These excess cartridges were sent to me via my enrollment in the program. 

I talker with A HP rep and was told that they will not provide credit for the cartridges and moreover they will send me more if I continue the program.  If I drop the instant ink program, I will not be able to use the excess cartridges because they can control the recognition of cartridges thru the internet connection and built-in software.

I have in effect paid for these cartridges thru my enrollment in the instant ink program and the use should be at my discretion.  If what they are doing is not illegal, it surely is not an ethical business practice.

That is incorrect. The program charges you for the number of pages you print per month, not how much ink you use. You are charged the same amount if you printed a page with a single word, or a page that you fill entirely with black ink.

They send you cartridges as part of this program when they show you are low on ink. Unless you have multiple printers, the mystery is how you got so many extras. But even if they sent you a few dozen cartriges they are still part of the "program" and you are only paying for the number of pages you are printing...not the number of cartridges.

There is nothing unethical about this, as this is exactly what you agreed to when you signed up for it.

By the way don't think I am defending them, I am just telling you what you signed up for. I personally don't use this service as if you look at the numbers for most average people it seems cheaper to just go get your own cartridges, you are really just paying for the "convienience" of having a cartridge mailed to you.
