Bennys Smog Check Tested a car knowing it would fail, wouldn’t honor retest. Rialto California
I took my vehicle in to get a smog test done. He came back about 5 min later saying that the check engine light was on and that he failed it and I had to pay the fee. He said I could bring in back to get retested after I got it fixed.
I went to retest and he said I had to pay full price even though he wrote down that he would retest for a different fee. He would not honor his promise and I believe he intentionally fails cars to scam people. People in front of me were mysteriously failing too. I've never been to a shop where almost every car fails.

A "Check Engine Light" is an instant failure for the Smog Test. There is no mystery about that. The fact is that you shouldn't have even taken it in with the Check Engine Light on.
One thing you left out is what was the repair you had to make?
Without knowing exactly what was agreed upon in writing it's hard to say. So out of curiosity what did you pay for the first one you failed on? What price did he agree to in writing for the re-test? Did you take the original document showing the price he agreed to do the retest when you went back?
