single explanation as to why I have never received any acknowledgments or credible responses to my grievances. 

It was never explained the Rapid re-housing program is an intervention designed to help individuals and families that don't need intensive and ongoing supports to exit homelessness and return to permanent housing quickly. I do not fit these criteria.  

It is notoriously difficult to get disability status. It took nearly 727 days to be told that I will be “GRADUATING” the Rapid Re-Housing Program. All I can get is an apology from the program providing the subsidized payments that I was not given the correct information starting the program. 

I had Twenty One Months to prepare for the unexpected or at the very least look into other resources to ask for help from other agencies before I was given this information. No one to hold accountable.

The only response I am have ever been provided is that there is “NO FUNDING FOR SUPPORTIVE HOUSING”, which furnishes with further incentive to address Homelessness and the Housing Crisis in Santa Clara County. 

I am left without any promised vehicle repairs, loss of independent stable housing, loss of mental health services; I am also facing the consequences of having an eviction on record for the next seven years due to the lack of information given to me by community agencies.

Due to the spread of misinformation, DEMOCRATS are more united and harbor hatred for the President and his supporters more than ever.

As a single individual enduring prejudice and isolation residing in a city where DEMOCRATS are a majority, one cannot help but look to the REPUBLICAN Parties' Agenda for support (e.g., U.S HUD Secretary Ben Carson, a former Neurosurgeon, who identifies as REPUBLICAN).

Although I cannot afford a market-rate apartment, feeling a lack of support I would read case-managers letters I had written to Government agencies in the event they had felt "TRIVIAL" as to whether it was worth their effort to assist me with maintaining Permanent Supportive Housing. 

My grievances against Santa Clara County Agencies are:

 

  • All too often, poorly managed SHARED SERVICE migrations — or uncoordinated actions — can lead to miscommunications with clients, lengthening the time it takes to deliver a service and consequently creating failure demand (demand caused by a failure to do something or do something right for a client).”

 

  • Maintaining thorough, accurate records of case management activities with every program participant is a requirement of grant contracts. 

 

  • This is the first time I have ever been aware that Organizations Grants and Contracts are subject to inspection and audit by the funding governmental agency.

 

  • The purpose of such audits is to determine whether program funds were used in accordance with their respective guidelines and regulations.

 

  • Even if management believed that program funds had been utilized in accordance with program guidelines, it is possible that funded program costs could ultimately be disallowed.

 

  • This gives RRH program participants the impression that grievances or complaints may be discarded as quickly as possible and further discourages a Client from seeking further assistance.

 

  • Qualifying for Permanent Supportive Housing is NOT based on a “First-Come, First-Served” approach. I have been told it was.

 

  • I have expressed to local agencies an eviction of a person with mental illness from subsidized housing is particularly devastating.

 

  • Loss of subsidized housing can have serious consequences for someone who suffers from multiple co-morbidities.

 

  • Instability, especially in housing, can be a major source of stress and can trigger or worsen a disabled tenant's mental illness and will lead to chronic homelessness or institutionalization that violates the integration mandate of the ADA. 

 

  • Evictions of those suffering from mental illness with safe and stable housing are recognized by federal housing laws, expediting evictions undermine this intended right, with disastrous results for this often fragile segment of society.

 

  • A Person with a Mental Disability Needs an Advocate in Order to Truly Have a Meaningful Opportunity to Present a Defense

 

  • Characteristics of impairment in cognitive functioning would greatly interfere with a tenant’s ability to represent themselves in court. 

 

  • There is no opportunity for persons with mental illness to raise meaningful defenses to eviction or termination proceedings.

 

  • Unrepresented, these tenants are placed at a severe disadvantage in the process. 

 

  • While housing court is often a stressful experience for pro se plaintiffs generally, it can be even more difficult for individuals with mental disabilities, particularly given the stigma of self-identifying.

 

  • People with mental health issues sometimes hide their mental disabilities because they have faced stigma and discrimination after past disclosures. 

 

  • People with mental illness report feelings of anxiety before and after disclosure, low self-esteem, and social isolation.

 

  • A legal situation that requires a person to openly discuss a mental health problem—such as disclosing a disability in order to raise an affirmative defense to eviction—can add more stress and discomfort to the process.

 

  • It is almost unfathomable that a severely mentally ill individual would be able to put forth a meaningful defense under these circumstances.

 

  • Relying upon the tenant’s ability to retain counsel or represent himself fails to consider the capacities and circumstances of tenants with mental disabilities in eviction cases.

 

  • Depriving the victim of evident and necessary consideration and then taking extraordinary measures to cover up wrongdoing.

 

  • Additionally, some individuals with mental illness may consider themselves significantly impaired in some circumstances, but not in a way that inheres to the idea of “Disability.”

The Tenant below me relocated to the unit under me because he had a problem with the noise from the tenant above him. It had been assumed the Tenant who is now below me was telling the truth, but it appears he was not.

The Tenant who was accused had recently asked me to bring this up to someone because he, himself, got a warning for being disruptive, and he was not taken into account since the noisy tenant has been a tenant much longer than he has. The Tenant who had been accused, complained that a "feather” could drop and the menacing tenant below would strike the walls.

When the tenant above had guests the tenant below would interrupt his visits. I brought this up to the landlord back when the new Tenant moved in, and he assured me that he had explained to the Tenant that the previous tenants (below me) never made a noise complaint about me.

The previous tenants were a Hispanic couple, and numerous I could hear them having intimate moments below me, and it was never an issue if I needed to turn up my volume or do chores. The Tenant below me is notably loud and tends to hit the wall with an object with extreme force.

When the Tenant is not beating the wall ( I recognize the distinction between tapping and beating), he uses an object to scrape the ceiling in circular motions all around the ceiling under me. He uses offensive and vulgar language, which I cannot understand.

The attacks by the Tenant are so intense; it makes it extremely difficult to clean my apartment, vacuum, wash dishes, throw out the trash, store property or do anything at all. At this point, it would be unreasonable to ask the Tenant to stop considering he could be mentally ill and have a weapon on hand. I don't want to intervene if he is engaged in any inappropriate activities, as others have told me.

Fact-checking on Electrical Saftey:

1. I moved into the unit on October 2, 2017. December 18, 2017, I had made my initial complaint to the landlord concerning electrical problems. 

2. All the lighting in the living room and bedroom burnt out simultaneously. I was concerned about the damage done to my other appliances and electronics. 

3. I have needed to purchase top-of-the-line surge protectors, a backup battery to charge small electronics and plugs with ENERGY MONITORING SOFTWARE from PG&E (PACIFIC GAS & ELECTRIC COMPANY).

4. March 24, 2018, I followed up with the landlord once again and responded that his contractor was busy all day. I had two miss two workdays and becoming a problem.

5. The landlord responded, If his contractor could not make it, the landlord offered to stop by. 

6. The landlord made minor repairs (which I took photos of) on his own; this, however, DID NOT FIX THE PROBLEM. On occasion, the outlets would continue to BUZZ or SPARK.

7. When [3] tenants SELF INSTALLED AC units( extension cords, etc.) I made further complaints on tripping circuit breakers, buzzing appliances, discolored, and warm outlets in my unit. The landlord disputed that it was the number of appliances I had plugged in. 

8. Fact-checking, I informed the landlord I was worried that a fire could happen. I sent him the image I have attached "How to plug in your air conditioner without dying in a fire." 

9. Since the air conditioners continued to be in use in other units, I had shut off and unplugged most of my devices to prevent further damage and would leave the unit for hours at a time due to the RISK OF FIRE.

10. When PG&E came to inspect the heater on August 28, 2019, I had asked him to take a look at the main outlet that was causing a "HUM" or "BUZZ."

11. PG&E determined that THE LANDLORD HAD LIED TO ME, and it was not the number of appliances in the unit or connected to the outlet.

12. To prove this, PG&E showed me that the prongs and plastic had melted (see image), and it was something that a LICENSED CONTRACTOR and not the landlord would need to repair. (see invoice)

13. The landlord has given me wrong information and has been negligent since the approximate date of December 18, 2017 (24 MONTHS), to avoid costly inspections and repairs.

1." Through the program, you've been offered support by your case-manager with employment options to increase your income.”  

A. My case-manager, Ryan Sanders, suggested that I seek employment to get off Social Security Disability Benefits. The loss of stable independent housing would result in even greater losses. 

B. I have mentioned to Ryan Sanders I have been determined to be at 53% Permanent Disability by a Licensed Doctor. I added that my Permanent Disability rating may have increased since my last assessment, February 2019. 

C. Instability, especially in housing, can be a major source of stress and can trigger or worsen a disabled tenant's mental illness and will lead to chronic homelessness, ignoring the superimposed difficulties due to the added loss of treatment or mental health services.

 

2."As well as support to identify from a housing specialist to identify and secure more affordable housing that may fit your long term stability plan." 

A. The number of times Ben Muniz and I met, Mr. Muniz had acted under the idea that I was a new client and would continue to get financial assistance for one year. The information Ben gave me had been verbal.

B. I made sure to tell ben the date my lease started October 2, 2017. If I were to be given the incorrect information by the Housing Specialist, this would create significant setbacks.

C. Ben gave me a total of two listings. I drove to both listings in Campbell the next day.

D. Ben himself showed me on his computer that he was having a very difficult time finding landlords who accept "vouchers" because they have a terrible reputation.

E. Ben continued to imply that I would receive financial assistance for 12 additional months.

F. I spoke with my case-manager, Marlene Ruelas, and suggested Ben Muniz, the Housing Specialist, may have provided me with the wrong information. 

G. After that conversation, communication with Ben Muniz ended.

H. Marlene Ruelas is no longer a HomeFirst employee. 

I. Before separating, Marlene Ruelas told me she had approved me for another subsidy, and she did not, however, inform me that 24 months is the maximum term for the Rapid Re-Housing Program.

 

3. " The resources were also provided to you by mail to the address XXX X XXX XXXXXX XXX XX. San Jose CA XXXXX on October 8th, 2019.”

A. This is the incorrect mailing address.

B. My case-manager, Ryan Sanders, asked me for my mailing address (P.O Box) on August 15, 2019. 

C. I do not understand why my case-manager would send needed resources to the incorrect mailing address. 

D. I did not receive the needed resources Ryan Sanders sent to the wrong address on October 8th, 2019 until the approximate date of November 6, 2019, which had been rerouted to my correct mailing address. 

E. By this date, I had already received pay or quit notice from my landlord.

A. On the approximate date of September 5, 2019, Ryan Sanders told me that we would have OUR LAST case-management meeting before exiting the RRH program. 

B. The purpose of the visit to my apartment was to follow up on a HUD mandated inspection

C. Ryan Sanders waited for The Health Trust inspectors to leave to give me this information. Ryan Sanders denies having this conversation.

D. I felt moderately perplexed why I was being dropped from the RRH program on such short notice. 

E. I immediately reported to my therapist at Family Children Services and my care team at Sutter Health.

F. My therapist at Family and Children Services of Silicon Valley understood dropping a client from case-management was against HomeFirsts philosophy. My therapist added that she would be giving him a call.

G. My care-team from Sutter Health was concerned that leaving life-sustaining medical equipment unattended in a vehicle could be subject, vehicle vandalism, and property theft. 

H. I was further informed there had been an increase in the theft of CPAP machines because they resemble a laptop case.

I. My Primary care doctor prescribed me an inhaler to deal with chest pains, difficulty breathing and in the event, I could not use my CPAP machine in the event of an emergency.

J. It was my FCS therapist and Sutter Health care team that had encouraged me to meet with Ryan Sanders. Dropping a client on such short notice was both unprofessional and dangerous to a person suffering from multiple co-morbidities.

K. I have not been allowed to raise meaningful defenses in respects RRH Program or an expedited eviction process.

L. I have reported both stress and fear before and after these disclosures.

M. Life and safety issues were not dealt with in the most professional or expeditious manner.

N. There was no response to landlords harassing behavior. It was further suggested I contact a non-profit agency for legal services. 

O. The grievance procedure has been misleading as it implied that program participants must first go through HomeFirsts complaint process before filing a complaint with any outside entity.

P. There is a lack of transparency in the grievance process.

Q. There is no grievance procedure designed to respond to program participants' concerns and complaints in a timely and appropriate manner.

R. I had not been allowed adequate time to escalate the complaint or appeal to a management representative that was not involved in Mr. Juan Guel's JRs (Office of Supportive Housing Contract Manager) original decision.

S. From an outsider's perspective this would resemble an agreement between two or more parties to deprive a third party of legal rights or to obtain an unconstitutional objective. This may or may not be illegal but it is fundamentally dishonest.

  • The landlord compelled me to write statements via phone calls and texts to benefit the landlord while intentionally wasting a disabled tenants' resources and time to win an eviction lawsuit in order to maintain a good reputation within the organization paying him subsidized payments. During a State of Emergency.

 

  • I had asked the Landlord over the course of two years to inspect the electrical wiring in the unit, fix the windows, replace the lock on the rear door because it was both dangerous and damaged my electronics. 

 

  • I had mentioned to my landlord on several occasions that just because I had renters insurance, it was not a good enough reason to ignore the problems and assume that my renters' insurance policy would cover property or premises in the event it was damaged.

 

  • During a State of Emergency, if each instance (even when driving) I was threatened, pressured or compelled to write statements, each time I was harassed by asking if I was going to pay or vacate the premises immediately, how many landlord violations would that be? 

 

 

  • I had already begun to transfer my property to a storage unit, to prevent my landlord from expediting an unlawful eviction and use law enforcement under the guise that I was intentionally unwilling to pay or leave the premises. 

 

  • Should I have rented from my current landlord without a third party, my current situation could have been much worse.

 

  • My skepticisms are that if I had done exactly as the landlord had pressured me to do, I would not be able to provide a response or advocate for myself due to the lack of resources in such a short amount of time. 

 

 

  • In addition to restricted access and asthma attacks, I would not have electricity, internet access, my property, clothing, my computer, printer, paper, bathroom, running water, washer and dryer, kitchen, and a safe place to sleep or continue to use life-sustaining medical equipment; during a State of Emergency.

 

  • My landlord tried to bribe me/ or pay me off with my own rental deposit to leave quickly and quietly, as my landlord formulated it; it was a cheaper option than filing an eviction. “Cash for Keys”

 

  • The landlord did not disclose he could take unto three weeks to return my deposit.

 

  • My landlord gave statements this past week that I did not pick up the phone when he called ( To show other tenants the unit while I was home alone). This was false.

 

  • This reflects poorly on the landlord because he tried to persuade me to move out within three days' notice by using my deposit as leverage since he has other tenants who want to move into the unit. 

 

  • The landlord falsely alleged to other individuals that he tried to call me and I did not answer, raises some concerns that he could do the same and tell others I did not answer when returning my property or deposit. 

 

  • The landlord had previously held me accountable for my sink dripping water into the tenant below me, more so, that the water could cause an electrical malfunction and fire hazard. 

 

  • I had to tell the landlord several times that I had no excess water in the kitchen sink that could cause an electrical malfunction and put at risk the tenants below me until he decided to do repairs himself. *This proves that leaks are also in the garage ports when there is running water. 

 

  • I have always told my landlord that if he wished to dispute liabilities for repairs that needed to be done to the apartment, my renter's insurance would discuss the merits of his claims. 

 

  • Should I be asked why I was unable to pay my rent, my only breach was that I could not pay 2050.00 when I paid 352.00 only on 35 days' notice. 

 

  • Furthermore, why would my landlord ask me to reach out for Emergency Fund Relief to pay this month's rent when my landlord knew that I could only receive that assistance under the condition that I had planned to stay in the apartment. 

 

  • My landlord claims he advocated for me to stay in the apartment for “hours” in October only to not to receive a response, he had instructed me to tell Sacred Heart ( and the like) that I was going to stay in the apartment (lie) and I needed the check for 2050.00 issued to him while my voucher was in transfer. 

 

  • Since the Emergency Fund Relief interview was two hours by appointment, The Landlord then offered to take 68.33 per day ("a couple hundred dollars") from my 3,000.00 (3700.00) deposit. 

 

  • My landlord did not establish a time frame, but I had understood if the rent was 2050.00 for 30 days, I would be left with the remaining balance. 

 

  • Reviewing the contract, I found that the landlord cannot take from the deposit on a 24 months or month to month contract. "He was trying to be nice."

 

  • My landlord's proposal to withhold the deposit at 68.33 per day then dropped. It was not until 2-3 days before the end of the month, during the State of Emergency that there was absolutely nothing I could do to avoid an eviction. 

 

  • When putting into place the setbacks I had for three weeks due to the lack of communication, I may have had only two or three days during a State of Emergency to remove my self from the premises without an Exit Destination. 

 

  • Since three separate organizations are involved with this matter, the responses you may receive may be both erroneous or misconstrued. 

 

” Keep in mind, that the Landlord can do all of that which I have documented to past and future tenants.”

"HAZARD OR RISK?"

  • I told my landlord on several occasions that the electrical wiring in the unit was causing damage to my electronics most importantly that I had just purchased them. This began on December 18, 2017.

 

  • My landlord who has often asked me to bend the truth and finding ways to save money told me that it was the number of appliances I had that we're the problem.

 

  • I had responded to my landlord on a number of occasions that I was a single individual and that the other units were occupied by much larger households.

 

  • Electrical Problems, Self-installed Air Conditioners by other tenants [3], Extension Cords, Non-grounded 2-prong outlets, overheating outlets.

 

  • Never followed up on replacing windows that do not close with “Double Pane Windows.” Never followed up to replace the lock on the rear door.

 

  • It was not until PG&E (Pacific Gas & Electric Company) came to do an inspection for the Thermostat on August 28, 2019, that I had asked him to take a look at the electric outlets.

 

  • For the past two years, my landlord had lied to me.  PG&E (Pacific Gas and Electric Company) left a note for my landlord to have his contractor check the wiring in all the units. Should my property been damaged, again no one to hold accountable?

 

  • Risk of fire, Shock, Electrocution, Damage to property, Personal injury, Death.

 

  • On one occasion (June 7, 2018), my landlord needed to turn on the furnace pilots so that he could pass inspection. Rather than going through his contractor( fees, scheduling), he had asked me to call PGE (Pacific Gas and Electric Company) and tell them “I smelled gas.” 

 

 

  • When PGE came, they had been extremely upset about calling in an Emergency. Furthermore, they asked me if I could let my landlord know that making a false PGE emergency appointment was using up their emergency resources, reserved precisely for emergencies. 

 

  • PGE also left my landlord a note stating that the landlord had asked for PGE to come to check for a gas leak to turn on the flame or pilot on the furnaces to pass an inspection. 

 

  • There had been some humor behind this because igniting a flame during a gas leak would cause an explosion. Again there was no one to hold accountable. 

 

  • The landlord has signs that warn individuals that the apartment complex is under surveillance by cameras. When I had brought this up to my landlord, I was told that there were no cameras.

 

  • I have had visitors looking for past tenants asking to buy drugs, solicit sex, use the bathroom; stolen amazon packages from my doorstep.

 

  • I was fully aware that the landlord was required to ensure that tenants felt safe in the complex, and I had to ask the landlord to take 700-800 out of my deposit to pay for my own cameras since I felt bringing this up to my landlord would result in negative feedback.

Hello Mr. Chicoine,

As a single adult suffering from cognitive and physical impairments, would this treatment be looked upon any different if it had been a family unit who may or may not speak English as their first language? 

I am providing the most recent correspondence I had sent electronically to The Health Trust and Home First. My landlord made the following statement to execute an unlawful detainer.

 

And since both my landlord's texts and complaint in the UD specifically identify September 26, 2019, as the date we had both been notified that I would be graduating the RRH program.

 

Furthermore, I did not put in my 30 days notice four days after receiving it. Mr. Chicoine, is four days reasonable for someone who is disabled to write a 30-day notice after 24 months without an exit destination in place?  

 

If you could, please do what you can to assist me to maintain stable or supportive housing. Furthermore, I cannot advocate how the program works on behalf of Abode, HomeFirst, and HealthTrust. 

 

This is crucial when providing an opening statement in response to my landlord's UD allegations. 

 

Furthermore, my landlord's frustrations are regarding the communications given to him by Abode, HomeFirst and The HealthTrust. 

 

Should I be asked why I was unable to pay my rent, my only breach was that I could not pay 2050.00 when I paid 352.00 only on 35 days' notice. 

 

Furthermore, why would my landlord ask me to reach out for emergency fund relief to pay this month's rent when my landlord knew that I could only receive that assistance under the condition that I had planned to stay in the apartment.

Mr. Chicoine,

My case-manager from HomeFirst always addressed the lack of funding or grants for supportive housing. 

As a result, I had made the mistake of telling my landlord that I had been writing to several government agencies, such as US HUD Secretary Ben Carson and California Congressman Devin Nunes reporting on the housing crisis in Santa Clara County. 

This was done in good faith. When HomeFirst Case-Management, mentioned that there was a lack of grants or program funding to house me( while I am in cue to be transferred to a permanent supportive housing voucher.) I had never been presented with an ideal exit destination.

Attached are just some of the materials I would show my landlord so that when he reached out for assistance, and in the event, he felt "trivial" as to whether it was worth his effort to keep me in his apartment complex. This way, I could show my landlord I was proactive( the material contains information concerning housing vouchers and veterans). 

After three weeks, Alfio John Ragonesi declared he spent ”hours” on the phone with Abode and The HealthTrust and that he was very disappointed in me since I did not get another subsidy. 

I had no way of verifying if he had spent hours on the phone. Using your judgment, Mr. Chicoine, would that be a form of discrimination or retaliation by the landlord?

HOMEFIRST SERVICES OF SANTA CLARA COUNTY DISCRIMINATION HUD TENANTS RIGHTS

Hi Pauline,

What is the HUDs role with the RRH program or with my landlord's obligations to tenants? It seems that the only times' attention is brought to tenants' rights is when having the need to pass an inspection. 

I recall, when I was first enrolled in the program, Abode Services was very strict and maintained a very high standard for clients when it came to doing the first inspection of any needed repairs, etc prior to moving in. The landlord was very enthusiastic about getting any and all repairs fixed before the move-in date.

After moving in, case-management or any type of support significantly dropped. Over the course of 24 months, the landlord used me to keep an eye out for other tenants engaging in suspicious activities. I had often witnessed strangers coming in and out of other tenants' units. 

This very moment several people and whole families are staying or coming in and out of one of the units for the past couple of weeks. Sometimes I witness child abuse and no one seems to do anything about it. 

I had brought it up to Marlene, my first case-manager because it made me extremely uncomfortable. 

At first I thought the daily abuse was so violent that my case-manager, Marlene, did not want to get entangled with those tenants or report it the agency or to authorities. It appears that was not the case. 

My neighbor who smokes cigarettes and has 11 DUIs flicks his cigarettes at the neighbor's rooftop when he's intoxicated and on numerous occasions.

After my neighbor had denied setting the front porch of the apartment complex on fire and claimed to have been sleeping because he has sleep apnea and couldn't remember. This happened at around 6 in the morning. 

The fire department had to come to the apartment complex that morning when I was sleeping and it was not until days later that I had been told about the incident. 

I became extremely worried that the neighbor's rooftop( it's a home with several roommates who go to San Jose State University) would also catch on fire and there would be no witnesses or anyone to hold accountable. 

My neighbor also drove his vehicle extremely intoxicated ( I could not even imagine him making it out of the alleyway without crashing and causing an accident with a pedestrian) on several occasions until it caught on fire at Valley Medical Center. 

My neighbor told me he ran into VMC and told the fire department who was investigating the incident he wasn't in his vehicle when his vehicle caught fire. Again, no one to hold accountable.

Hi Pauline,

At this time, the short time frame the landlord has given me to dispute that his expedited eviction was not done in good faith and my limited ability to openly communicate with case-management will make it much more difficult to meet in person. 

When undergoing traumatic events, I communicate most effectively in writing. Most importantly, this enables me to better retain information and be more proactive. 

Starting the program felt I was treated fair. It was not until the last 3 months at HomeFirst that I began to feel discrimination, prejudice, or bias towards me at home first. 

If you can answer my questions or provide me with resources via email or regular mail to the mailing address I provided, that would work best. 

Since the landlord's demeanor has changed drastically(putting profits over tenants' safety), I am providing a photo of the rooftop where my neighbor flicks his cigarettes to show that I have some plausible concerns about the person in the neighboring unit starting a fire.

I had told the landlord numerous times that I had some concerns about the neighbor's home catching fire one day after being informed that a cigarette butt had burned the front porch. 

After seeing how upset the landlord had been about the damage that has been done to his property( Fire Department had to investigate, and I was told Abodes Legal Counsel had to get involved in protecting tenants rights), I feel the landlord would prevent being held liable for not informing the neighbors sooner about a potential risk of fire. 

 

Again, If you can do your best to answer my questions or provide me with resources and expedite my case-file via email or regular mail to the mailing address I provided, that would work best.

I have an urgency because I need to know if any of my electronics were damaged due to the power surge, however I believe that having the surge protectors in place wouldn't have caused reversible damage to the electrical system, and shutting down half of the apartment. 

 

This is very important because I can't wait around I indefinitely if this is going to get fixed today or not, I depend on the electrical outlets working and my electronics working and I can't miss work, if nothing happens today I'll have to miss another day tomorrow. 

 

I had already told you about the lights in December and showed you a picture of the door on the side of the rear entrance that looked tampered and you said that it was just the old telephone lines. This is an on-going issue.  

 

Please excuse my frustration. But understand that if I don't have anyone look at this tonight the lights or other side of the apartment could go out too, it would be a second night staying out and not going to work.

2. I went got the documentation from a clinical case manager and social worker as she had told me to do.

4. Juan didn't call me back until last Wednesday on the way to the airport. 

 

5. You asked me on Thursday if I could go to scared heart on the following Friday to get emergency fund relief. Which I told you I did. 

 

6. You then told me you would take out 68.33 from my rent per day

 

7. About 7 of 8 days later Juan Guel called me back and that's was where you started changed your behavior. Which was this week. 

 

8. You said the 68.33 was breaking the contract you were doing it to be nice but you changed your mind. 

 

9. You asked me to write a response to your letter I just received declaring all of the above.

I, ADRIAN QUIRARTE, AM A TENANT AT XXX S. 5TH STREET XXXX SAN JOSE CA 95122. 

FOR THE LAST TWENTY-FOUR MONTHS, I HAVE PAID A SUBSIDIZED PORTION OF THE FULL AMOUNT OF 1850.00 THE RENT, RANGING FROM EIGHT HUNDRED AND SIXTY-SEVEN DOLLARS TO THREE HUNDRED AND FIFTY-TWO DOLLARS. LESS THAN A HANDFUL OF TIMES, I PAID MOSTLY IN CASH.

ON FRIDAY NOVEMBER 1ST 2019, YOU REQUESTED THAT I WRITE YOU A LETTER, TO BE SPECIFIC WITH DATES AND TIMES AND THE AMOUNTS I NEEDED RECEIPTS FOR. I PAID IN CASH, AND YOU HESITATED TO RESPOND TO ANY QUESTIONS REGARDING YOUR ACCOUNTING PRACTICES.

THIS CAME AFTER YOU HAD THREATENED TO WITHHOLD RECEIPTS FOR ALL PRIOR CASH PAYMENTS. AND UNLESS I PAID RENT FOR THE MONTH OF NOVEMBER, YOU WOULD NOT PROVIDE ME WITH THOSE RECEIPTS. THE FULL RENT OF 1850.00 HAS BEEN PAID WITH A TENANT BASED VOUCHER FROM ABODE SERVICES AND HEALTH TRUST FOR 24 MONTHS. 

I RESPONDED ON SEVERAL OCCASIONS, USING YOUR JUDGEMENT HOW YOU CAN  EXPECT ME TO PAY THE FULL AMOUNT OF 2050.00 WHEN I ONLY RECEIVE 1.5 TIMES THAT AMOUNT FROM SOCIAL SECURITY DISABILITY BENEFITS FOR THE ENTIRE MONTH IN LESS THAN 2 WEEKS NOTICE.

UNDER CALIFORNIA CODE OF CIVIL PROCEDURE §2075., I AM ENTITLED TO A RECEIPT FOR EACH RENTAL PAYMENT. FURTHERMORE, THE NOTICE YOUR ATTORNEY KIRKMAN J HOFFMAN LEFT ON MY DOOR NOVEMBER 4,2019 INDICATES IT WAS DONE IN GOOD-FAITH. 

YOU HAD WARNED ME SEVERAL TIMES THAT YOU WERE GOING TO TAKE OUT 68.33 EVERY DAY FROM MY DEPOSIT FOR THE MONTH OF NOVEMBER IF I COULD NOT COME UP WITH THE FULL RENT OF 2050.00. FOR TWO OR THREE WEEKS YOU ASKED ME TO CONTINUE TO CONTACT COMMUNITY AGENCIES AND SEE IF THEY COULD FIND A WAY TO PROVIDE ME WITH EMERGENCY FUND RELIEF SO THAT YOU WOULD NOT GO WITHOUT NEXT MONTHS RENT. LIKE MANY TIMES, YOU HAD ASKED ME TO MAKE STATEMENTS AND BEND THE TRUTH SO THAT YOU COULD SAVE MONEY.

YOU HAD IMPOSED THIS CHARGE OF 68.33 PER DAY AND THREATENED TO WITHHOLD FROM YOUR ATTORNEY RELEVANT INFORMATION THAT COULD ASSIST ME IN MY DEFENSE WHILE I WAS STILL PAID THROUGH THE MONTH OF OCTOBER.

FOR EXAMPLE, YOU TOLD ME THAT YOU HAD SPENT "HOURS" ADVOCATING FOR ME TO STAY SUPPORTIVE HOUSING AND CONTINUE TO RECEIVE ASSISTANCE IN THE FORM OF SUBSIDIZED PAYMENTS AFTER TWO YEARS OF BEING IN THE RAPID REHOUSING PROGRAM. YET, YOU CANNOT ADVOCATE FOR YOURSELF BEFORE A JUDGE AND PREFER TURN EVERYTHING OVER TO YOUR ATTORNEY TO FILE AN EVICTION. 

YOU HAVE BECOME VERY AGGRESSIVE OVER THE PHONE. YOU CONTINUE TO HOLD THE JUSTIFICATION THAT YOU DID NOT WANT TO EVICT ME THROUGH LEGAL PROCEEDINGS BECAUSE IT COULD COST YOU ANYWHERE FROM FOUR TO FIVE THOUSAND DOLLARS, AND YOU HAD PROMISED OTHER TENANTS THE APARTMENT NOVEMBER 1ST, 2019. 

I HAVE RESPONDED TO PLEASE KEEP IN MIND THAT GOOD-FAITH IS DEFINED AS AN ABSTRACT AND COMPREHENSIVE TERM THAT ENCOMPASSES A SINCERE BELIEF THAT OR MOTIVE WITHOUT ANY MALICE OR THE DESIRE TO DEFRAUD OTHERS.

FURTHER, I MAY DEMAND A PROPER SIGNATURE TO SUCH RECEIPTS AS A CONDITION OF TAKING CASH PAYMENTS.

My skepticisms are that if I had done exactly as the landlord had pressured me to do, I would not be able to provide a response or advocate for myself due to the lack of resources. My landlord told me during these last couple of weeks my health was not his problem, furthermore that ”he was not my care-taker” ( I wondered what kind of caretaker would take someone off life support when not receiving their monthly salary!).

My landlord suddenly became a Strange Case of Dr. Jekyll and Mr. Hyde. In addition to restricted access and asthma attacks, I would not have electricity, internet access, my property, clothing, my computer, printer, paper, bathroom, running water, washer and dryer, kitchen, and a safe place to sleep or continue to use life-sustaining medical equipment.   

Furthermore, my landlord tried to bribe me/ or pay me off with my own rental deposit to leave quickly and quietly, as my landlord formulated it; it was a cheaper option than filing an eviction. My landlord gave statements this past week that I did not pick up the phone when he called. This was false.  

This reflects poorly on the landlord because he tried to persuade me to move out within three days' notice by using my deposit as leverage since he has other tenants who want to move into the unit.

The fact the landlord falsely alleged to other individuals that he tried to call me and I did not answer, raises some concerns that he could do the same and tell others I did not answer when returning my deposit.   

”Please keep in mind, that my landlord can do all of that which I have documented to past and future tenants.”  

In any case, a landlord alternative option besides unlawfully removing the tenant is called ”Cash for Keys.”-And depending on the circumstances, it may or may not be illegal, but it's fundamentally dishonest.
