Aformer employee of First Union Mortgage and her parents defrauded me. In june of 1992 I was forced into purchasing a moble home that I didn't want or need. My wife started college in fall in nineteen- ninty eight and took a business law class. She would ask questions because I had a house taken away in this transation. Susan Mattison Jones was an employee of First Union in nineteen ninty two. She told her boss that the property had belong to her dad and she was allowed to do all the paper work on this loan.
I couldn't afford this loan; however, her and her parent placed money into my account for me to qualify. I found out by going through our documents in nineteen ninty eight that ms.Jones, is on my deed in which she wasn't supposed to have anything to do with because she said that it was her father's.
June 1992 my wife had wrote the attorney general because the house was in poor conditions and the seller wouldn't repair anything, my wife had told him that ms.Jones was an owner because she was on the buyers warranty as a seller.
Ms. Jones, had assured me that it was a mistake by the real estate agent and I took her word thinking it was an honest mistake.
I hired an attorney in Dec. ninteen ninty eight after finding ms. Jones listed on my deed, the attorney told us that we had a good case so I accepted a job in another state and I moved my family also because the lawyer told me he was working to have the problem resolve. I am still making payments on a house that is not mine and he is doing nothing on my behalf.
A hearing was held in August of ninteen ninty nine for a dismissal. The judge had ordered all the lawyers that was involved to go to the closing attorneys office to look at the title and told our attorney to asked us if everything was okay would we let it go. We said no and our attorney told us he was tired of working on the case what a statement for attorney Jerome Willingham, to say to us after we had paid him over three thousand dollars.
My attorney, after lookng over the document at the closing attorney's office, he stated that ms. Jones was the owner of the house and that she had paid fifteen thousand dollars for it. There was no renovation done to this place. Mr. and Mrs. Mattison, told us that the house was thirty five thousand and the land was fifteen thousand dollars this brought the total to fifty thousand dollars.
In their reply to our lawsuit they stated we paid fifteen thousand dollars for the mobile home and that the hous had belong to a mortgage company, I paid fifty thousand dollars for a peice of junk. The lawyer that was supposed to have represented First Union has the last name as the closing attorney.
My wife was curious, she called First Union and asked if they had received a lawsuit aganist them on our behalf and she was told no. I made a call to First Union and was told by someone in the legal team that the company never received a lawsuit, they asked what address was the papers sent to. I told her and she told me that the address didn't exsist and the office was closed in ninty two.
My lawyer had documents with accurate address that he could have used so I don't know where he got that address from for its no where in my documents.
The attorney that I hired does not return my calls.
I want all the money that I have paid into this mortgage which totals $41,508.74 to date, we also want interest plus punitive damages I don't have a set amount for the punitive damages, also want money back for the repairs I made which total over $5,000.00. I also want my house back that they took away with the back rent that Mrs. Susan M. Jones, owes me for living in my house that she took.
