 I was call in to see safety after coming off my delivery and given a three day suspension. After returning to work I was told I had to see safety again and was not told why, after waiting for forty- five minutes and nature calling I was told by the front desk they will see me now. Once in there I was told that I had to take a drug test.

 

After agreeing to the test we proceeded and I told them that nature had call earier, so we waited for three hours and was not able to give them what they wanted, so they put me on a week suspension to see my doctor and get a letter stating my problem. My forward the letter to them and after a week of suspension I call to return back to work, I was told that my suspension could last up to to a month.

 

I couldn't wait a month so went out to seek other employment, a week later they put in my file and on my dat that I was discharge and the reason was that I refused to take a drug test which are all lies.

 Don't know what was in the letter that the doctor fax to them, but I'm sure it contain words on my medical condition. Despite the DOT definition of refusal a person has to say no or don't show up, beside the DOT can't predict someones body. Also if you are call in to safety once you report to them they need to inform you why you are there.

 

I was given the three says for electronic logs viloation, I can live with that.

First, I don't work for them.

As you reported, you couldn't provide a urine sample after three hours.  Drinking water during that three hour period should enable anyone to provide a sample.  The three hours is the D. O. T. limit.  After three hours, the company can consider it a refusal or send you to a doctor to see why you can't provide a sample.  That's what they did.  What was in the report the doctor sent to them?  Why were you initially given a three day suspension?
