Sadly, I know what you are going through. Ameriquest also tried to take my home last year after I was hospitalized from domestic abuse, paying for an expensive divorce and finally, filing bankruptcy. If there is any way you can pay your bills without filing bankruptcy, do it. If my ex had not run up over $80,000 in credit debt I would never have filed. I am having trouble finding someone who will refinance so I can end the "Ameritheft nightmare". So, if at all possible, try not to do it. I will be unable to purchase anything on credit for SEVEN years. Also, I agree with Barbara. Write to your governor, senators and most definately the Attorney General. I am in contact with them now. I have been speaking to Arlene Baldwin and she has been wonderful. But, beware, Ameriquest is sending her letters as fast as I am with one exception.....my letters and documentation is factual while Ameriquest's is not. Just don't give up! That's what Ameriquest wants. They are theives, liars and fraudulent. They are the lowest of low. If, and when, I can refinance, I will do so but I will have to pay Ameriquest approx. $6,000 to do it. But, it will be worth it. They are charging me expenses and fees (which they won't explain) that are unrealistic every month. And the late charges are amazing. Also, they have tacked on thousands of dollars for their bankruptcy attorney. I filed a Chapter 7 and my attorney contacted Ameriquest with documents that I would continue to pay my mortgage. Do they care what kind of bankruptcy you file? NO! That's another thing you would have to deal with by filing bankruptcy. They will also charge you with misc. bankruptcy fees and property inspection fees to see if the property is abandoned even though they know it is not. Most importantly, contact the Attorney General. If more people continue to do so, maybe we can get Ameriquest investigated and something will be done to stop their unethical practices. Good luck and keep with it. Just know others, many others, are going through the same grief as you. We cannot give up and let Ameriquest win.

I spoke to a lawyer, and now I'm trying to file bankruptcy so I can protect my house. Is that a good idea?

Dear Mother, Per usual I am reluctant to respond to your brand of pleas for help because many years ago I went through the same type trauma. When I opened myself up to helping others, I was stunned to find out people all over the country were in the same state of emergency distress and honestly, this sad state of affairs gives me nightmares. Also, by helping others I found opened myself up to additional retaliation. Not everyone involved in this wants the abuse to end. Some are getting rich off it and are very motivated to see this continue. That said, I will try to respond. Ameriquest foreclosed on a friend and his lawyer found out the bank was trying to do it in "secret". Basically the process server said the suit was undeliverable because the address was "abandoned" with "utilities off". That of course was not true as the man was raising his son alone and the power company records showed no interruption of power. Once that was dealt with, he arranged an agreement with a local investor to buy the judgement from Ameriquest directly. But then, lo & behold, the investor came back on the friend for more. In other words, he had a mortgage on 4 parcels only. He was foreclosed on 4 parcels only. The final judgement was "accidently" for 5 parcels! Please proceed with caution. Make sure you go to the courthouse and get copies of what is filed. Documents may "disappear" or become "different". It is very sad to believe that public records are not safe, in this time though mom, you will have to protect yourself and the children. To go into a lawsuit against them can costs millions and steal about 7 years of your quality of life. In addition to making copies AT the courthouse of the file, write a letter to your local newspaper editor, and call your state Attorney General immediately. Then ask a local attorney to file an Emergency Petition for you to ask the judge to Not let Ameriquest proceed until they provide the Court with an accounting and explanation of the fees. Write to your Senators, Congessional, and try to visit local Representative in person for help.A Good Luck. My Heart Goes Out to You and Yours.
