In April 2002, in defense of Our Country in retaliation for actions on September 11th (at age 25), I enlisted in the United States Air Force. Already having my bachelor's degree (and in the midst of attaining my master's degree), enlistment in the armed forces seemed to be the most efficient manner in which to serve my Country and avenge the atrocities committed against Us.

 Subsequently, I was deployed twice during my enlistment (from 2002 to 2008). Once to Baghdad, Iraq and once to Balad, Iraq; both times in the midst of combat zones, I was 'fired upon,' bombed and mortared, missle-attacked yet survived, even enduring the near-death of one of my troops from a roof being blown off a building, landing where my troop once stood.

Before achieving my third deployment to a combat zone, I chose to save the wavering mental health I was able to maintain during that time, and I opted for a decorated Honorable Discharge in April 2008. Sometime during 2006, I chose to receive the services of a credit card attributed to Capital One (MC/Visa), as a result of belief in myself to maintain societal functionality and gain a more financially stable station.

I was unaware (at that time) I was (and, had been) suffering from Post-Traumatic Stress Disorder and Tremors. Later, after Honorable Discharge, I was diagnosed with a terminal illness and, in 2011, a 6mm brain aneurysm on my left-carotid artery from a 'blow' I received to my head. Shortly after my Honorable Discharge in 2008, my life imploded around me.

Unemployment, societal dysfunction, marital discourse and decimation of all functionality, to include the diagnosis of a terminal illness consumed my life. Not to mention the embarassment, humiliation and disgrace of achieving the attrition of the person I once was. I, and through my 'demonically-conceived' devices, drove my wife and me into utter financial devastation.

Finally on June 27, 2011, I began to try to put my life back together through a debt settlement program of a nationally-known and nationally-reputable debt settlement agency. Capital One (MC/Visa) was a deliquent account placed in the debt settlement program, in order for this agency to recover the borrowed funds totalling near $1,500. On August 5, 2011, my delinquent account was sold to 'junk-debt collector' NCO Financial Systems, 507 Prudential Road, Horsham PA 19044, (866) 437-7403, with mailing address: PO Box 15894, Wilmington DE 19850-5894.

On August 15, 2011, my legal representative from the debt settlement agency from which I receive representation was notified my delinquent debt was 'sold' to: Monarch Recovery Management, 10965 Decatur Road, Philadelphia PA 19154. After receiving notification from my legal representative, Monarch Recovery Management 're-sold' the delinquent debt to Capital One (MC/Visa).

Even with debt settlement in progress through legal representation, on April 4, 2012, I was served with a 'Summons & Complaint' by a court official process server of the State of Michigan-5th Judicial Court at my home-of-record by Jonathon A. VanGemert of Weltman, Weinberg & Reis, Co. LPA in representation of plaintiff, Capital One (MC/Visa) demanding prosecution and immediate payment in full. On April 17, 2012, my legal representative was served with the appropriate documentation, by my hand, with total disregard to my legal rights or representation or ability to recover any delinquent debt.

On April 25, 2012, my legal representative was served with documentation of the malificent Jonathon VanGemert of Weltman, Weinberg & Reis, Co. LPA of Troy, Michigan demanding my appearance in Berrien County Trial Court, State of Michigan-5th Judicial Court, authorized by Hon. John M. Donahue and notarized by Cynthia Killeeney, Deputy Clerk, demanding I appear in court for charges against me to prosecute me for a delinquent debt I previously assumed debt recovery payments and for which I have previously assumed responsibility.

As a result, I charge I am being unduly prosecuted with prejudice, abuse of the judicial system by Jonathon VanGemert of Weltman, Weinberg & Reis, Co. LPA, discrimination based on disability and military service, refusal by Jonathon VanGemert of Weltman, Weinberg & Reis, Co. LPA to resolve these matters thereby incurring further mental anguish and detriment to my well-being and that of my family for the purpose of further financial gain for themselves, deleterious actions to the detriment of the plaintiff and me, the Defendant, and incompetence to resolve matters in the least restrictive and uninclusive manner resolute of government agencies.
