I know exactly how you feel. Ameriscum messed me up by returning my partial payments a couple of years ago after telling me I could send them. I was also told I did not qualify for their non-existent hardship program. I did file a Chapter 7 since my ex had maxed out every credit card he could but, believe me, AMQ will still try to take your home. I reaffirmed but they screwed around with the paperwork until they could send foreclosure documents. This company is a piece of s**t. I don't mean to use profanity but I can think of no other word to describe it. If you do decide to file a Chapter 7, please get a good lawyer. My neighbor works for one and I went with him because she said he was good. Well, he was not. I found later that since my ex had signed the credit card bills, some in my maiden name before we were married, I could have sued him and all responsibility would have gone to him. But, at the time, credit card companies are relentless and tell you all kinds of things that makes you believe you better file or pay up. Credit card companies are almost as bad as this stinking company with all the harrassing phone calls. And as long as you are with AMQ, they will continually raise you monthly payments. My payment started at $1,141 (when I had 2 incomes) and is now $1,400. I wish you luck and don't give up. Find a good attorney and keep your home. Take care.

First I know about that whole lien thing with the seller, I am sorry that your realtor did that to you:( Your attorney should have caught that before/during closing. Ameriquest will not take partial payments because then they have no grounds to forclose. Chapter 13's stink, been there tried that too, chapter 7, well that is a gamble with AMC depending on wether you reaffirm or not. It sounds like you really are trying to keep your house. There are several websites availible with great info on how to get where you need to be, I would suggest talking with an attorney and getting their thoughts on this matter. Read Ken's= Holland MI. posts. I would also suggest getting documents from AMC that gives a breakdown for what is owed. Go over it with a fine tooth comb. Is your sale next week or they are starting the process next week? This answer will give you a guess-timate of how much time you have to do research. It takes a little time to get through the forclosure process. I can only try and help with certain things, I don't claim to be an expert. Please also remember that mortgage companies are on these websites all the time and read these posts and sometimes they fish for info like real people that have been hurt. Don't give up, my attorney got my sale cancelled 1 day prior to the sheriff's sale. Don't let the bastards beat you down! Good luck:)
